MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING
HELD ON AUGUST 9, 2005
The Regular Session of the Planning and Zoning Commission of the City of The Colony,
Texas was called to order at 6:30 p.m. on the 9`h day of August, 2005 at City Hall, 6800
Main Street, The Colony, Texas.

With five (5) Planning and Zoning Commissioners present, a quorum was established and
the following items were addressed:
2.0 DISPOSITION OF MINUTES
2.1 Consider approval of the minutes for the July 26, 2005 regular session.
Commissioner Connelly motioned to approve the minutes. Commissioner Milsak
seconded.
Motion carried (5-0)
3.0 PUBLIC HEARING
3.1 Hold a public hearing and consider making a recommendation to the City
Council regarding an amendment to Planned Development One. The 0.157
acre tract is located northwest of the intersection of Lakeview Drive and
Northshore Drive, and is legally described as the west portion of Lot A, Block
14, of the Garza Lake Estates Addition (Z05-0006).
Ms. Odell presented the staff report regarding a recommendation on an amendment to
Planned Development One, northwest of the intersection of Lakeview Drive and
Northshore Drive, and is legally described as the west portion of Lot A, Block 14, of the
Garza Lake Estates Addition.

Mr. Richard Leary, 6869 Younger Drive, stated he and his wife have lived in the Colony
for about 11 years and want to build a house on the above mentioned property.
Mr. Mark Sellers, 4513 Northshore, stated he did not receive enough information to
determine if he was in favor or opposed.
Commissioner Hubbard asked if the center property was platted and if the property owner
has been notified to plat.
Ms. Bateman stated that the property has changed owners several times. Three different
owners own each portion. These are not the original owners that separated the property.
She recommends approving the amendment to the Planned Development and go in city
wide and fix every lot not in conformance. This will be done in addition to this request.
Commissioner Milsak asked if all the properties would be replatted.
Ms. Bateman stated that they would be rezoned or the ordinance would be modified. The
Leary's need to plat because this one lot was illegally separated into three lots. Platting
will be enforced at the time of the building permit. Regulations depend on the location of
the lot within the city.
Commissioner Connelly asked how far the property line was from the neighbors on the
west and east.
Ms. Odell stated that we do not have that information because we do not have a formal
survey on record of either property.
Commissioner Connelly asked if this request was not approved what could this property
be used for.
Ms. Bateman stated it would be an undevelopable lot.
Mr. Sellers stated he knows where the property line to the west is because he built a
retaining wall on it.
Ms. Elizabeth Sellers, 4513 Northshore, questioned distances on the side and front of the
property.
Commissioner Wade and Ms. Odell answered her questions.
Commissioner Connelly motioned to recommend approval of the amendment.
Commissioner Hubbard seconded.
Motion carried (5-0)

Ms. Bateman handed out the draft copy of the 121 Corridor Master Plan.

Zoning meetings are recorded and are a part of the permanent and public record of the

issues NOT on the posted agenda), during any PUBLIC HEARING (this form is not
necessary for public hearings), or for discussion of any POSTED AGENDA ITEM. All
comments must relate to the issue, and must be made to the Planning and Zoning
Commission as a whole, not to individuals. Comments will be limited to 5 minutes, and
each speaker will be allowed one opportunity to speak for each item requested.
All regular sessions are broadcast on our government cable channel, therefore, please
speak directly into the microphone (you may adjust it as necessary).
You may have your position recorded without speaking by checking the appropriate box.
If the information you have to present will exceed 5 minutes, the Planning and Zoning
Commission recommends it be submitted in writing to the Recording Secretary for
distribution to the Planning and Zoning Commission.
