A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, SUPPORTING THE EXISTING STATE LAW ON
QUALIFICATIONS-BASED SELECTION AND OPPOSING ANY
PROPOSED LEGISLATION CURRENTL Y PENDING BEFORE THE
TEXAS LEGISLATURE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Texas Law has for many years provided for a system of qualifications-based
selection ("QBS") when governmental entities select engineers and architects for public
facilities; and
WHEREAS, design costs are a very small part of overall construction and maintenance costs of
projects, but the quality of engineering decisions is a key driver of those costs; and
WHEREAS, QBS ensures a focus on long-term value in public construction and minimizes
potential for disputes and litigation; and
WHEREAS, the existing system offers significant protection for taxpayers while promoting
innovation; and
WHEREAS, QBS is the law in approximately forty-five (45) states and the federal government and
has been endorsed by the American Public Works Association; and
WHEREAS, proposed legislation is now pending before the Texas Legislature that would allow
priced-based selection of engineering and architectural services; and
WHEREAS, price-based selection of engineering and architects will stifle innovation, compromise
design quality, delay projects, and increase construction costs for municipalities; and
WHEREAS, the City Council has determined that it would be in the best interest of the City to
support the existing state law on qualifications-based selections and oppose proposed legislation
currently pending;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS:
SECTION 1. That the City of The Colony, Texas supports existing state law on
qualifications-based selection and opposes any proposed legislation that is currently pending
before the Texas Legislature that would allow price-based selection of engineering and
architectural services.

SECTION 2. This Resolution shall become effective immediately from and after its
passage, as the law and charter in such cases provide.
DULY PASSED and approved by the City Council of the City of The Colony, Texas, on
this the 18th day of April, 2005.
