CITY OF THE COLONY, TEXAS

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS AMENDING CHAPTER 6 OF THE CITY'S CODE OF
ORDINANCES BY AMENDING ARTICLE II, SIGNS, SECTION 6-21,
DEFINITIONS, BY ADDING A DEFINITION FOR SIGN, OPEN HOUSE,
AND SIGNS, PERSONAL PROPERTY SALE (GARAGE SALE);
PROVIDING A PENALTY UPON CONVICTION IN AN AMOUNT NOT
TO EXCEED FIVE HUNDRED DOLLARS ($500.00) AND A SEPARATE
OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR
ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Section 6-21 of the Code of Ordinances provides definitions of specific
signage within the City; and
WHEREAS, the City Council desires to amend Section 6-21 by adding a definition for
open house signs and personal property sale (garage sale) signs.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS;
SECTION 1. The Code of Ordinances of the City of The Colony be, and the same is,
hereby amended by amending Chapter 6, Article II, Section 6-21 by adding a definition for
Siglls, Open House and Signs, Personal Property Sale (Garage Sale), which shall read as
follows:
"ARTICLE II. SIGNS
Sec. 6-21. Definitions.
The following words, terms and phrases, when used in this article, shall
have the meanings ascribed to them in this section, except where the context
clearly indicates a different meaning:

Signs, on-premises. . .
Signs, open house means a temporary sign that only advertises a residence
for sale, lease or rent within the City that is open for viewing by the public and
may include the name of the real estate firm, realtor, agent, the owner, the date
and time of the open house, and directions to, or the location of the open house.
Signs, personal property sale (garage sale) means a temporary sign that
only advertises the offering for sale of personal and/or household property
belonging to or in the possession of the person conducting the sale, which may
include the address, and the date and time of such sale in any residential district or
at a church.

SECTION 2. That if any article, paragraph, subdivision, clause or provision of this
ordinance or the City of The Colony Code of Ordinances, as hereby amended, be adjudged
invalid or held unconstitutional for any reason, such judgment or holding shall not affect the
validity of this ordinance as a whole or any part or provision thereof, or of the Code of
Ordinances, as amended hereby, other than the part so declared to be invalid or unconstitutional.
SECTION 3. That the City of The Colony Code of Ordinances, as amended, shall
remain in full force and effect, save and except as amended by this ordinance.
SECTION 4. Any person, firm or corporation violating any of the provisions of this
ordinance or the provisions of the Code of Ordinances of the City of The Colony, Texas, as
amended hereby, shall be deemed guilty of a misdemeanor and, upon conviction, shall be subj ect
to a fine not to exceed the sum of Five Hundred ($500.00) dollars for each offense, and each and
every day such offense shall continue shall be deemed to constitute a separate.
SECTION 5. This Ordinance shall become effective from and after its date of passage in
accordance with law.
PASSED AND APPROVED by the City Council of the City of The Colony, Texas, this
the 18th day of April, 2005.
