MINUTES OF THE PLANNING AND ZONING COMMISSION
MEETING HELD ON DECEMBER 10, 2002
The Regular Session of the Planning and Zoning Commission of the City of The Colony,
Texas was called to order at 6:30 p.m. on the l0th day of December, 2002 at City Hall
with the following members present:
Deville Hubbard, Chairman
Rick Aliford
Brian Wade
Bill Jamme
Kirk Mikulec
Bill Harrison
Absent:
DeWayne Snider - Business
Staff:
Harry Persand, Director of Development Services
Chris Spencer, Planner
Gordon Hikel, City Attorney
Sandy Vondersaar, Administrative Assistant
With six (6) members present, a quorum was established and the following items were
addressed:
2.0 DISPOSITION OF MINUTES
2.1 Approval and/or correction of Planning and Zoning Commission Minutes for
the meeting held on November 12, 2002.
Motion to approve the minutes of the meeting held on November 12, 2002,
Commissioner Jamme; second, Commissioner Harrison. Motion carried 6-0.
3.0 CITIZEN INPUT
None
City Attorney Gordon Hikel called an executive session at 6:31. Commissioners returned
at 6:45 p.m.

4.0 PUBLIC HEARING
4.1 Hold a public hearing and consider an ordinance of the City of The Colony,
Texas amending the Comprehensive Zoning Ordinance of the City, by
amending subsection 10-200 entitled schedule of uses by district and
subsection 10-300 entitled definitions and explanations applicable to use
schedule and providing for an effective date. The proposed amendments
relate to Rehabilitation Care Facilities, Rehabilitation Care Institutions,
Group Homes, Household Care Facilities, and Elderly and Handicapped
Housing. (2002-M017)
Chairman Hubbard opened the public hearing at 6:46 p.m.
Mr. Spencer presented the staff report regarding proposed zoning amendments for
Rehabilitations Care Facilities, Rehabilitation Care Institutions, Group Homes,
Household Care Facilities, and Elderly and Handicapped Housing Facilities here in the
City. This item was tabled at the November 12, 2002 meeting.
Commissioner Harrison left the meeting at 7:15 p.m.

Those speaking in favor:
Mr. Kyle Woodall of 5692 Powers Street, The Colony, Texas, 75056 and Mr. Donald
Eliot of 4605 Carr Street, The Colony, Texas 75056.
Chairman Hubbard closed the public hearing at 7:45 p.m.
The Commissioners still feel major concems need to be addressed. It was suggested that
this item be further discussed in a work session.
A motion to table an ordinance of the City of The Colony, Texas amending the
Comprehensive Zoning Ordinance of the City, by amending subsection 10-200
entitled schedule of uses by district and subsection 10-300 entitled definitions and
explanations applicable to use schedule and providing for an effective date. The
proposed amendments relate to Rehabilitation Care Facilities, Rehabilitation Care
Institutions, Group Homes, Household Care Facilities, and Elderly and
Handicapped Housing. (2002-M017) with the stipulation a work session will be
scheduled prior to placing on a future Planning and Zoning Agenda; Commissioner
Jamme, second Commissioner Allford. Motion carried 5-0.

4.2 Hold a public hearing and consider making a recommendation to City
Council regarding an amendment to Appendix B, creating section 4.1 of the
City of The Colony's Subdivision Regulations by providing for the creation
of a Development Review Committee of the City of The Colony. (2002-M020)
Chairman Hubbard opened the public hearing at 7:47p.m.
Mr. Spencer presented the staff report regarding a request for recommendation to City
Council to amend Appendix B, creating section 4.1 of the City of The Colony's
subdivision Regulations. This item was tabled at the November 12, 2002 meeting.
Mr. Persaud stated the Development Review Committee meetings streamline and
expedite the process for development in the City.
City Attorney Hikel stated the purpose of this ordinance is to protect the City from
litigation by formalizing responses to developers' questions at the Development Review
Committee Meeting instead of by individual City staffmembers.
Chairman Hubbard closed the public hearing at 8:10 p.m.
A motion to make a recommendation to City Council regarding an amendment to
Appendix B, creating section 4.1 of the City of The Colony's Subdivision
Regulations by providing for the creation of a Development Review Committee of
the City of The Colony. (2002-M020) Commissioner Jamme; second Commissioner
Allford. Motion 5-0.
5.0 ITEMS FOR DISCUSSION
5.1 Discuss date for 2003 orientation for Planning and Zoning Commission.
Mr. Persaud informed the Commission that an Orientation for the Planning Commission
and an Advisory Committee meeting will be schedule early next year. Staff will inform
the Commission after dates have been finalized.
With no further business, the meeting adjourned at 8:15 p.m.
