ORDINANCE NO. '9 ~- 14 ~q
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT
WITH KIMLEY-HORN TO EVALUATE POSSIBLE IRRIGATION
SOURCES FOR FIVE STAR COMMUNITY COMPLEX; ATTACHING THE
APPROVED FORM OF CONTRACT AS EXHIBIT "A"; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1. That the City Manager of the City of The Colony, Texas is hereby authorized
to execute on behalf of the City a contract with Kimley-Horn to evaluate possible irrigation
sources for Five Star Community Complex. The approved form of contract is attached hereto as
Exhibit "A", and made a part hereof for such purposes.
SECTION 2. This Ordinance shall take effect immediately from and after its passage by the
City Council of the City of The Colony, Texas.

PREAMBLE
Describing a specific agreement between KIMLEY-HORN AND ASSOCIATES, INC. (hereinafter,
"the Consultant"), and The City of The Colony, Texas (hereinafter "the Client") in accordance with the
term~ of the Master Agreement for Continuing Professional Services dated

SECTION 1
Identification of Project: General Investigation Services - Water Master Planning for Five Star Park in
The Colony, Texas.
SECTION 2
General Category of Services: Data collection, review and recommendations for imgation source water
options for the Five Star Park.
SECTION 3
Specific Scope of Basic Services: Kimley-Hom and Associates, Inc. will perform the following basic
scope of services under this IPO.
(a) Task 1 - Data Collection and Evaluation
The Consultant will gather available information on the irrigation system for the Five
Star Park. Data collection will include discussions with City Staff and reviewing
construction documents for the park to determine the volume and rate of water required
to adequately irrigate the completed park.
The Consultant will evaluate the following possible water sources:
I. raw water from Lake Lewisville
2. treated effluent from the wastewater treatment plant
3. existing well sites currently used for potable water
4. proposed on-site well for irrigation purposes only
5. treated water purchased from DWU
6. utilizing excess capacity of a drainage detention facility and a pump station.
Co) Consultant will attend meetings with Client, developers, and other consultants at the
Client's direction or request of Client. Consultant will report findings to the Client and
work closely with the Client to develop opinions of probable construction costs, and a
letter report outlining the evaluation of the six possible water sources.

SECTION 4
Additional Services if Required: Additional Services may include master planning, design, and
construction contract administration services. Additional Services will be agreed upon using additional
IPOs.
SECTION 5
Special Terms of Compensation: Consultant will perform services on this project up to a limit of Ten
Thousand Dollars ($10,000.00). This limit is set for budgeting purposes and should not be considered a
minimum or maximum fee. Upon nearing this limit, Consultant will notify the Client to discuss further
fee limits for budgeting purposes.
SECTION 6
Report(s) Generated: The Consultant agrees that any report(s) or data collection compiled by
Consultant pursuant to this Project Order shall be the property of the City.
