AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
AMENDING APPENDIX A, ZONING, OF THE CODE OF ORDINANCES
BY AMENDING SECTION 24, AMENDMENTS, BY ADDING SECTION
24-102, ADMINISTRATIVE AMENDMENTS, PROVIDING FOR STAFF
TO APPROVE CERTAIN DEVELOPMENT REGULATIONS;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALER
CLAUSE; PROVIDING A PENALTY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, all developments and development regulations within the City must be
approved by the city council at a duly called and posted meeting; and
WHEREAS, after receiving approval from the city council, any change or amendment to
any development regulations must also be granted or denied by the city council, at a duly called
meeting, upon giving proper notice; and
WHEREAS, currently there are not any prOVISIons III Appendix A providing for
Administrative Amendments to any development regulations; and
WHEREAS, the city council has determined that it would be in the best interest of the City
and its developers to amend Appendix A of the Code by adding Section 24-102 to provide for
administrative amendments to certain development regulations as provided herein;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS:
SECTION 1. That the Code of Ordinances of the City of The Colony, Texas be hereby
amended by amending Appendix A of the Code by adding Section 24-102 to provide for
administrative amendments to certain development regulations, which shall read as follows:

The Director of Development Services or successor may approve an
administrative development regulations to provide for:
(1) substitution of approved landscape materials on any approved landscape
plan;
(2) amend the orientation of any building on an approved site plan, except
such orientation amendment may not change the set back requirements
contained in this Chapter;
(3) substitution of building materials of like kind on any approved site plan
or planned development;
(4) adjustment not to exceed ten percent (10%) on side or rear yard setbacks
under the terms of this Chapter;
(5) amend the orientation or location on any monument sign permitted under
this Chapter;
(6) any application for an administrative amendment under this section may
only be approved where the need for the amendment will ensure the
protection of the adjacent property and does not otherwise adversely
affect the health, safety and welfare ofthe City. "
SECTION 2. If any section, article paragraph, sentence, clause, phrase or word in this
ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional by
a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions
of this ordinance; and the City Council hereby declares it would have passed such remaining
portions of this Ordinance despite such invalidity, which remaining portions shall remain in full
force and effect.
SECTION 3: That all provisions of the Ordinances of the City of The Colony, Texas, in
conflict with the provisions ofthis ordinance be, and the same are hereby amended, repealed, and all
other provisions of the Ordinances of the City not in conflict with the provisions of this ordinance
shall remain in full force and effect.
SECTION 4. That all provisions of the Ordinances of the City of The Colony, Texas, in
conflict with the provisions of this ordinance be, and the same are hereby amended, repealed, and
all other provisions of the Ordinances of the City not in conflict with the provisions of this
ordinance shall remain in full force and effect.
SECTION 5. Any person, firm, or corporation violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor and, upon conviction in the municipal court
of the City of The Colony, Texas, shall be punished by a fine not to exceed the sum of Five

Hundred Dollars ($500.00) for each offense. Every day a violation occurs shall constitute a
separate offense.
SECTION 6. This Ordinance shall become effective from and after its date of passage in
accordance with law.
