MINUTES OF THE PLANNING AND ZONING COMMISSION
Meeting held on Tuesday, January 10,2006

After determining that a quorum was present, the Planning and Zoning Commission
of the City of The Colony, Texas convened into Regular Session which was held on
Tuesday, January 10, 2006 at 6:30 pm in the City Council Chambers located in City
Hall, 6800 Main Street, The Colony, Texas, at which time the following items were
addressed:
Commissioners Present: DeVille Hubbard, Marlene Milsak, Brian Wade, Jeff
Connelly, Karen Hames, Mike Barrett, Debbie Morrison
Staff Present: Donna Bateman, Planning and Development Services Director, David
Dodd, City Attorney, Lauren Odell, Planner I
11.0 1 CALL REGULAR SESSION TO ORDER
12.0 I DISPOSITION OF MINUTES
2.1 Consider approval of the minutes of the October 11, 2005 work session and
regular session.

Consider approval of the minutes of the November 15, 2005 work session and
regular session.

Commissioner Connelly motioned to approve the minutes of the
October 11, 2005 meeting. Commissioner Milsak seconded.
Motion carried (6-0), Commissioner Barrett abstained.
Commissioner Connelly motioned to approve the minutes of the
November 15, 2005 meeting. Commissioner Hubbard seconded.
Motion carried (7-0)
13.0 I PUBLIC HEARING
3.1 Hold a public hearing and consider making a recommendation to the City
Council regarding an amendment to the Code of Ordinances, by amending
Appendix A, Zoning, Section 10-100 concerning automotive and boating uses
(SI05-0024).
This item was pulled at the request of staff and will be returned in a
different format during the January 24, 2006 meeting.
3.2
Hold a public hearing and consider making a recommendation to the City
Council regarding an amendment to the Code of Ordinances, by amending
Appendix A, Zoning, Section 10-900 concerning Specific Use Permits (S105-
0029).

Ms. Odell presented a staff report regarding making a recommendation to the
City Council regarding an amendment to the Code of Ordinances, by amending
Appendix A, Zoning, Section 10-900 concerning Specific Use Permits.
Commissioner Connelly asked if the criteria should be more specific.
Mr. Dodd stated that the criteria was specific and captured everything.
Ms. Hames asked if environmental control should be added.
Ms. Odell stated that Section E has language for environmental control.
No one was present to speak in favor or in opposition of the request.
Commissioner Hubbard motioned to recommend approval of the request
with revisions noted by the Commission. Commissioner Barrett seconded.
Motion carried (7-0)
3.3
Hold a public hearing and consider making a recommendation to the City
Council regarding amendment to the Code of Ordinances, by amending
Appendix A, Zoning, Section 10-100 concerning farm or ranch uses (SI05-
0025).

Ms. Odell presented a staff report regarding making a recommendation to the
City Council regarding an amendment to the Code of Ordinances, by amending
Appendix A, Zoning, Section 10-100 concerning farm or ranch uses.
Ms. Hames asked why pigs, chickens, cows and turkeys... were not included.
Ms. Odell stated that the ratios were put in and then the definition refers back to
the chapter of the City of The Colony Code of Ordinances which addresses
livestock.
Ms. Morrison asked what was required by the Appraisal District to be
considered Ag exemption.
Ms. Odell stated that a number of livestock is not required just some for.11 of
agricultural activity on the land.
Mr. Connelly would like to require an applicant to get a SUP for agricultural
property.

with the revision to require a specific use permit. Commissioner Hubbard
seconded.

3.4
Hold a public hearing and consider making a recommendation to the City
Council regarding an amendment to the Code of Ordinances, by amending
Appendix A, Zoning, Section 10-702 concerning accessory uses and amending
the Code of Ordinances, Chapter 6, Buildings, Construction, and Related
Activities, adding Article IX, Sections 6-150 through 6-160 (SI05-0009).
Ms. Odell presented a staff report regarding making a recommendation to the
City Council regarding an amendment to the Code of Ordinances, by amending
Appendix A, Zoning, Section 10-702 concerning accessory uses and amending
the Code of Ordinances, Chapter 6, Buildings, Construction, and Related
Activities, adding Article IX, Sections 6-150 through 6-160.
Mr. Hubbard questioned the description of storage buildings in Table 1.
Mr. Dodd and Ms. Bateman clarified the wording.

Mr. Connelly asked if section 6-153K hinders residence from putting a washer
and dryer and things of the sort in a detached garage.
Ms. Bateman stated that residence can tie in from the main house as long as it is
on the same meter.
Mr. Connelly asked if section 6-154B pertaining to patios and decks, required
second story decks to be blocked from sight.
Ms. Bateman stated that this pertained to first level patios and decks but that a
sentence can be added stating that this does not apply to second story decks.
Mr. Connelly asked if section 6-159B, standards for swimming pools and hot
tubs, impacted people with side yards.
Ms. Bateman stated that it does not because setbacks are determined in platting.
Mr. Connelly asked if the current property owners would be affected if this
were to pass.
Ms. Odell stated that this would only affect property owners with attached
accessory structures.

Ms. Milsak asked if the structures built beside the garage would be allowed to
stay.
Ms. Bateman stated that a non conforming accessory structure can continue to

Ms. Bateman stated that a non conforming accessory structure can continue to
be used as is but if destroyed or demolished that it could not be rebuilt.
Mr. Connelly questioned why the BOA and P&Z were not included as part of
the process for special exemption procedures.
Ms. Bateman stated that state law and zoning ordinance does not allow the P&Z
to hear this type of case. Weare requesting that it be moved from the zoning
ordinance to the building and minimum standards chapter to give it the
opportunity to go to CC.
Mr. Connelly asked if we were reducing the percentage oflot coverage.
Ms. Odell stated that the current ordinance is 40 percent. Lot coverage is not
being reduced.
Ms. Rita Webster, 5417 Sutton Place asked if she built a garage if it would have
to be of the same percentage of brick as the house.
Ms. Odell stated that each wall would need to be 70 percent masonry.

Commissioner Barrett motioned to recommend approval of the request
with the revision to extend water and sewer lines to detached garages.
Commissioner Connelly seconded.
Motion carried (7-0)
