CITY OF THE COLONY
ORDINANCE NO. Cflf-lS"qCj
AN ORDINANCE VACATING AND ABANDONING THAT CERTAIN PORTION OF
HACKBERRY ROAD LOCATED WITIllN THE CORPORATE LIMITS OF THE CITY OF
THE COLONY, DENTON COUNTY, TEXAS; DETERMINING THAT THERE IS NO
CURRENT NOR PROJECTED FUTURE NEED FOR SAID EASEMENT; REQUIRING A
HOLD HARMLESS AGREEMENT; PROVIDING A SEVERABILITY CLAUSE AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, the City of The Colony, Texas is
a municipal corporation organized under the laws of
the State of Texas; and
WHEREAS, it is intent of the City of The
Colony ("City") to protect the health, safety and
welfare and well being of its citizens; and
WHEREAS, a new public road, to wit:
Stonebrook Parkway has been constructed by
Pulte Homes of Texas, L.P. which does qualify as a
replacement road and which is generally parallel to
Hackberry Road, as depicted in Exhibit "A" hereto,
and is located within the corporate limits of the City of
The Colony, Denton County, Texas;
WHEREAS, the thoroughfares planned and
depicted on the Concept Plan (Exhibit "B") provide
adequate and acceptable access to the area shown and
that is consistent with the City Thoroughfare Plan.
WHEREAS, Pulte Homes of Texas, L.P., is
the sole and fee simple current owner of property
adjacent to and underlying that certain portion of
Hackberry Road within the corporate limits of the City
of The Colony, Denton County, Texas and has
requested that the City abandon and vacate all right,
title and interest to the easement described herein; and
WHEREAS, the roadway easement described
in Exhibit "C", and depicted in Exhibit "D" attached
hereto is located within the corporate limits of the City
of The Colony, Denton County, Texas, and are not
needed for current or future use and the same should be
abandoned and vacated; and

NOW THEREFORE: BE IT ORDAINED BY THE
CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS:
SECTION 1. AUTHORlTY
The Mayor or Mayor's designee, is hereby
authorized and directed to implement the applicable
provisions of this Ordinance.
SECTION 2. ABANDONMENT
The roadway easement, described in Exhibit
"C" and depicted in Exlnbit "D", attached hereto and
made a part hereof, that within the corporate limits of
the City of The Colony, Denton County, Texas is
hereby vacated and abandoned.
SECTION 3. RECORDING
The City Secretary of the City of The Colony
is instructed to file a copy of this ordinance reflecting
the abandonment authorized by this ordinance with the
Real Property Records of the City of The Colony and
the Real Property Records of Denton County, Texas.
SECTION 4. RESTRlCTIONS
A. The abandonment provided for herein
is made subject to all present zoning and deed
restrictions and is subject to all pre-existing rights of
others, if any, whether apparent or non-apparent, aerial,
surface, WldergroWld or otherwise.
B. The abandonment provided for herein
is subject to and conditioned upon Pulte Homes of
Texas, L.P., through its general partner, PN I, Inc., by its
Dallas Division President Richard Dix, indemnifying
and holding harmless the City as a result of the vacation,
closing and abandonment of the identified easements.
SECTION 5. BINDING
The terms and conditions contained in this
ordinance shall be binding upon the Grantee, its
successors and assigns.
SECTION 6. TITLE
The abandonment provided for herein shall
extend only to that public right, title, easement and
interest and shall be construed only to the extent of that
interest which the governing body of the City of The
Colony may legally and lawfully abandon and vacate.
SECTION 7. RECITALS
The City Council hereby fmds and declares all
precatory language herein to be true and correct and
approves and adopts the same herein as part of this
Ordinance.
SECTION 8. SEVERABILITY
If for any reason any section, paragraph,
subdivision, clause, phrase or provision of this
Ordinance shall be held invalid, it shall not affect any
valid provisions of this or any other Ordinance of the
City of The Colony to which these rules and regulations
relate.
SECTION9. EFFECTIVE DATE
This Ordinance shall be effective on or after its adoption.

SURVEY, ABSTRACT NUMBER 179, DENTON COUNTY, TEXAS, AND BEING
OUT OF A 4.351 ACRE TRACT OF LAND CONVEYED TO PULTE HOMES OF
TEXAS, L.P., ACCORDING TO THE DEED FILED OF RECORD IN DENTON
