HomeMy WebLinkAboutResolution No. 05-95 1 RESOLUTION NO. 05- 95 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A CHANGE ORDER TO THE ENGINEERING SERVICES CONTRACT BY AND BETWEEN THE CITY OF THE COLONY AND HALFF ASSOCIATES TO REDUCE THE SCOPE OF THE WATER AND WASTEWATER UTILITY RELOCATIONS NEEDED FOR THE PROPOSED WIDENING OF F.M. 423, WHICH IS ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CHANGE ORDER; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City and Consultant have entered into an agreement such that the Consultant is to provide the following services: REDUCE THE SCOPE OF THE WATER AND WASTEWATER UTILITY RELOCATIONS NEEDED FOR THE PROPOSED WIDENING OF F.M. 423; and WHEREAS, the City has determined that it is in the best interest of the City to enter into the Contract Change Order with HALFF ASSOCIATES, which is attached hereto and incorporated herein by reference as Exhibit "A," under the terms and conditions provided therein. WHEREAS, with this Change Order the original contract amount is reduced by $259,952.00, leaving a balance of $26,948.00 for the original contract and work performed as agreed upon. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS THAT: Section 1. The Change Order, which is attached and incorporated hereto as Exhibit "A", having been reviewed by the City Council of the City of The Colony, Texas, and found to be acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all things approved, and the City Manager is hereby authorized to execute the Change Order on behalf ofthe City of The Colony, Texas. Section 2. That this Resolution shall take effect immediately from and after its adoption and it is so resolved. PASSED, APPROVED and EFFECTIVE this 17th day of Dillard, Mayor y of The Colony, Texas 63918 STATE OF TEXAS ) COUNTY OF DENTON ) CHANGE ORDER AND AMENDMENT OF CONSULTANT'S CONTRACT THIS agreement is by and between the City of The Colony, Texas, a Texas home rule municipality, and Halff Associates. Inc., hereinafter known as Consultant, a civil engineering firm, with principal offices located in Fort Worth. Texas. WHEREAS, the City and Consultant have entered into an agreement such that the Consultant is to provide the following services: Reconnaisance Phase Services for FM 423 Utility Relocations from SH 121 to the North City Limits. WHEREAS, the above referenced agreement provides that if there is a change in scope or focus of the activities in the contract, or an adjustment in services, it is necessary for the City to approve such change or adjustment in services, and WHEREAS, the parties recognize that the scope of work of work has been decreased to include only initial identification and inventory of FM 423 water and sanitary lines to be relocated and estimates of probable cost for those relocations, and NOW, THEREFORE, for and in consideration of the mutual acts and covenants set out herein, the parties agree as follows: 1. Consultant shall reduce the scope of work to include only initial identification and inventory of FM 423 water and sanitary lines to be relocated and estimates of probable cost for those relocations. 2. The amount to be paid to Consultant under such contract shall be decreased by the sum of $259.952.16, to reflect the revised scope of work described in Paragraph 1 above. The total amount of the contract is thereby reduced to $26.947.84. 3. This shall constitute an Authorization for a Change in Work as set out in the agreement between the parties, and an amendment to such contract. All of the terms and conditions of the original contract shall remain in full force and effect, as amended hereto, unless set out otherwise herein.
