HomeMy WebLinkAboutResolution No. 05-110 ORIGINAL CITY OF THE COLONY, TEXAS RESOLUTION NO. 05- I \~ A RESOLUTION OF THE CITY OF THE COLONY, TEXAS, ADOPTING THE STREET NAMING AND STREET NAME CHANGING POLICY; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That the City Council of the City of The Colony, Texas, hereby approves and adopts the Street Naming and Street Name Changing Policy for the purpose establishing uniform guidelines to govern the naming and the changing of street names and other rights-of-way in order to avoid potential conflicting names and to promote the public welfare and general convenience of the community. Section 2. That a true and correct copy of the policy IS attached hereto and incorporated herein. Section 3. passage. That this resolution shall take effect immediately from and after its PASSED AND APPROVED by the City Council of the City of The Colony, Texas, this 5th day of December, 2005. Dillard, Mayor of The Colony, Texas STREET NAMING AND STREET NAME CHANGING POLICY BACKGROUND: Selection of street names must be done carefully in order to avoid duplication and confusing similarity not only within the City of The Colony but also with other cities and unincorporated areas of the City. The avoidance of duplication is necessary because of the use of multi-agency, computer-aided dispatching of fire, police and paramedic vehicles. Also, the U.S. Post Office has a policy of delivering mail only to addresses (both number and street name) assigned by the City with jurisdiction over the area. PURPOSE: The City Council desires to establish uniform guidelines to govern the naming and the changing of street names and other rights-of-way in order to avoid potential conflicting names and to promote the public welfare and general convenience of the community. POLICY: The City will work with the County, DENCO 911 and other governmental agencies within the County in the selection and approval of street names within the City by use of the following procedures: Naming of New Public or Private Streets: It is the policy of the City of The Colony that names for new public and private streets and other named rights-of-way be regulated as follows: A. A list of active street names will be maintained by the Planning Department and will be available for review on the department's web site or by request; B. Upon completion of a preliminary plat, all street names indicated on the plat will be reserved until completion of the final plat or for a period of 90 days, whichever is less; C. Street names are to be selected by the developer and submitted to the Planning Department as a part of the platting process; D. Street names are reviewed for approval by the Engineering, Public Works, Police and Fire Departments; E. Loop streets should be called "Circle"; F. Cul-de-sacs should be called "Court"; G. Duplicate street names will not be permitted unless the new street IS a continuation of an existing street or road; H. The use of street names with historical significance must be identified by the developer and kept on record within the Planning Department; Renaming of Existing Public or Private Streets: It is the policy of the City of The Colony to provide a process for consideration of the renaming of public and private streets located within the City limits. This policy does not alter the existing street naming policy for new streets. The following format provides a procedural and processing format to accomplish the City's policy. A. A request for a Street Name Change accompanied by a "Street Name Change Canvass Form" is submitted to the Public Works Department in the form of a completed application. See attached applications; B. Staff mails copies of the application to all affected property owners, identified by the Denton County Tax Assessor Rolls, which may be affected by the proposed street name change. The notice will explain the approval process and will be mailed at least 10 days prior to the Planning and Zoning Commission public hearing; C. Appropriate public agencies and other city departments are notified of the proposal and are requested to comment within 10 days of the public hearing; D. A public hearing will be scheduled at the Planning and Zoning Commission. A report on the proposal will be prepared by city staff and forwarded to the Commission with the application. Following a public hearing, the Planning and Zoning Commission will make a recommendation to the City Council; E. Prior to scheduling the item at a City Council meeting, the petitioner shall pay all costs associated with the street name change, including but not limited to, cost of mailing property owner notifications, newspaper notices (if any), production costs of new street signs, and labor associated with erection of new signs; F. A second notice is mailed to adjacent property owners at least 10 days prior to City Council meeting; G. Staff provides the City Council with a staff report including responses from adjacent property owners, city departments, and other public agencies. City Council will then take action to approve, deny or continue the request; H. If approved, the City Council will adopt a resolution renaming said street; 1.
