HomeMy WebLinkAboutOrdinance No. 00-1201 CITY OF THE COLONY, TEXAS ORDINANCE NO. ~-/.-~0 ~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS APPROVING A CAPITAL IMPROVEMENTS PLAN; ADOPTING IMPACT FEES RELATIVE TO STORM WATER, DRAINAGE AND FLOOD CONTROL FACILITIES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 395, Tex. Loc. Gov. Code, the City Council of the City of The Colony, Texas has conducted a review and analysis of its capital improvements plan and impact fees relative to storm water, drainage and flood control facilities; and WHEREAS, the engineering firm of Corwin Engineering, Inc. assisted the City in its review and issued reports thereon; and WHEREAS, a public hearing regarding the updated capital improvements plan and impact fees for storm water, drainage and flood control was held on the 5~ day of June, 2000; and WHEREAS, following such public hearing and after review of Cotmcil reports, the City Council has determined that the updated capital improvements plans and impact fees for storm water, drainage and flood control facilities shall be approved; and WHEREAS, the City recognizes that all legal prerequisites have been met. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. Incorporation of Premises. The above recitals are hereby found to be true and correct and are incorporated herein. Section 2. Capital Improvements Plan. The Capital Improvements Plan for storm water, drainage and flood control facilities dated May 3, 2000, entitled Stream SC-iA East Drainage and on file in the office of the City Secretary is hereby approved. Section 3. Section 8-64 Amount of Impact F¢¢$. That Chapter 8 Article II, Section 8-64 of the Code of Ordinances, City of Thc Colony, Texas is hereby amended by adding the following under Section 8-64(d); (d) Impact fees for storm water, drainage and flood control facilities in the stream SC-IA East Drainage Area shall be determined as shown in Exhibit A, which is attached hereto and incorporated for all purposes. Section 4. Severability. The sections, paragraphs, sentences, phrases, clauses and words of this Ordinance are severable, and if any section, paragraph, sentence, phase, clause or word in this Ordinance or application thereof to any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance, and thc City Council hereby declares that it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 5. Savings. This Ordinance shall be cumulative of all other ordinances of the City and shall not repeal any of the provisions of those ordinances except in those instances where the provisions of those ordinances are in direct conflict with the provisions of this Ordinance. Section 6. Engrossment and Enrollment. The City Secretary of the City of The Colony is hereby directed to engross and enroll this Ordinance by copying the Caption Clause and Effective Date Clause in the minutes of the City Council and by filing this Ordinance in the ordinance records of the City. Section 7. Effective Date. This Ordinance shall take effect immediately from and after its passage and approval, and it is so ordained.
