DO ~ I I ~ AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AUTHORIZING THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION TO HOLD JOINT PUBLIC HEARINGS; PROVIDING FOR PUBLIC NOTICE OF SAID HEARINGS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, thc City Council of the City of The Colony, Texas, is empowered under Chapter 211 of the Texas Local Government Code to adopt an ordinance that provides for the City Council and the Planning and Zoning Commission to conduct a joint public heating; and WHEREAS, it is the desire of the City Council of the City of The Colony, Texas to discuss the option of conducting a joint public hearing. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. Authorization. The City Council may elect to combine the Planning and Zoning Commission hearing and the Council hearing; however, the legislative body shall not take action upon any proposed item until it has received the final report and recommendation from the Planning and Zoning Commission. Section 2. Public Notice. When the City Council elects to combine the Planning and Zoning Commission hearing and the Council hearing, the City Council shall cause a notice showing the time and place of such hearing to be published in a newspaper of general circlulation at least 15 days prior to the hearing. In addition, notice of all jointly held public heatings on proposed changes in classification, shall be given not less than ten (10) days prior to the date set for hearing, to all such property owners as the ownership appears on the last approved city tax roll. Section 3. Severability. The sections, paragraphs, sentences, phrases, clauses and words of this Ordinance are severable, and if any section, paragraph, sentence, phrase, clause or word in this Ordinance or application thereof to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance, and the City Council hereby declares that it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4. Savings. This Ordinance shall be cumulative of all other ordinances of the City and shall not repeal any of the provisions of those ordinances except in those instances where the provisions of those ordinances are in direct conflict with the provisions of this Ordinance. Section 5. Enerossment and Enrollment. The City Secretary of the City of The Colony is hereby directed to engross and enroll this Ordinance by copying the Caption Clause and Effective Date Clause in the minutes of the City Council and by filing this Ordinance in the ordinance records of the City. Section 6. ~. This Ordinance shall take effect immediately bom and after its passage and approval, and it is so ordained.
