Q;'5.,./'f'15 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER 2, ARTICLE II, BOARDS AND COMMISSIONS, BY AMENDING DIVISION 3, TECHNOLOGIES BOARD, TO RESERVE SECTIONS 2-234 THROUGH 2-249 AND BY ADDING DIVISION 4, SECTIONS 2-250 THROUGH 2-255, AND BY RESERVING SECTIONS 2.256 THROUGH 2.300, PROVIDING FOR THE ESTABLISHMENT OF THE CODE ENFORCEMENT ADVISORY BOARD; PROVIDING FOR COMPOSITION AND QUALIFICATIONS; PROVIDING FOR TERMS; PROVIDING FOR REMOVAL, RESIGNATION, VACANCIES, REAPPOINTMENT; PROVIDING FOR ABSENCE FROM MEETINGS; PROVIDING FOR DUTIES, OPERATIONAL RULES, AND PROCEDURES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS; SECTION 1. That the Code of Ordinances be, and the same is, hereby amended by amending Chapter 2, Article II, Boards and Commissions, by amending Division 3, Technologies Board, to reserve Sections 2-234 through 2-249 and by adding Division 4, Sections 2-250 and 2-255, to provide for the establishment of the Code Enforcement Advisory Board, and by reserving Sections 2-256 through 2.300, which shall read as follows: "Sec. 2-234 - 2.249. Reserved. DIVISION 4. CODE ENFORCEMENT ADVISORY BOARD Sec. 2-250. Advisory board created. There is hereby created the code enforcement advisory board (the "board"). The purpose of the board shall be serve as an advisory body to the city council with respect to matters concerning regulations for adoption by the City Council and recommendations for code enforcement. Sec. 2-251. Composition; qualifications. The board shall consist of seven (7) members appointed by the city council, whom shall all be residents of the City. No member of the board shall hold an elective office within the city. In addition, the City Council may appoint up to two (2) council members to act as liaisons. The members of the board Page 1 73912 shall consider the issues concerning code enforcement and suggest proposed regulations or enforcement activities and shall be persons who have a diverse interest in and knowledge about the city, business and various familiarities with the Code of Ordinances. The members of the board shall serve without pay. Sec. 2-252. Term. The board shall select from its members a chairperson and a vice chairperson. The chairperson and vice chairperson shall serve in that capacity for a period not to exceed two (2) years. The chairperson shall not serve consecutive terms. The city council shall make appointments of members whose terms begin in January of each year. The appointments shall be for a two (2) year term. The original board shall be selected after the effective date with three (3) members selected for three (3) year terms and four (4) members for two (2) year terms to stagger such terms. The city council shall determine which three seats will be for three years by drawing lots. Thereafter, each term shall be two (2) years. Sec. 2-253. Removal; resignation; vacancies; reappointment. Any member of the board may discontinue their membership by resignation and/or may be removed by the majority vote of the city council. If any position becomes vacant, the city council shall appoint a member to serve the balance of the unexpired term. Sec. 2-254. Absence from meetings. Any member who is absent from the three consecutive meetings of the board without a satisfactory excuse shall be removed from office by the city council. Sec. 2-255. Duties, operational rules and procedures. The board shall adopt operational rules and procedures for the conduct of its duties, which shall be ratified by the city council. The rules and procedures shall provide for annual election of officers, the conduct of regular and special meetings, and the appointment of subcommittees. These operational rules and procedures are to be consistent with this division and the policies and procedures for advisory boards and commissions, passed by the city council on August 1990, as amended. The affirmative vote of two-thirds of the entire membership of the board shall be required to amend such operational rules and procedures, and any such amendment must be ratified by the city council. The board shall hold monthly meetings at regularly stated times. Such meetings are to be open to the public and subject to the provisions of the Texas Open Meetings Act. The board shall serve in an advisory capacity to the mayor and city council. The board does not have the power to obligate the city for any funds or expenditures or incur any debt on behalf of the city. Page 2 73912 Sec. 2-256 - 2.300. Reserved" SECTION 2. If any article, paragraph, subdivision, clause or provision of this ordinance or the Code of Ordinances, as hereby amended, be adjudged invalid or held unconstitutional for any reason, such judgment or holding shall not affect the validity of this ordinance as a whole or any part or provision thereof, or of the Code of Ordinances, as amended hereby, other than the part so declared to be invalid or unconstitutional. . SECTION 3. This Ordinance shall become effective from and after its date of passage in accordance with law.
