A RESOLUTION OF THE CITY OF THE COLONY, TEXAS, AUTHORIZING
THE CITY MANAGER TO SIGN RESIGNATION ELECTION PROGRAM
LETTERS FOR GEORGE D. WINTLE, JOSEPH M. HAMMOND, MICHAEL D.
CARROLL, AND GENE ABRAMS; ATTACHING THE SIGNED LETTERS AS
EXHIBIT A; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City of the Colony City Council desires to enter into agreements with long
tenured City employees whereby said City employees elect to resign their current positions; and
WHEREAS, said City employees are eligible to retire from the City of The Colony through the
Texas Municipal Retirement System and desire to enter into a resignation agreement with the City of the
Colony; and
WHEREAS, the City of the Colony agrees to purchase accumulated sick leave of said employees
not to exceed 750 hours for each in exchange for the Resignation Election Program agreement and based
on the resignation letters attached hereto and made a part hereof; and
WHEREAS, by electing to participate in the Resignation Election Program, said City employees
agree to resign their positions with the City effective September 30,2005.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS:
Section 1. That the City Council of the City of The Colony, Texas, hereby adopts and enters
into Resignation Election Program agreements with GEORGE D. WINTLE, JOSEPH M. HAMMOND,
MICHAEL D. CARROLL, AND GENE ABRAMS effective September 30, 2005.
Section 2. That the Resignation Election Program is a one-time offer of payment for
accumulated sick leave hours based upon their respective accumulated sick leave hours in an amount not
to exceed 750 hours.
Section 3. That the City Council of the City of The Colony, Texas authorizes the city manager
to execute said agreements, and a true and correct copy of each Resignation Election Program letter is
attached hereto and incorporated herein.
Section 4. That this program will expire on September 7, 2005 and shall not be construed to
be a permanent program or otherwise amend or repeal any applicable personnel rule, regulation or benefit
except as provided herein.
Section 5.
That this resolution shall take effect immediately from and after its passage.
RESIGNATION ELECTION PROGRAM
To: Dale Cheatham, City Manager
The Wldersigned is eligible to elect retirement through the Texas MWlicipal Retirement System and the
adopted policy of the City of The Colony. It is my Wlderstanding that the City Council is considering a one-
time payment for accumulated sick leave up to a maximum of 750 hours. That the undersigned hourly rate
will be calculated based on the employee's most recent payroll status that existed before the signing of this
document.
By signing this letter and upon authorization of the City Council to purchase up to 750 hours of my
accumulated sick leave, I agree to resign my position; and, in consideration thereof, the undersigned hereby
release, waive and discharge the City of The Colony and its affiliate organizations, members of the City
Council. current and former officers, directors, trustees, employees, agents, successors, and assigns of such
persons or entities from any and all claims, liabilities, demands and causes of action, and demands of
whatever kind or character known or Wlknown, fixed or contingent, arising out of my employment
relationship or resignation of my employment with City, including but not limited to: claims arising Wlder
federal, state, or local constitutions, charters or laws; any claims of age, race, sex, ethnicity, color or
religious or other disaimination under state and/or federal constitutions and/or laws.
By signing this letter I am giving the City proper notice of my election and understand that I will be eligible
for rehire with the City of The Colony. If, and only if, the City is willing to purchase all of my
accumulated sick leave up to a maximum of 750 hours then I elect to resign with an effective date of
September 30, 2005. The tendering of my resignation under the conditions stated in this letter is completely
voluntary and is irrevocable upon acceptance by the City under the terms and conditions recited herein.
