RESOLUTION NO. 05-1 'I
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF
THE ENGINEERING SERVICES CONTRACT CHANGE ORDER BY
AND BETWEEN THE CITY OF THE COLONY AND HALFF &
ASSOCIATES, INC. FOR ADDITIONAL ENGINEERING SERVICES
FOR MEMORIAL DRIVE FROM PAIGE TO WORLEY, WHICH IS
ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT
"A"; AUTHORIZING THE CITY MANAGER TO EXECUTE THE
CONTRACT CHANGE ORDER; AND PROVIDING AN EFFECTIVE
DATE
WHEREAS, the City and Consultant have entered into an agreement such that the
Consultant is to provide the following services: ADDITIONAL ENGINEERING SERVICES
FOR MEMORIAL DRIVE FROM PAIGE TO WORLEY; and
WHEREAS, the City has determined that it is in the best interest of the City to enter into
the Contract Change Order with HALFF & ASSOCIATES, INC., which is attached hereto and
incorporated herein by reference as Exhibit "A," under the terms and conditions provided
therein.
WHEREAS, with this Change Order the City of The Colony is agreeing to pay the sum
not to exceed $7,800.00 for such work.
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS THAT:
Section 1. The Change Order, which is attached and incorporated hereto as Exhibit "A",
having been reviewed by the City Council of the City of The Colony, Texas, and found to be
acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all
things approved in the amount of $7,800.00 as the base amount, plus a $-0- contingency amount for
a total not to exceed $7,800.00, and the City Manager is hereby authorized to execute the
Agreement on behalf of the City of The Colony, Texas.
Section 2. That this Resolution shall take effect immediately from and after its adoption
and it is so resolved.
PASSED, APPROVED and EFFECTIVE this 15 day of AUGUST,
2005.

CHANGE ORDER AND AMENDMENT OF CONSULTANT'S CONTRACT
THIS agreement is by and between the City of The Colony, Texas, a Texas home
rule municipality, and Halff Associates, Inc., hereinafter known as Consultant, a civil
engineering firm, with principal offices located in Fort Worth, Texas.
WHEREAS, the City and Consultant have entered into an agreement such that the
Consultant is to provide the following services: Site Infrastructure Associated with
Horizon Water Park.
WHEREAS, the above referenced agreement provides that if there is a change in
scope or focus of the activities in the contract, or if it is necessary for the Consultant to do
additional work such that there is a significant additional cost or expense to the City, it is
necessary for the City to approve such work and/or for the parties to change the contract;
and
WHEREAS, the parties recognize that it is necessary for Consultant to do
additional work under the contract, such work which is set out in the attached Exhibit
"A," which is attached hereto and incorporated herein as if set out in full herein; and
NOW, THEREFORE, for and in consideration of the mutual acts and covenants
set out herein, the parties agree as follows:
1. Consultant, in addition to the work to be performed in the Contract dated
November 17,2003, shall perform the task(s) described in the attached
Exhibit "A," basically described as Additional Services
2. The amount to be paid to Consultant under such contract shall be increased by
the sum of$7,800.00, to reflect the work described in Exhibit "A."
3. This shall constitute an Authorization for a Change in Work as set out in the
agreement between the parties, and an amendment to such contract. All of the
terms and conditions of the original contract shall remain in full force and
effect, as amended hereto, unless set out otherwise herein.

ADDITIONAL SERVICES
Site Infrastructure Associated with Horizon Water Park
The additional work is as follows:
· The City of the Colony was unable to obtain right-of-way from Sunflower
Venture, Ltd. for Memorial Drive. Since right-of-way will not be dedicated from
the property owner above, the current Memorial Drive construction plans, dated
December 14,2004, need to be revised. Revisions to the following plan items are
necessary: Memorial Drive Pavement, Waterline "B", and Storm Drain Line "F".
· The Five Star East Walk plan shall be revised from a 10-foot width to an 8-foot
width.
· The Five Star East Irrigation plan shall be revised according to changes made to
the sidewalk and pavement.
Fee for additional work:
$7,800.00
Total Additional Work:
$7,800.00
All work will be billed to Phase II. The total fee for Phase II will increase from $144,000
to $151,800. The total fee for the entire contract will increase from $252,000 to
$259,800.
