CITY OF THE COLONY
ORDINANCE NO. 05 _ /{,0'r
AN ORDINANCE ADOPTING THE NATIONAL INCIDENT
MANAGEMENT SYSTEM ("NIMS"); AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the President, in Homeland Security Presidential Directive (HSPD-5),
Management of Domestic Incidents, directed the Secretary of Homeland Security to develop and
administer a National Incident Management System (NIMS) to provide a consistent nationwide
approach for Federal, State, local, and tribal governments to work together more effectively and
efficiently to prevent, prepare for, respond to and recover from domestic incidents, regardless of
cause, size, or complexity; and
WHEREAS, on March 1, 2004, the Secretary of Homeland Security issued the NIMS to
provide a comprehensive national approach to incident management, applicable to all
jurisdictional levels across functional disciplines; and
WHEREAS, NIMS establishes standard incident management processes, protocols and
procedures so that all responders can work together more effectively; and
WHEREAS, the Federal NIMS Integration Center was established to oversee all aspects
of NIMS, including the development of NIMS-related standards and guidelines and to provide
support to and guidance for incident management and responder organizations as they implement
the system; and will validate compliance with NIMS and National Response Plan
responsibilities, standards and requirements; and
WHEREAS, the overwhelming majority of emergency incidents are handled on a daily
basis by a single jurisdiction at the local level with the involvement of multiple jurisdictions,
functional agencies and emergency responder disciplines, and
WHEREAS, these instances require effective and efficient coordination across the
spectrum of organizations and activities; and
WHEREAS, NIMS is based on an appropriate balance of flexibility and standardization
in order to provide a framework for interoperability and compatibility during incident operations;
and
WHEREAS, NIMS provides a consistent, flexible and adjustable national framework
within which government and private entities at all levels can work together to manage domestic
incidents, regardless of their cause, size, location, or complexity; and
WHEREAS, this flexibility applies across all phases of incident management:
prevention, preparedness, response, recovery and mitigation; and
WHEREAS, the Incident Command System components of NIMS are already an
integral part of various incident management activities throughout the City, including current
emergency management training programs; and
WHEREAS, the National Commission on Terrorist Attacks (9-11 Commission)
recommended adoption of a standardized Incident Command System;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS;
Section 1
That the City Council of the City The Colony, Texas, hereby recognizes NIMS and adopts NIMS
principles and policies as the City standard for incident management.
Section 2
That the City Manager is hereby directed to establish a NIMS baseline by determining which
NIMS requirements have already been met, and to establish a timeframe and develop a strategy
for full City of The Colony NIMS Implementation.
Section 3
That the City Manager is hereby directed to insure that incident managers and response
organizations in the City train and conduct exercises in the use of the National Incident
Command System and use it in their response operations.
Section 4
That this Ordinance shall take effect immediately from and after its adoption.
