CITY OF THE COLONY, TEXAS
RESOLUTION NO. 06- (/)/<p
A RESOLUTION OF THE CITY OF THE COLONY, TEXAS, ORDERING AN ELECTION
OF THE QUALIFIED VOTERS OF SAID CITY ON THE THIRTEENTH DAY OF MAY
2006, FOR THE PURPOSE OF ELECTING THE MAYOR AND TWO
COUNCILMEMBERS FOR SAID CITY.
WHEREAS, the term of office of the Mayor and two (2) Councilmembers presently on the
City Council expire May 13,2006; and
WHEREAS, it is hereby found and determined by the Mayor, acting in his official capacity,
and the City Council acting as the governing body ofthe City that it is in the best interest ofthe City
and its citizens to hold an election for the purpose of electing the Mayor and two (2)
Councilmembers to the City Council Places 1 and 2; and
WHEREAS, Election Code, Section 3.004 authorizes such election; and
WHEREAS, Election Code, Section 41.001 specifies the date on which such elections may
be held;
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS:
Section 1. That a general election be held in and throughout the City of The Colony, Texas
on Saturday, May 13,2006, at which all qualified voters residing within the city limits of the City
may vote for the purpose of electing the Mayor and two (2) Councilmembers to serve on the City
Council Places 1 and 2.
Section 2. That the City election precincts for this election shall consist of the territory
situated within the various Denton County election precincts located within the corporate limits of
the City and bearing the following numbers, and the polling places of said election shall be as
follows:

Section 3. That voting at and on the date of said election shall be by optical scan ballot and
disabled access units, or by any other method as approved in the Texas Election Code, as amended,
and said ballots shall be printed in accordance with the Texas Election Code, as amended.
Section 4. No person's name shall be placed on the ballot as a candidate for the position of
Councilmember of the City Council until such person has filed his/her sworn application and
affidavit as provided by the laws of the State of Texas and the Charter of the City of The Colony,
Texas with the City Secretary at least sixty-two (62) days prior to the election date.
Section 5. All eligible City of The Colony voters shall cast their ballots at the aforementioned
Polling Places. The polls shall be open between 7 :00 o'clock a.m. and 7 :00 o'clock p.m. on May 13,
2006.
Section 6. As to early voting for said election, optical scan ballots shall be used, as well as
disabled access units, and such early voting shall be conducted by the City Secretary, who is hereby
appointed the Clerk for Early Voting, at the City Secretary's Office at City Hall, 6800 Main Street,
City of The Colony, Texas. The dates for early voting are May 1 - May 9,2006. For the period
early voting for said election is permitted by law, the Clerk shall keep said office open for early
voting during regular working hours of each workday. For the purpose of additional early voting the
Clerk shall keep said office open on Saturday, May 6,2006 from 8:00 a.m. to 5:00 p.m. Earlyvoting
times will also be extended on May 2 and May 4, 2006 from 7 a.m. to 7 p.m. The early ballots for
said election shall conform to the requirements of the Texas Election Code, as amended, and in so
doing shall permit the voters to vote for the Mayor and two (2) Councilmembers, Places 1 and 2.
Each elector shall mark the space provided beside each candidate's name that he/she wishes to vote
for, provided, however, that no elector shall vote for more than one (1) candidate for Mayor or
Councilmember in each Place.
Section 7. The city secretary shall receive applications for a ballot to be voted by mail until the
close of business on May 5,2006. Requests for applications should be mailed to: Christie Wilson,
City Secretary, City of The Colony, 6800 Main, The Colony, Texas 75056, or requested by phone at
972 624-3105.
Section 8. The election materials enumerated in Election Code, 272.005, shall be printed in both
English and Spanish for use at the polling place and for early voting for said election.
Section 9. Notice of said election shall be given by publishing the notice at least one time, not
more than thirty (30) days nor less than ten (10) days before the election, in at least one newspaper
regularly published in the City. A copy ofthe notice shall also be filed with the City Secretary and
another copy shall be posted on a bulletin board in the office of the City Secretary, at least twenty
(20) days before the election. The City Secretary ofthe City of The Colony, Texas shall keep a copy
of the notice as published, together with the name(s) of the newspaper(s) and date or dates of
publication.
Section 10. The City Secretary is hereby authorized and directed to publish and/or post, in the
time and manner prescribed by law, all notices required to be so published and/or posted in
connection with the conduct of this election.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS, TO BE EFFECTIVE this 6th day of February 2006.
