HomeMy WebLinkAbout11/09/04 P&ZLl Planning and Zoning Commission November 9, 2004 MINUTES OF THE PLANNING AND ZONING COMMISSION MEETING HELD ON NOVEMBER 9, 2004 The Regular Session of the Planning and Zoning Commission of the City of The Colony, Texas was called to order at 6:30 p.m. on the 9th day of November, 2004 at City Hall with the following members present: Tardy: Bill Jamme, Chairman Mike Barrett Marlene Milsak DeVille Hubbard Brian Wade Kirk Mikulec - Business Absent: Bill Harrison - Business Staff. Harry Persaud, Director of Development Services Lauren Odell, Planner Fred Ehler, Senior Engineer James Hanvey, Staff Engineer Sandy Vondersaar, Administrative Assistant With five (5) P & Z members present, a quorum was established and the following items were addressed: 2.0 DISPOSITION OF MINUTES 2.1 Approval and/or correction of Planning and Zoning Commission Minutes for the meeting held on October 26, 2004. Motion to approve the minutes of the meeting held on October 26, 2004, Commissioner Milsak; second, Commissioner Wade. Motion carried 4-0 with one abstention. Commissioner Hubbard was not in attendance at the October 26th meeting. -1- Planning and Zoning Commission November 9, 2004 3.0 CITIZEN INPUT None 4.0 PUBLIC HEARING Chairman Jamme opened the public hearing at 6:31 p.m. 4.1 Hold a public hearing and consider approval of a Replat for Lots 37 & 38, Block 9, Garza -Little Elm Estates, being a 0.2876 -acre tract situated in the G. Emberlin Survey, Abstract No. 394, located at 7545 South Horseshoe Trail, in the City of The Colony, Denton County, Texas. (2004-RP005) Ms. Odell presented the staff report regarding approval of a Replat for Lots 37 & 38, Block 9, Garza -Little Elm Estates located on the north side of South Horseshoe Trail at 4535 South Horseshoe Trail. Notices were mailed to the property owners within 200 feet of the subject tract. At meeting time four (4) responses in favor and zero (0) in opposition had been received. Ms. Sharon Lisenbee, owner, 4535 South Horseshoe Trail, The Colony, Texas 75056 was present to answer questions. Commissioner Mikulec arrived at 6:34 p.m. Chairman Jamme closed the public hearing at 6:35 p.m. Staff recommends approval with two (2) stipulations. Commissioner Wade requested an additional stipulation be added to correct the description on the plat. A motion for approval of a Replat for Lots 37 & 38, Block 9, Garza -Little Elm Estates, being a 0.2876 -acre tract situated in the G. Emberlin Survey, Abstract No. 394, located at 7545 South Horseshoe Trail, in the City of The Colony, Denton County, Texas. (2004-RP005) subject to three (3) stipulations, Commissioner Wade; second Commissioner Barrett. Motion carried 6-0. 4.2 Hold a public hearing and consider approval of a Replat for Lot 3, Block B, Parks of Austin Ranch Addition, being a 2.522 -acre tract situated in the John B. Martin Survey, Abstract No. 827, located South of Windhaven Parkway at the intersection of Saintsbury Drive West and Sumner Street, in the City of The Colony, Denton County, Texas. (2004-RP006) Chairman Jamme opened the public hearing at 6:36 p.m. -2- Planning and Zoning Commission November 9, 2004 Ms. Odell presented the staff report regarding approval of a Replat for Lot 3, Block B, Parks of Austin Ranch Addition located south of Windhaven Parkway at the intersection of Saintsbury Drive West and Sumner Street. Mr. Lucilo Pena and Mr. Mark Sullivan of Billingsley Company, 4100 International Parkway, Suite 1100, Carrollton, Texas and Mr. John Spiars of Spiars Engineering, 730 E. Park Boulevard, #210, Plano, Texas 75075 were present to answer questions. Chairman Jamme closed the public hearing at 6:38 p.m. Staff recommends approval. A motion for approval of a Replat for Lot 3, Block B, Parks of Austin Ranch Addition, being a 2.522 -acre tract situated in the John B. Martin Survey, Abstract No. 827, located South of Windhaven Parkway at the intersection of Saintsbury Drive West and Sumner Street, in the City of The Colony, Denton County, Texas. (2004-RP006), Commissioner Mikulec; second Commissioner Wade. Motion carried 6-0. 4.3 Hold a public hearing and consider approval of a Replat for Lots 16, 17, & 18, Block 6, Garza -Little Elm Estates, being a 0.566 -acre tract situated in the G. Emberlin Survey, Abstract No. 394, located on Main Street, North of Lake Highlands and South of Lake Park, in The City Of The Colony, Denton . County, Texas. (2004-RP004) Chairman Jamme opened the public hearing at 6:39 p.m. Ms. Odell presented the staff report regarding approval of a Replat for Lots 16, 17 & 18, Block 6, Garza -Little Elm Estates located on the west side of Main Street north of Lake Highlands and south of Lake Park. Mr. Anthony Vecchio of A V Construction, 2625 Sir Lancelot Boulevard, Lewisville, Texas 75056 was present to answer questions. Chairman Jamme closed the public hearing at 6:44 p.m. Staff recommends approval with four (4) stipulations. A motion for approval of a Replat for Lots 16, 17, & 18, Block 6, Garza -Little Elm Estates, being a 0.566 -acre tract situated in the G. Emberlin Survey, Abstract No. 394, located on Main Street, North of Lake Highlands and South of Lake Park, in The City Of The Colony, Denton County, Texas. (2004-RP004) subject to four (4) staff stipulations, Commissioner Wade; second Commissioner Barrett. Motion carried 6-0. -3- Planning and Zoning Commission November 9, 2004 5.0 ITEMS FOR CONSIDERATION 5.1 Consider a recommendation for approval of a Site Plan for Lot 3R, Block B, Parks of Austin Ranch Addition, being a 2.522 -acre tract situated in the John B. Martin Survey, Abstract No. 827, located South of Windhaven Parkway at the intersection of Saintsbury Drive West and Sumner Street, in the City of The Colony, Denton County, Texas. (2004-SP009) Ms. Odell presented the staff report regarding approval of a Site Plan for Lot 3R, Block B, Parks of Austin Ranch Addition located south of Windhaven Parkway at the intersection of Saintsbury Drive West and Sumner Street. Mr. Lucilo Pena and Mr. Mark Sullivan of Billingsley Company, 4100 International Parkway, Suite 1100, Carrollton, Texas and Mr. John Spiars of Spiars Engineering, 730 E. Park Boulevard, #210, Plano, Texas 75075 were present to answer questions. Mr. Pena gave a presentation of the Site Plan to the Commission. Chairman Jamme was concerned that the City's Ordinance does not provide for the shared parking methodology used for parking at this site. Mr. Persaud explained to Chairman Jamme this methodology has been widely used for Mixed Use Development. The Urbanland Institute Study was used to determine the parking calculations. This is a Planned Development and the standards may be different than for other developments. Chairman Jamme then asked whether the parking standards used would comply with the City requirements. Mr. Persaud answered that the parking for this site would conform with the approved Site Plan if it is approved by Council. Staff recommends approval with three (3) stipulations. A motion for approval of a Site Plan for Lot 3R, Block B, Parks of Austin Ranch Addition, being a 2.522 -acre tract situated in the John B. Martin Survey, Abstract No. 827, located South of Windhaven Parkway at the intersection of Saintsbury Drive West and Sumner Street, in the City of The Colony, Denton County, Texas. (2004-SP009) subject to three (3) staff stipulations, Commissioner Barrett; second Commissioner Wade. Motion carried 6-0 5.2 Consider a recommendation for approval of a Site Plan for Lot 17R, Block 6, Garza -Little Elm Estates, being a 0.566 -acre tract situated in the G. Emberlin Survey, Abstract No. 394, located on Main Street North of Lake Highlands and South of Lake Park, in The City Of The Colony, Denton County, Texas. (2004- SP008) Planning and Zoning Commission November 9, 2004 Ms. Odell presented the staff report regarding approval of a Site Plan for Lot 17R, Block 6, Garza -Little Elm Estates located on the west side of Main Street north of Lake Highlands and south of Lake Park. Mr. Anthony Vecchio of A V Construction, 2625 Sir Lancelot Boulevard, Lewisville, Texas 75056 was present to answer questions. Staff recommends approval subject to four (4) stipulations. The Commission requested an additional stipulation be included to address the freeze gauge ordinance. A motion for approval of a Site Plan for Lot 17R, Block 6, Garza -Little Elm Estates, being a 0.566 -acre tract situated in the G. Emberlin Survey, Abstract No. 394, located on Main Street North of Lake Highlands and South of Lake Park, in The City Of The Colony, Denton County, Texas. (2004-SP008) subject to five (5) stipulations, Commissioner Wade; second Commissioner Mikulec. Motion carried 6-0.
