HomeMy WebLinkAboutResolution No. 05-40 RESOLUTION NO. 05-.% A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF THE ENGINEERING SERVICES CONTRACT BY AND BETWEEN THE CITY OF THE COLONY AND FREESE AND NICHOLS INC. FOR CHANGE ORDER No.2 FOR ADDITIONAL ENGINEERING SERVICES, \VHICH IS ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City and Consultant have entered into an agreement such that the Consultant is to provide the following services: CHANGE ORDER No.2 FOR ADDITIONAL ENGINEERING SERVICES; and \VHEREAS, the City has determined that it is in the best interest of the City to enter into the Contract with FREESE AND NICHOLS INC., which is attached hereto and incorporated herein by reference as Exhibit "A," under the tenns and conditions provided therein. WHEREAS, with this Change Order the City of The Colony is agreeing to pay the sum not to exceed $66,775.00 for such work. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS THAT: Section 1. The Change Order, which is attached and incorporated hereto as Exhibit "A", having been reviewed by the City Council of the City of The Colony, Texas, and found to be acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all things approved in the an10tmt of $66,775.00 and the City Manager is hereby authorized to execute the Agreement on behalf ofthe City of The Colony, Texas. Section 2. That this Resolution shall take effect immediately from and after its adoption and it is so resolved. PASSED, APPROVED aud EFFECTIVE this 4TH day of APRIL, 2005. {iL . -, Ai L/~0- Christie Wilson, City Secretary Dillard, Mayor ity of The Colony, Texas [CITY SEAL] 63918 SCOPE OF SERVICES TPDES Permitting aud 'VWTP Phosphorous Removal Design BASIC SERVICES: Freese and Nichols, Inc., (hereinafter "FNI") shall render the following professional services in connection with the development of this Task Order: TASK DESCRIPTION This Task Order consists of professional engineering services to provide engineering services for the City of The Colony (hereinafter "OWNER") for the following items: provide a presentation to the OWNER's Technology Review Board describing technological innovations and use of technology as part of the wastewater treatment plant improvements project; assistance in permit negotiations with the TCEQ including issues relating to the recent Authorization to Construct submittal and negotiations for a possible date extension for compliance to the previously issued Administrative Order; evaluate and design improvements to the wastewater treatment plant to assist in the implementation of biological phosphorous removal. The following is the detailed scope of work for this Task Order: Presentation to Technical Review Board 1. Make a presentation to the technical review committee providing recommendations on course of action with TCEQ and describing the technical improvements being implemented at the wastewater treatment plant. TCEO Permitting Assistance 1. Providing environmental support services including TCEQ permitting assistance, and other assistance required to address environmental issues, in particular issues related to the resolution ofthe current permit amendment and potential phosphorous limits. 2. Provide support services relating to the wastewater treatment plant permit renewal and securing an authorization to construct the work design in Task Order 5B. 3. Provide support services relating to negotiations with TCEQ for an extension to compliance of the Administrative Order issued by TCEQ. Biological Phosphorous Removal Evaluation and Design 1. Evaluate and prepare a design for Phase I Nutrient Removal to modify The Colony Wastewater Treatment Plant to include anaerobic and anoxic zones in the secondary treatment system for use in biological phosphorous removal. 2. Design modifications are to be prepared as a change order to the existing Wastewater Treatment Plant improvements construction and should include any required plans, sections, details and specifications needed for the construction of the improvements. 3. Design of the Phase I Phosphorous Improvements shall include the following process items: a. Modification of the existing aeration basin design to relocate IF AS units b. Provide partitions in the existing basin to create "swing" zones which may be used as anaerobic, anoxic or oxic treatment c. Replacement of aeration diffusers in the swing zones to new coarse air diffusers with individual drop legs and isolation/throttling valves. d. Provide mixers in the partitioned zones to ensure proper mixing at minimal or no aeration e. Modification of the RASIW AS pump automation to allow for larger wet well volumes and addition of a screened sewage bypass to bring an additional carbon source to the RAS/W AS wet well A~RPR-l FNI OWNER 4. Provide construction phase implementation, general representation and inspection of the designed improvements. Phase II Nutrient Removal Evaluation 1. Provide an evaluation and brief technical memorandum for future Phase II Nutrient Removal requirements for the WWTP to include: a. Separate anaerobic basins for advanced phosphorous and nitrogen removal, b. Potential addition of new anoxic basins for nitrogen removal and the addition of recycle flow streams for total phosphorous removal and total nitrogen removal below 0.5 mg/L P and 6 mgIL, respectively c. Alternative locations for future anaerobic basins including a stand alone basin or as part of common wall construction with future primary clarifiers d. Develop opinions of probable construction cost for future advanced nutrient removal facilities TIME OF COMPLETION: FNf is authorized to commence work on performing these services upon execution of this AGREEMENT and agrees to complete the services in a timely manner as indicated below. IF FNI's services are delayed or suspended in whole or in part by OWNER for more than 30 days through no fault of FNI, FNI shall be entitled to equitable adjustment of rates and amounts of compensation. Deliverable TCEQ Permitting Services Phase f Nutrient Removal Design Phase II Nutrient Removal Evaluation and TM Time of Completion Ongoing June 2005 (as change order) June 2005 RESPONSIBILITIES OF OWNER: OWNER shall perform the following in a timely manner so as not to delay the services ofFNI: 1. Designate in writing a person to act as OWNER's representative with respect to the services to be rendered under this AGREEMENT. Such person shall have contract authority to transmit instructions, receive information, interpret and define OWNER's policies and decisions with respect to FNI's services for the Project. 2. Assist FNI by placing at FNf's disposal all available information pertinent to the services provided including previous reports and any other data relative to the work performed 3. Examine all studies, reports, sketches, drawings, specifications, proposals and other documents presented by FNI, obtain advice of an attorney, insurance counselor and other consultants as OWNER deems appropriate for such examination and render in writing decisions pertaining thereto within a reasonable time so as not to delay the services ofFNI. 4. Furnish approvals and permits from all governmental authorities having jurisdiction over the Project and such approvals and consents from others as may be necessary for completion of the Project. 5. Give prompt written notice to FNI whenever OWNER observes or otherwise becomes aware of any development that affects the scope or timing of FNI's services. 6. Bear all costs incident to compliance with the requirements of the Responsibilities of OWNER.
