HomeMy WebLinkAbout04/12/05 P&Z I I I Planning and Zoning Commission April 12, 2005 MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING HELD ON APRIL 12,2005 The Regular Session of the Planning and Zoning Commission of the City of The Colony, Texas was called to order at 6:30 p.m. on the 12th day of April, 2005 at City Hall with the following members present: DeVille Hubbard Marlene Milsak Mike Barrett Kirk Mikulec, Chairman Brian Wade Jeff Connelly Absent: Bill Harrison Staff: Harry Persaud, Director of Development Services Mike Lang, City Attorney James Hanvey, Engineer Lauren Odell, Planner Sandy Vondersaar, Administrative Assistant With six (6) P & Z members present, a quorum was established and the following items were addressed: 2.0 DISPOSITION OF MINUTES 2.1 Approval and/or correction of Planning and Zoning Commission Minutes for the meeting held on March 8,2005 Motion to approve the minutes of the meeting held on March 8, 2005, Commissioner Connelly; second, Commissioner Wade. Motion carried 6-0. 3.0 CITIZEN INPUT None 4.0 ITEM FOR CONSIDERATION 4.1 Consider approval of a Final Plat for Lot 1, Block 1, Wynnwood Pump Station Addition, being a 2.536-acre tract situated in the B.B.B. and C.R.R Co. Survey, Abstract No. 182, located south of Boyd Road and west of FM 423, in the City of The Colony, Denton County, Texas (2005-FP001). - 1 - Planning and Zoning Commission April 12, 2005 Ms. Odell presented the staff report regarding a Final Plat for Lot I, Block 1, Wynnwood Pump Station Addition located west ofFM 423 and south of Boyd Road. Staff recommends approval with one (1) stipulation. Motion to approve a Final Plat for Lot 1, Block 1, Wynnwood Pump Station Addition, being a 2.536-acre tract situated in the B.B.B. and C.R.R Co. Survey, Abstract No. 182, located south of Boyd Road and west ofFM 423, in the City of The Colony, Denton County, Texas (2005-FP001) subject to one (1) staff stipulation, Commissioner Connelly; second Commissioner Hubbard. Motion carried 6-0. 4.2 Consider approval of a Final Plat for Lot 1, Block A, Lewisville Independent School District Bus Maintenance Facility Addition, being a 5.436-acre tract situated in the T. Wilson Survey, Abstract No. 1352, located on the south side of Cougar Alley, west of NowUn Drive in the City of The Colony, Denton County, Texas (2005-FP002). Ms. Odell presented the staff report regarding a Final Plat for Lot 1 , Block A, Lewisville Independent School District Bus Maintenance Facility Addition located on the south side of Cougar Alley, west of Nowlin Drive. Mr. Mark Ross ofL.I.S.D., P.O. Box 217, Lewisville, Texas 75067 and Mr. R. Yon Beougher of G & A Consultants, Inc., 111 Hillside Drive, Lewisville, Texas 75067 were present to answer questions. Mr. Persaud reminded the Commission that a school district is not required to follow the City Zoning Ordinance. City Attorney Lang explained that the Lewisville Independent School District Bus Maintenance Facility trumps any zoning laws or ordinances of a municipality due to the transportation of students. Commissioner Connelly made a motion to adjourn to Executive Session. Commissioner Barrett seconded the motion. Motion carried 5-1. Commissioners Hubbard, Milsak, Barrett, Connelly and Wade for; Chairman Mikulec against. The Commissioners returned to the Council Chambers at 7:02 p.m. and the meeting resumed. Commissioner Connelly asked Mr. Ross if other school districts contracted by Durham Transportation will be having maintenance performed on their buses at this location. Mr. Ross assured the Commission only Lewisville Independent School District buses will be parked or serviced at this facility. - 2 - Planning and Zoning Commission April 12, 2005 I Staff recommends approval with one (1) stipulation. Motion carried 6-0. 4.3 Consider approval of a Site Plan for a School Bus Parking and Maintenance Facility for the Lewisville Independent School District, being a 5.436-acre tract situated in the T. Wilson Survey, Abstract No. 1352, located on the south side of Cougar Alley, west of Nowlin Drive in the City of The Colony, Denton County, Texas (2005-SP003). Ms. Odell presented the staff report regarding a Site Plan for a School Bus Parking and Maintenance Facility for the Lewisville Independent School District located on the south side of Cougar Alley, west of Nowlin Drive. Mr. Mark Ross ofL.I.S.D., P.O. Box 217, Lewisville, Texas 75067 and Mr. R. Yon Beougher ofG & A Consultants, Inc., III Hillside Drive, Lewisville, Texas 75067 were present to answer questions. I Staff recommends approval with two (2) stipulations. The Commission expressed the following concerns: Placement of fire hydrant Usage of barbed wire with chain link fencing Landscape and screening buffers Lighting Hours of operation Commissioner Connelly inquired as to how the Commission can make a motion regarding the Maintenance Facility when only the Parking Facility is included in their packet. Mr. Persaud suggested the motion state; " to approve parking lot only." Mr. Ross was in complete agreement. After lengthy discussion the Commission requested the following stipulations: I 1. Lewisville Independent School District will erect a wrought iron fence along the frontage of the property adjacent to Cougar Alley. 2. Lewisville Independent School District will install a buffer of Red Tip Photina on - 3 - Planning and Zoning Commission April 12, 2005 the west property line, abutting Lot 2R, Block A, Ridgepointe Professional Office Park Addition. Photinas are to be planted six (6') feet on center and are to be four (4') feet high at the time of planting. 3. All issues regarding the installation of fire hydrants on the site are to be resolved prior to City Council consideration on May 2,2005. Motion to approve a Site Plan for School Bus Parking only, for the Lewisville Independent School District, being a 5.436-acre tract situated in the T. Wilson Survey, Abstract No. 1352, located on the south side of Cougar Alley, west of Nowlin Drive in the City of The Colony, Denton County, Texas (2005-SP003) subject to the three (3) stipulations listed above, Commission Wade; second Commissioner Connelly. Motion carried 5-1. Commissioners Hubbard, Milsak, Connelly, Wade and Mikulec for; Commissioner Barrett against. 5.0 PUBLIC HEARING 5.1 Hold a public hearing and consider approval of a Replat for Lot lR, Block 1, Main Street-121 Addition, being a 1.261-acre tract situated in the Thomas C. Wilson Survey, Abstract No. 1352, located at the northeast corner of Main Street and State Highway 121, in the City of The Colony, Denton County, Texas (2005-RPOOl). Chairman Mikulec opened the public hearing at 7:40 p.m. Mr. Rhett Niewinski of Lawrence A. Cates and Assoc., 14800 Quorum Drive, #200, Dallas, Texas 75254 was present to answer questions. Ms. Odell presented the staff report regarding a Replat for Lot lR, Block 1, Main Street- 121 Addition located at the northeast comer of the intersection of Main Street and State Highway 121. Chairman Mikulec asked if anyone wanted to speak in favor of item 5.1. No one came forward. Chairman Mikulec then asked if anyone wanted to speak in opposition of item 5.1. No one came forward. Chairman Mikulec closed the public hearing at 7 :42 p.m. Staff recommends approval with two (2) stipulations. A motion to approve Replat for Lot lR, Block 1, Main Street-121 Addition, being a 1.261-acre tract situated in the Thomas C. Motion carried 6-0. 6.0 ITEM FOR CONSIDERATION 6.1 Consider approval of a Site Plan for Wachovia Bank, being a 1.261-acre tract situated in the Thomas C. Wilson Survey, Abstract No. 1352, located at the northeast corner of Main Street and State Highway 121, in the City of The Colony, Denton County, Texas (2005-SP004). Mr. Rhett Niewinski of Lawrence A. Cates and Assoc., 14800 Quorum Drive, #200, Dallas, Texas 75254 was present to answer questions. Ms. Odell presented the staff report regarding a Site Plan for Wachovia Bank located at the northeast comer of the intersection of Main Street and State Highway 121. The second staff stipulation found on page 22 of the packet; "The radius on curve "C 1 0" shall be changed to a twenty (20') foot radius to accommodate a fire engine" will now read 'the radius on curve "ClO" shall be changed to a thirteen (13') foot radius to accommodate a fire engine." It was also agreed that if relocated landscaping does not survive the applicant will replace the landscaping. Staff recommends approval with two (2) staff stipulations. A motion for approval of a Site Plan for Wachovia Bank, being a 1.261-acre tract situated in the Thomas C. Wilson Survey, Abstract No. 1352, located at the northeast corner of Main Street and State Highway 121, in the City of The Colony, Denton County, Texas (2005-SP004) subject to two (2) staff stipulations, Commissioner Connelly; second Commissioner Milsak.
