AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
AMENDING THE CODE OF ORDINANCES BY AMENDING SECTION 2-20
SUBSECTION (C) OF CHAPTER 2 "ADMINISTRATION" BY ADDING
VERBAGE TO THE ORDINANCE THAT ESTABLISHED THE MUNICIPAL
COURT TECHNOLOGY FUND TO ALLOW THE FUND TO BE USED FOR
THE PURPOSE OF MAINTAINING TECHNOLOGICAL ENHANCEMENTS
FOR THE MUNICIPAL COURT; PROVIDING A REPEALING CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the 76th Legislature of the State of Texas has amended Chapter 102
of the Texas Code of Criminal Procedure by adding Article 102.0172 to allow a
municipality by ordinance to create a Municipal Court Technology Fund effective until
September 1, 2005; and
WHEREAS, the City Council on August 16, 1999 passed Ordinance No. 99-1133
which established the Municipal Court Technology Fund; and
WHEREAS, the 78th Legislature of the State of Texas amended Article 102.0172
of the Code of Criminal Procedure by repealing the provision that terminated the
Municipal Court Technology Fund on September 1, 2005 and allowing funds to be used
for the purpose of maintaining technological enhancements for the municipal court.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF THE COLONY, TEXAS:
SECTION 1. The City Council hereby amends Section 2-20 titled "Municipal
Court Technology Fund" subsection (c) to read verbatim as follows:
(c) Deposit of fee into the fund; fund administration; use of fee. The municipal court
clerk shall collect the technology fee, pay the fee to the City's finance director, and the
fee shall be deposited by the finance director into the fund. The fund shall be
administered under the direction of the city council. The fund may be used only to finance
the pumhase of or to maintain technological enhancements for the Municipal Court,
including:
1. Computer systems;
2. Computer networks;
3. Computer hardware;
4. Computer software;
5. Imaging systems;

6. Electronic kiosks;
7. Electronic ticket writers; and
8. Docket management systems."
SECTION 2. All provisions of the ordinances of the City of The Colony,
Texas, in conflict with the provisions of the ordinance are hereby repealed, and all other
provisions of the ordinances of the City of the Colony, Texas, not in conflict with the
provisions of this Ordinance, shall remain in full fome and effect.
SECTION 3. This Ordinance, and every provision hereof, shall be considered
severable, and the invalidity or unconstitutionality of any section, clause, provision or
portion of this Ordinance shall not affect the validity or constitutionality of any other
portion of this Ordinance.
SECTION 4. This Ordinance shall take effect immediately upon its passage, as
the law and charter in such cases provide, and it is accordingly so ordained.
