WHEREAS, Texas Law has for many years provided for a system of qualifications-based selection ("QBS") when governmental entities select engineers and architects for public facilities; and WHEREAS, design costs are a very small part of overall construction and maintenance costs of projects, but the quality of engineering decisions is a key driver of those costs; and WHEREAS, QBS ensures a focus on long-term value in public construction and minimizes potential for disputes and litigation; and WHEREAS, the existing system offers significant protection for taxpayers while promoting innovation; and WHEREAS, QBS is the law in approximately forty-five (45) states and the federal government and has been endorsed by the American Public Works Association; and WHEREAS, proposed legislation is now pending before the Texas Legislature that would allow priced-based selection of engineering and architectural services; and WHEREAS, price-based selection of engineering and architects will stifle innovation, compromise design quality, delay projects, and increase construction costs for municipalities; and WHEREAS, the City Council has determined that it would be in the best interest of the City to support the existing state law on qualifications-based selections and oppose proposed legislation currently pending; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the City of The Colony, Texas supports existing state law on qualifications-based selection and opposes any proposed legislation that is currently pending before the Texas Legislature that would allow price-based selection of engineering and architectural services. 1 72950 SECTION 2.
