MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING
HELD ON JULY 26, 2005
The Regular Session of the Planning and Zoning Commission of the City of The Colony,
Texas was called to order at 6:30 p.m. on the 26th day of July, 2005 at City Hall with the
following members present:

With six (6) P & Z members present, a quorum was established and the following items
were addressed:
2.0 DISPOSITION OF MINUTES
2.1 Consider approval of the minutes for the July 12,2005 regular session.
Chairman Wade noted a change in the minutes.
Motion to approve the minutes of the meeting held on July 12, 2005 with one
change, Commissioner Milsak; second, Commissioner Barrett. Motion carried 6-0.
3.0 ITEMS FOR CONSIDERATION
3.1 Consider making a recommendation to the City Council regarding a Site
Plan for Trinity Presbyterian Church, being a 4.502-acre tract located on Lot
1, Block 1, Trinity Presbyterian Church Addition. The subject tract is
located on the south side of Nash Street east of Main Street and west of
Mayes Place (SP05-010).
Ms. Odell presented the staff report regarding a recommendation on the Site Plan for
Trinity Presbyterian Church, located on the south side of Nash Street east of Main Street
and west of Mayes Place.

Mr. Steve Thomas with Trinity Presbyterian Church, 6501 Terrace Drive, The Colony,
TX 75056, was present to answer questions.
Staff recommends approval with two stipulations:
1. Engineering and Building Plans must be approved prior to issuance of a
building permit.
2. External lighting shall not extend beyond the property lines nor produce a
glare to adjacent uses.
Commissioner Hubbard asked about the .roof on the building.
Mr. Thomas explained the roof is to be metal and brown in color.
Commissioner Milsak asked about the timing of the landscape installation of phase two
landscaping.
Mr. Thomas explained the installation of the landscaping in phase two is be consistent
with the development of the site, which could be in the next three to five years, but
probably longer dependent on church growth.

Commissioner Connelly asked about the inclusion of the Gateway Overlay District
Landscape Worksheet on the Landscape Plan.
Ms. Odell explained the property is not within the Gateway Overlay District. The
applicant included the information with the submittal and staff did not want to alter the
applicant's submission. She went on to explain the landscaping in the proposed phase
one does not meet the landscape ordinance. However, when the phase two landscaping is
installed the landscaping will comply with the ordinance. The property has three street
yards and that is the reason the landscape requirement is so extensive on this property.
Commissioner Connelly asked if the phase one landscaping on the west side of the
building was eliminated would the landscaping comply with the ordinance.
Ms. Odell answered no.
Commissioner Wade asked for an explanation of the parking standard.

Ms. Odell explained the applicant is using chairs for seating in the sanctuary. The
applicant did not want to provide parking for the capacity of the sanctuary based on
seating in chairs for fiscal reasons. The applicant applied for a variance to the Board of
Adjustment to use the number of parking spaces as if seating the sanctuary were to be in
pews. The Board of Adjustment approved the applicant's request and the applicant has
provided 93 parking spaces as approved in the variance request.

Commissioner Hubbard noted that this particular piece of property has a burden based on
the size of the property and the three street yards. Because of the burden and the
Commission never approving a phased landscape plan before, he would prefer to set a
date for the installation of the phase two landscaping and tie the landscape installation to
a Certificate of Occupancy.
Director Bateman explained the landscaping in phase one could be tied to the Certificate
of Occupancy for the expansion and phase two landscape installation could be tied to
Certificate of Occupancies on future expansions.
Commissioner Hubbard noted again the importance for a date to be set on the phase two
landscape installation. He suggested the church use a tree of a smaller caliper that would
be less expensive.
Director Bateman informed the Commission they could include a stipulation conditioning
the phase one landscape installation be to plan and the phase two installation should be
within a specific number of years.
Commissioner Connelly asked if the phasing of landscape plans was typical and if the
Commission had approved such plans before?
Attorney Dodd answered no.

Commissioner Connelly asked Mr. Thomas if the church would be comfortable with a
one year time line on the phase two installation.
Mr. Thomas answered no, it would be more preferable if the time line were three to five
years.
Mr. Thomas then asked about the Lewisville Independent School District Natatorium
property that was divided into two parts, one which will be developed at a later date. He
wanted to know what the difference was between the Natatorium project and the church
project.
Ms. Odell explained the Natatorium project is part of two separately platted lots. The
development of the school site at a later date is on a different lot than the Natatorium
property. Landscaping on the school site will come in at the date of development on that
site.
Mr. Thomas stated that seemed like a distinction without a difference.
Attorney Dodd informed Mr. Thomas and the Commission that the School District runs
the risk of there being a change in the development standards and more stringent
standards could be applied at the time of development of the school site.

Mr. Thomas cited that all of the area is phase two is to be a parking lot expansion.

Chairman Wade asked if the development standards were changed and become more
stringent prior to the installation of the phase two landscaping, would the current or
former standard apply to the phase two installation.
Attorney Dodd answered that landscaping on the site would have match the plan
approved at the current meeting.
Commissioner Harrison asked how much new parking was included on the plan.
Mr. Thomas stated he did know.
Commissioner Wade stated there are 93 parking spaces included on the plan.
Commissioner Connelly asked ifthe trees on the west side of phase one could be moved
along Main Street where the phase two landscaping is proposed.
Director Bateman stated the west portion of phase two trees could be damaged by the
expansion of Main Street in the future.
Commissioner Connelly asked how much additional right of way was needed for the
expansion of Main Street on this site.

Director Scruggs stated no additional right of way was needed in this area.
Commissioner Connelly stated the landscaping should be complete at the time of the
expanSIOn.
Commissioner Hubbard stated the property is unique and that should be a consideration.
If it were a commercial property generating revenues, the situation should be different.
A motion for approval of a Site Plan for Trinity Presbyterian Church, being a 4.502-

of Mayes Place (SP05-010). Motion with three stipulations:

from the date of City Council approval of the plan.
Commissioner Hubbard; second Commissioner Barret. Motion carried 5-1.
Commissioner Connelly opposed. .

4.0 DIRECTOR'S REPORT

Director Bateman welcomed Commissioner Debbie Morrison.
Director Bateman informed the Commission some new training materials would be
distributed soon, City Council outcome reports will be included in the packet as soon as
some technical difficulties are resolved, and we will start having work sessions prior to
the meetings once the department is fully staffed.
Director Bateman stated the Commission's new recording secretary, Angela Puente, will
be at the August 9 meeting.
The meeting ajomed at 7:07 pm.
