AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT
WITH FREE~E-NICHOLS FOR A FEASIBILITY STUDY FOR A
SATELLITE WASTEWATER PLANT FOR WYNNWOOD PENINSULA;
ATTACHING THE APPROVED FORM OF CONTRACT AS EXHIBIT "A";
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1. That the City Manager of the City of The Colony, Texas is hereby authorized
to execute on behalf of the City a contract with Freese-Nichols to provide a feasibility study for a
satellite wastewater plant for Wynnwood Peninsula. The approved form of contract is attached hereto
as Exhibit "A", and made a part hereof for such purposes.
SECTION 2. This Ordinance shall take effect immediately from and after its passage bythe
City Council of the City of The Colony, Texas.

SCOPE OF SERVICES - TASK ORDER NO. 4
BASIC SERVICES: FNI shall render the following professional services in connection with the
development of this Task Order:
TASK DESCRIPTIONS
Wynnwood Peninsula Satellite Wastewater Treatment Plant
The City of The Colony needs an assessment of alternatives for wastewater treatment for the
Wynnwood Peninsula development. Freese and Nichols shall examine up to three separate
satellite treatment alternatives for Wyrmwood Peninsula and shall make recommendations for
treatment. Treatment alternatives should include potential for wastewater effluent reuse and odor
control facilities.
For each alternative, FNI will prepare wastewater flow projections for average day, max day and
peak 2-hour flows; identify required improvements including treatment requirements; prepare
budget level opinions of probable construction cost; prepare a schedule for implementation of the
improvements; and prepare a detailed report outlining the alternative improvements and
recommendations.
FNI will perform these services in accordance with the requirements of the original Agreement
for Professional Services dated November 20, 2001.
Task 1.1 Project Administration
FNI will perform general administrative duties associated with the Project including progress
monitoring, scheduling, general correspondence, office administration, and invoicing. These
duties include day-to-day contact and liaison with the OWNER and project staff; ensuring the
needs of the OWNER are met in a timely manner; providing project communication; and
monitoring work on the project.
Task 1.2 Project Meeting and Workshops
Three project status/coordination meetings will be scheduled and held in the City of The Colony
municipal offices to coordinate evaluation details and alternatives with City staff and
representatives of other entities impacted by the outcome of this study. Consult with OWNER to
review the scope of services, to verify OWNER's requirements for the Project, and to review
available data.
Task 1.3 Final Report
Prepare a Report containing schematic layouts, sketches and conceptual design criteria with
appropriate exhibits to indicate the considerations involved and some alternative-solutions
available to OWNER and setting forth FNI's f'mdings and recommendations with opinions of
probable construction costs for the Project, which includes estimates of contingencies and
allowances for charges of professionals and consultants.

RESPONSIBILITIES OF OWNER: OWNER shall perform the following in a timely manner
so as not to delay the services of FNI:
1. Designate in writing a person to act as OWNER's representative with respect to the services
to be rendered under this Task Order.
2. Provide all criteria and full information as to OWNER's requirements for the Project,
including objectives and constraints, space, capacity and performance requirements,
flexibility and expandability, and any budgetary limitations.
3. Assist FNI by placing at FNI's disposal all available information pertinent to the Project
including previous reports and any other data relative to design or construction of the Project.
4. Examine all studies, reports, sketches, drawings, specifications, proposals and other
documents presented by FNI within a reasonable time so as not to delay the services of FNI.
COMPENSATION: The total fee for this Task Order shall be computed on the basis of the
original Schedule of Charges but shall not exceed $36,800. If FNI sees the Scope of Services
changing so that Additional Services are needed, FNI will notify OWNER for OWNER's
approval before proceeding. Additional services shall be computed based on the Schedule of
Charges.
