ORDINANCE NO. 05 oJ 1(013
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS AMENDING THE CODE OF ORDINANCES BY AMENDING
CHAPTER 2, ARTICLE II, BOARDS AND COMMISSIONS, BY ADDING
DIVISION 5, SECTIONS 2-256 THROUGH 2-260, AND BY RESERVING
SECTIONS 2-261 THROUGH 2-300; PROVIDING FOR THE
EST ABLISHMENT OF THE ANIMAL CONTROL ADVISORY BOARD;
PROVIDING FOR COMPOSITION AND QUALIFICATIONS; PROVIDING
FOR SCHEDULED MEETINGS; PROVIDING FOR RESPONSIBILITIES OF
THE BOARD; PROVIDING FOR REMOVAL, RESIGNATION, VACANCIES,
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS;
SECTION 1. That the Code of Ordinances be, and the same is, hereby amended by amending
Chapter 2, Article II, Boards and Commissions, by adding Division 5, Sections 2-256 through 2-260,
to provide for the establishment of the Animal Control Advisory Board, and by reserving Sections 2-
261 through 2-300, which shall read as follows:
"DIVISION 5. ANIMAL CONTROL ADVISORY BOARD
Sec. 2-256. Advisory board created.
There is hereby created the animal control advisory board (the "board").
Sec. 2-257. Composition; qualifications.
The board shall consist of five (5) members appointed by the city council. As
required in Chapter 823 of the TEXAS HEALTH & SAFETY CODE, one member shall be a
licensed veterinarian, one member shall be municipal official, and one member shall be a
person whose duties include daily operation of the animal shelter. The remaining two (2)
members shall be the captain supervising the Animal Control Division and one citizen of
the City of The Colony. The members of the board shall serve without pay.
Sec. 2-258. Scheduled meetings.
The board shall meet at least three (3) times each year.
Sec. 2-259. Responsibilities.
The board's authority shall be limited to the following tasks and responsibilities:

(a) The Animal Control Advisory Board shall meet to discuss ideas that will
help ensure the animal shelter is in compliance with the State Department
of Heath rules pertaining to animal shelters.
(b) The board shall meet to make recommendations to the city manager or his
designee for the betterment of the community concerning operations,
policies, procedures, new programs, and the improvement of existing
programs. The board may also make appropriate recommendations for
amendments to existing animal control ordinances.
Sec. 2-260. Removal; resignation; vacancies; reappointment.
Any member of the board may discontinue their membership by resignation and/or
may be removed by the majority vote of the city council. If any position becomes vacant,
the city council shall appoint a qualified member to serve the balance of the unexpired
term.

SECTION 2. If any article, paragraph, subdivision, clause or provision of this ordinance or the
Code of Ordinances, as hereby amended, be adjudged invalid or held unconstitutional for any reason,
such judgment or holding shall not affect the validity of this ordinance as a whole or any part or
provision thereof, or of the Code of Ordinances, as amended hereby, other than the part so declared to
be invalid or unconstitutional. .
SECTION 3. This Ordinance shall become effective from and after its date of passage in
accordance with law.
