HomeMy WebLinkAboutResolution No. 05-26 CITY OF THE COLONY, TEXAS RESOLUTION NO. ø~-.:J. ~ A RESOLUTION OF THE CITY OF THE COLONY, TEXAS, ORDERING A GENERAL ELECTION TO BE HELD ON MAY 7, 2005, FOR THE PURPOSE OF ELECTING FOUR (4) COUNCIL MEMBERS FOR SINGLE MEMBER DISTRICTS 3, 4, 5, AND 6; AND PROVIDING FOR A JOINT ELECTION ON MAY 7, 2005 BETWEEN THE LEWISVILLE INDEPENDENT SCHOOL DISTRICT AND THE CITY; AND ESTABLISHING OTHER PROVISIONS RELATING TO THE ELECTION. WHEREAS, the terms of office for four (4) At Large City Council Members expire on May 7, 2005; and WHEREAS, it is hereby found and determined by the Mayor, acting in his official capacity, and the City Council acting as the governing body ofthe City of The Colony, that it is in the best interest ofthe City and its citizens to hold an election for the purpose of electing four (4) Council Members to City Council Places 3, 4, 5 and 6. WHEREAS, the Texas Election Code, Section 3.004 authorizes such election; and WHEREAS, the Texas Election Code, Section 41.001 specifies the date on which such elections may be held. NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. That a general municipal election is hereby called and ordered for the ih day of May, 2005, at which all qualified voters residing within the city limits of the City may vote for the purpose of electing their respective district Council Member to fill the expiring terms of Places 3, 4, 5 and 6. Section 2. That said election shall be held jointly with the Lewisville Independent School District by contract to be approved and entered into at a later date. Section 3. That the City Secretary is hereby designated as the Early Voting Clerk. Section 4. That early voting by personal appearance shall be conducted in The Colony City Hall, 6800 Main Street, beginning Wednesday, April 20, 2005, and continuing through Tuesday, May 3,2005, during regular working hours of8:00 a.m. to 5:00 p.m. For the purpose of additional early voting, the clerk shall keep said office open on Saturday, April 30, 2005, between the hours of 8:00 a.m. and 5:00 p.m. Section 5. That the city secretary shall receive applications for a ballot to be voted by mail until the close of business on April 29, 2005. Requests for applications should be mailed to: Christie Wilson, City Secretary, City of The Colony, 6800 Main, The Colony, Texas 75056, or requested by phone at 972 624-3106. Section 6. That the polls of each ofthe polling place on Election Day shall be open fÌom 7 :00 a.m. to 7:00 p.m. Section 7. That voting by both personal appearance and by mail in said election shall be by optical scan ballot or by any other method as approved in the Texas Election Code, as amended, and said ballots shall be printed in accordance with the Texas Election Code, as amended; and shall be canvassed by an Early Voting Ballot Board. Section 8. That no person's name shall be placed on the ballot as a candidate for the position of Council Member of the City Council until such person has filed his/her sworn application and affidavit as provided by the laws of the State of Texas and the Charter of the City of The Colony, Texas, with the City Secretary at least sixty-two (62) days prior to the election date. Section 9. That election materials as enumerated in the Texas Election Code 272.005 shall be printed in both English and Spanish for use at the polling places and for early voting for said election. Section 10. The City Secretary is hereby authorized and directed to publish and/or post, in the time and manner prescribed by law, all notices required to be so published and/or posted in connection with the conduct of this election.
