RESOLUTION NO. 04-11
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF
THE ENGINEERING SERVICES CONTRACT BY AND BETWEEN THE
CITY OF THE COLONY AND HALFF ASSOCIATES, INC. FOR
DETERMINING THE SCOPE OF WATER AND WASTEWATER
RELOCATION WORK NEEDED FOR THE PROPOSED WIDENING OF
F.M. 423 (MAIN STREET), WHICH IS ATTACHED HERETO AND
INCORPORATED HEREIN AS EXHIBIT "A"; AUTHORIZING THE
CITY MANAGER TO EXECUTE THE CONTRACT; AND PROVIDING
AN EFFECTIVE DATE
WHEREAS, the City and Consultant have entered into an agreement such that the
Consultant is to provide the following services: DETERMINING THE SCOPE OF WATER
AND WASTEWATER RELOCATION WORK NEEDED FOR THE PROPOSED WIDENING
OF F.M. 423 (MAIN STREET); and
WHEREAS, the City has determined that it is in the best interest of the City to enter into
the Contract with HALFF ASSOCIATES, INC., which is attached hereto and incorporated
herein by reference as Exhibit "A," under the terms and conditions provided therein.
WHEREAS, with this Contract the City of The Colony is agreeing to pay a sum not to
exceed $301,245.00 for such work.
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS THAT:
Section 1. The Engineering Services Contract, which is attached and incorporated hereto as
Exhibit "A", having been reviewed by the City Council of the City of The Colony, Texas, and found
to be acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all
things approved, and the City Manager is hereby authorized to execute the Agreement on behalf of
the City of The Colony, Texas.
Section 2. That this Resolution shall take effect immediately from and after its adoption
and it is so resolved.
PASSED, APPROVED and EFFECTIVE this 13TH day of SEPTEMBER, 2004.

SCOPE OF WORK
for
Reconnaissance Phase Services
FM 423 Utility Relocations
from
SH 121 to North City Limits
in
THE COLONY
A. General Description
The purpose of this project is to determine the scope of water and sanitary
sewer relocation work needed to clear the proposed FM 423 project and to
coordinate with other utilities, TxDOT and Denton County in order to devise a
plan that will provide for relocation of all utilities in a smooth and efficient
manner. The end result of the reconnaissance phase will be development of
an accurate scope of work and estimates of probable cost to enable the City
to execute a design contract for water and sewer relocation design work
immediately after receipt of plans adequate by TxDOT
Included in the scope of services will be coordination meetings, data
collection, preliminary surveys, subsurface utility engineering (SUE),
preliminary engineering, and preparation of a preliminary design report to
include estimates of probable cost and schedules.
Utility relocations will be designed in accordance with the TxDOT utility
manual. It is understood Denton County will reimburse the City for
relocations within existing rights-of-way and the State will reimburse the City
for relocations in easements outside of the current right-of-way.
B. Reconnaissance Phase
1. Kick-Off Meeting
Meet with City of The Colony staff to identify any requirements or
constraints with regard to the objectives and criteria of the project.
2. Data Collection
a. Perform field reconnaissance of the areas of the proposed relocations
and prepare a photographic record of major features.
b. Obtain deeds, easements, plats and 0 ther property records from the
Denton County Deed Records.

c. 0 btain copies of water, sanitary sewer, paving and drainage plans
from the City of The Colony and TxDOT.
d. Obtain copies of master utility plans from the City to ensure that any
existing utilities are upsized to meet future demands.
e. Obtain plans for franchised utilities from franchise utility companies.
f. Obtain digital files and hard copies of proposed highway plans and
right-of-way maps from TxDOT.
g. Obtain digital files and hard copies of any subsurface utility
engineering plans prepared by TxDOT.
3. Coordination Meetings - Meet on a monthly basis with The Colony
Engineering staff, TxDOT, TxDOT consultants a nd franchised utilities to
coordinate efforts and disseminate information.
a. The City of the Colony will contact all parties to arrange the first
meeting. A regular monthly meeting time will then be established.
b. Halff will prepare the agenda and distribute meeting minutes.
c. Other meetings will be held as needed.
4. Preliminary Surveys - Preliminary surveys will obtained for the purpose of
locating above ground improvements and below ground locations of
existing utility lines. Additional surveys will necessary later during the
design phase of the project to supplement the preliminary surveys.
a. Locate and tie horizontal and vertical control used by TxDOT and tie to
City benchmarks. All design work will be done using TxDOT control.
Establish secondary control necessary for preliminary design surveys
and for additional design surveys.
b. Determine the horizontal and vertical location of all known and
accessible utilities.
c. Provide all field surveys necessary to determine the limits of existing
right-of-way and/or easements.
d. Tie significant improvements affecting design.
e. Tie SUE holes and uncovered utilities horizontally and vertically.

5. Subsurface Utility Engineering (SUE): Halff will perform a combination of
Utility Designating Partial Services (Quality Level B) and Subsurface Utility
Locate (Test Hole) Services (Quality Level A). This work will supplement
SUE work done by TxDOT.
a. For Quality Level B - Designating, existing utilities are designated in
the field using radio frequency equipment, sonic equipment and
magnetic sensing equipment. The located utilities are marked with
paint and pain markings are field tied. This level provides horizontal
location information and limited vertical information.
b. For Quality Level A - Locating, existing utilities are uncovered using
vacuum excavation equipment to obtain the actual horizontal and
vertical location of the utility.
6. Preliminary Design Report - The preliminary design report will summarize
design decisions for relocations and will serve as the basis of negotiation
for design services. It will also serve as a communication tool with TxDOT
and other utilities. A preliminary design report will be prepared for each
construction segment that will include the following:
a. An inventory of each utility line within the work area describing the
size, type, age, and extent of relocation required (if any) will be
prepared.
b. A preliminary plan showing proposed TxDOT improvements and the
extent of relocation or adjustment recommended for each line will be
provided. In heavily developed areas the recommendations may
include abandonment, rerouting, or consolidation of utility lines.
c. Preliminary estimates of probable cost for each individual relocation
and based on latest bid prices for similar projects will be provided.
Estimates will be broken into those eligible for reimbursement by the
State and those eligible for reimbursement by Denton County.
Estimates will include engineering costs.
d. Recommendations for additional easement and right-of-way needs will
be provided.
e. Six (6) copies of the preliminary design report will be submitted for
review.

7. Utility Coordination
Halff will contact franchised utilities in order to coordinate with other utility
relocations and to schedule work activities to avoid conflicts. Halff will
provide digital files to utility companies if requested.
8. Meet with City Staff
A meeting to discuss the preliminary design report will be held with City
staff. Periodic meetings will be held to discuss other important issues that
may arise. Status reports will provided weekly in email format and
monthly in written format.
C. Preparation of Construction Plans
Upon approval of the preliminary design report and recommendations
contained therein, Halff will negotiate an engineering agreement or contract to
cover preparation of construction plans.

A. BASIS OF COMPENSATION
1. The compensation for services shall be on the basis of 2.3 times total
salary cost for each employee engaged directly on the project. These
fates shall include all costs of accounting and other staff not directly
involved in project production, and such costs and staff shall not be
charged directly to the project.
2. All direct non-labor expenses associated with basic services including use
of special consultants (if authorized by the owner in writing), computer-
aided design and drafting (CADD) charges, telephone toll charges, and
travel subsistence for the principals and staff when required for the proper
execution of work, are charged at actual invoice cost times a multiplier of
1.10.
3. Vacuum excavation (SUE test holes) shall be provided according to the
following schedule:
