Acceptance or Correction of Minutes from October 28th meeting
1. John Fowler made motion to approve minutes; Cheryl Mohrbacher seconds
motion.

(John Fowler requests that items 3 & 4 be addressed first and item 1 addressed after
them. Bill Longo approves this.).
1. Court Procedures for Code Enforcement Citations: Iris Browder presents
procedures for officers in court with regards to citations. Explains that this is
for informational purposes only, requested by Bill Longo. John Fowler asks if
they are being given ample time with regards to getting to court, Iris explains
yes they are given the proper amount of time. The only problems are with the
owners that do not live here. Iris also explains that it is sometimes necessary
to issue a citation because the violation would be too costly for the City to
correct and it is sometimes unlikely that The City will get the money back
from the owners. The lien process and new collections process is discussed
and a quarterly report reflecting the collections progress is requested for the
next meeting. Tom Handley makes a motion to accept the report for court
procedures and Eugene Brown seconds.
2. Update on Junked Vehicles Enforcement- Iris Browder: Iris explains that the
existing junk vehicle ordinance was amended to reflect that car covers and
tarps are no longer allowed. We waited 2 months before enforcement was
started. November 1, 2004 uncovered junked vehicles are being written up.
We have been advised by the attorney that if we want to investigate a vehicle
that is covered we must receive an administrative warrant to go onto the
property to investigate.
John Fowler asks how many vehicles were written up for car covers were
being restored. Iris explains that out of the 149 vehicles written up from
11/01/04-12/01/04 10 were restorations.
Todd Routhier makes motion to accept update; John Fowler seconds.
3. Parking on unimproved surfaces-Iris Browder presented a draft ordinance
amending parking on unimproved surfaces. Iris presents a survey taken by the
officers- the survey is a map showing how many vehicles are parked on
unimproved surfaces currently. Harry Persaud review the numbers presented in
the survey and reiterates the problem area which in Eastvale. Bill Longo
reminds committee that most people that live in Eastvale are older and have
owned the land for many, many years. John Fowler comments that most
people in Eastvale do not have driveways. Todd Routhier comments that it is
going to be a harsh move to tell people that currently do not have driveways
that they will need to install one. Todd suggests exemption for people that do
not have any concrete currently. Tom Handley suggests that we give residents
in East vale 1 year to get in compliance. Bill Longo explains that it was
discussed a few meetings ago to give ample time for solution. Harry Persaud
suggests that the committee review and decide on enforcement very cautiously
because Mesquite tried to pass the same ordinance but the City Council backed
out at the last minute. Tom Handley agrees that we need to start somewhere
but it does need to be reviewed carefully. John Fowler disagrees and feels that
the whole idea is not a good idea. John Fowler wants to know how many
complaints we have received in regards to parking on unimproved surfaces.
Iris will have the information to him as soon as it can be gathered. Verbal
exchange between Cheryl Mohrbacher and John Fowler in regards to the
importance of this amendment for beautification purposes. Verbal exchange
between Bill Longo and John Fowler with regards to staying open minded and
exploring all options of draft ordinances. Harry Persaud suggests that we
check with Mesquite and other cities to see how they handled this problem.
Cheryl suggests we check into zoning issues with regards to parking as well.
Eugene Brown makes motion to proceed with research of draft ordinance; Rita
Webster seconds. All agree; John Fowler opposes.
Bill Longo makes motion to proceed to next item; Cheryl Mohrbacher
seconds.
4. Review and discuss amendment to Health & Sanitation Code to prohibit the
collection of water that can breed mosquitoes-Iris Browder. Iris presents
ordinance to committee. Todd Routhier asks ifthe ordinance includes water in
the alley; Iris responds that Public Works will need to contacted for that.
Cheryl Mohrbacher makes motion to accept; Eugene Brown seconds.
5. Discuss any unfinished business- Bill Longo reminds committee that we can
only discuss items listed on the agenda. Bill also reminds committee members
that January 27,2005 is the next meeting and that is when the election of the
Committee Chairperson and Vice Chair will be done. An inquiry is made into
the CRMs submitted by Linda Adams. Iris responds out of 69 CRMs, 15 were
violations, 12 were junked vehicles (not enforcing at that time), 18 already
written up and 28 not code violations.
