MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING
HELD ON JUNE 14, 2005
The Regular Session of the Planning and Zoning Commission ofthe City of The Colony,
Texas was called to order at 6:30 p.m. on the 14th day of June, 2005 at City Hall with
the following members present:

With four (4) P & Z members present, a quorum was established and the following items
were addressed:
2.0 DISPOSITION OF MINUTES
2.1 Approval and/or correction of Planning and Zoning Commission minutes for
the meeting held on May 10, 2005
Motion to approve the minutes of the meeting held on May 10, 2005, Commissioner
Hubbard; second, Commissioner Connelly. Motion carried 4-0.
3.0 OTHER BUSINESS
3.1 Nomination and election of Chairperson and Vice Chairperson.
Commissioner Milsak nominated Vice Chairman Brian Wade for Chairman and
Commissioner Jeff Connelly for Vice Chairman. Commissioner Connelly seconded the
nominations. Commissioners Wade and Connelly were elected by acclamation.

4.0 CITIZEN INPUT
None
5.0 ITEMS FOR CONSIDERATION
5.1 Consider approval of a Preliminary Plat for Lots 1 and 2, Block A, Lewisville
Independent School District Natatorium Addition, being a 24.813-acre tract
situated in the William Bridges Survey, Abstract No. 112, the B.B.B. and C.R.R.
Survey, Abstract Nos. 172 and 174. The subject tract is located at the northwest
corner of the intersection of South Colony Boulevard and Memorial Drive, in
the City of The Colony, Denton County, Texas (2005-PP002).
Ms. Odell presented the staff report regarding a Preliminary Plat for Lots 1 and 2, Block
A, Lewisville Independent School District Natatorium Addition located on the north side
of Memorial Drive, west of South Colony Boulevard and east of Trailview Drive.
Mr. Mark Ross of the Lewisville Independent School District, P.O. Box 217, Lewisville,
Texas 75067 and Mr. R. Yon Beougher of G & A Consultants, Inc., 111 Hillside Drive,
Lewisville, Texas 75067 were present to answer questions.
Mr. Yon Beougher stated the tract has been owned by the school district since 1999. The
land use prior to the purchase was PD9 and before that he thinks Business Park or
Industrial Use.
Commissioner Connelly inquired as to why there were no curb cuts on Trailview Drive.
He also mentioned the drainage easement is in the wrong place. Mr. Yon Beougher
informed the Commission that the City wants curb cuts eliminated in residential areas
and that the placement of the drainage easement will be corrected.
Staff recommends approval with two (2) stipulations.
Motion to approve a Preliminary Plat for Lots 1 and 2, Block A, Lewisville

5.2 Consider approval of a Final Plat for Lot 1, Block A, Lewisville Independent

William Bridges Survey, Abstract No. 112, the B.B.B. and C.R.R. Survey,

intersection of Memorial Drive and Trailview Drive, in the City of The Colony,
Denton County, Texas (2005-FP003).
Ms. Odell presented the staffreport regarding a Final Plat for Lot 1, Block A, Lewisville
Independent School District Natatorium Addition located at the northwest comer of the
intersection of Memorial Drive and Trailview Drive.
Mr. Mark Ross of the Lewisville Independent School District, P.O. Box 217, Lewisville,
Texas 75067 and Mr. R. Yon Beougher of G & A Consultants, Inc., 111 Hillside Drive,
Lewisville, Texas 75067 were present to answer questions.
Staff recommends approval with 2 stipulations.
Motion to approve a Final Plat for Lot 1, Block A, Lewisville Independent School
District Natatorium Addition, being a 7.830-acre tract situated in the William Bridges
Survey, Abstract No. 112, the B.B.B. and C.R.R. Survey, Abstract Nos. 174. The
subject tract is located at the northwest corner of intersection of Memorial Drive and
Trailview Drive, in the City of The Colony, Denton County, Texas (2005-FP003) subject
to two (2) staff stipulations, Commissioner Connelly; second Commissioner Hubbard.
Motion carried 4-0.
6.0 PUBLIC HEARING

6.1
Hold a public hearing and consider making a recommendation to the City
Council regarding an amendment to Planned Development 12. The subject
property located on Lot 5, Block B, Parks of Austin Ranch Addition and is
generally southwest of the intersection of West Arbor Hills Way and Saintsbury
Drive (2005-Z003).
Chairman Wade opened the public hearing at 6:45 p.m.
Ms. Odell presented the staff report for a recommendation to the City Council regarding
an amendment to Planned Development 12. The subject property is located southwest of
the intersection of West Arbor Hills Way and Saintsbury Drive.
Two (2) notices were mailed to the property owners within 200' of the subject tract. Zero
(0) notices were received in favor of the variance and zero (0) notices were received in
opposition.
Mr. Marc Sullivan of Billingsley Co., 4100 International Parkway, Carrollton, TX 75007
was present to answer questions.
Chairman Wade asked if anyone wanted to speak in favor of item 6.1.

Chairman Wade then asked if anyone wanted to speak in opposition of item 6.1.
No one came forward.
The Commissioners inquired as to the intended use of the house. Mr. Sullivan stated it is
an amenity for the residents if they have out of town guests, or if repairs are being done
on their apartments. This facility is for short term use only.
Chairman Wade asked what the foundation will be setting on and the proposed exterior
color. Mr. Sullivan stated it is a concrete slab and the color has not been determined but
it will be a color consistent with a "historical 1903 Texas look."
Chairman Wade closed the public hearing at 6:58 p.m.
A motion to recommend approval to the City Council regarding an amendment to
Planned Development 12. The subject property located on Lot 5, Block B, Parks of
Austin Ranch Addition and is generally southwest of the intersection of West Arbor

Commissioner Milsak. Motion carried 4-0.

subject tract is generally located at the northwest corner of the intersection
of Memorial Drive and Trailview Drive (2005-Z002).
Chairman Wade opened the public hearing at 7:00 p.m.
Ms. Odell presented the staff report regarding the development plan for Planned
Development 20. The subject tract is located on the north side of Memorial Drive west of
South Colony Boulevard and east of Trailview Drive.
Seventy-seven (77) notices were mailed to the property owners within 200' of the subject
tract. Twelve (12) were received in opposition.
Mr. Mark Ross of the Lewisville Independent School District, P.O. Box 217, Lewisville,
Texas 75067 and Mr. R. Von Beougher of G & A Consultants, Inc., 111 Hillside Drive,
Lewisville, Texas 75067 were present to answer questions.
Mr. Von Beougher stated L.I.S.D. does not want to erect a masonry wall for safety
reasons. A wall will give the alley a tunnel effect. In lieu of a masonry wall, a wrought
iron fence has been proposed by LJ.S.D. with more dense, high canopied trees and
additional bushes and landscaping.
Mr. Ross stated he has attended many Police Department seminars. The Police
recommend not placing a solid masonry wall between a school and a residential area. It
is a safety issue.

Chairman Wade asked if anyone wanted to speak in favor of item 6.2.
No one came forward.
Chairman Wade then asked if anyone wanted to speak in opposition of item 6.2.
Mr. Jason Day of 6300 Day Spring, The Colony, Texas 75056 made the following
comments:
1. A masonry wall would decrease noise.
2. It would block the view of the natatorium and trucks delivering pool chemicals.
3. If the remainder of this site becomes the future home of a Middle School it would.
also block the view of a football field, track, bleachers, etc.
Mr. Paul Pearce of 6332 Rolling Hill Drive, The Colony, Texas 75056 made the
following comments:
1. He does not want to see Commercial Development.
2. He does not want the existing trees cut down.
3. The wall would be more attractive made from masonry rather than wrought iron.

Commissioner Milsak stated there is already a masonry wall separating a school from a
residential area in the City.
Commissioner Hubbard remarked there is a difference between the view from behind a
natatorium and the view from the behind of a school building.
Commissioner Connelly mentioned L.I.S.D. has the right to go with a masonry wall
regardless of public input tonight. However, could L.I.S.D. possibly consider building
the wrought iron fence to match the existing fence that is throughout the neighborhood.
Chairman Wade agrees ifthe fence could resemble the wrought iron fencing already in
the neighborhood that would be appreciated.
Another concern ofthe Commission was bus traffic. Mr. Ross stated buses will only be
there during swim meets. The building will block a majority of the view from the
residential area.
Chairman Wade reminded Mr. Ross of the need for irrigation to keep the landscape alive
and thriving.
Chairman Wade closed the public hearing at 7:26 p.m.

Z002) Commissioner Hubbard; second Commissioner Wade. Motion carried 4-0.
6.3 Hold a public hearing and consider making a recommendation to the City
Council amending Appendix A of the Code of Ordinances (Zoning
Ordinance) creating an Eastvale Overlay Zoning District (2005-M005).
Chairman Wade opened the public hearing at 7:27 p.m.
Ms. Odell gave the staff report regarding a recommendation to the City Council
to amend Appendix A of the Code of Ordinances (Zoning Ordinance) to create an
Eastvale Overlay Zoning District.
Chairman Wade asked if any one wanted to speak in favor of item 6.3.
No one came forward.
Chairman Wade then asked if anyone wanted to speak in opposition of item 6.3.
No one came forward.
Commissioner Hubbard suggested the name of the District be changed to North Main
Street Overly District.
Ms. Odell stated the name can be changed when it goes to City Council.
Chairman Wade suggested including more evergreens in the landscaping.
Commissioner Connelly stated this amendment is not lowering the standards in the City
but allowing the City to be more flexible to promote business in that area.
A motion to make a recommendation to the City Council amending Appendix A of
the Code of Ordinances (Zoning Ordinance) creating an Eastvale Overlay Zoning
District (2005-M005) with the stipulations to change the name to North Main Street
Overly District and to include more evergreens in the landscaping, Commissioner
Connelly; second Commissioner Milsak. Motion carried 4-0.
7.0 DIRECTOR'S REPORT
Director Donna Bateman expressed how happy she is to be a part of the Planning and
Zoning Commission for the City of The Colony. She is here to help in anyway. If the
Commissioners have any recommendations or suggestions regarding the Commission
please let her know.
The Commission requested those Commissioners who are interested in becoming
members of the American Planning Association should have an opportunity to do so.

It was also suggested Planning and Zoning be kept informed on how City Council votes
on their recommendations.
With no further business, the meeting adjourned at 7:50 p.m.
