OO '//~ ~ AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH TRUGREEN LAWN CARE FOR MOWING AND MAINTENANCE OF THE DRAINAGE DITCH LOCATED AT BAKER DR. AND BENTLEY LN.; ATTACHING THE APPROVED FORM OF CONTRACT AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the City Manager of the City of The Colony, Texas is hereby authorized to execute on behalf of the City a contract with TruGreen Lawn Cart for mowing and maintenance of the drainage ditch located at Baker Dr. and Bentley Ln. The approved form of contract is attached hereto as Exhibit "A", and made a part hereof for such purposes. SECTION 2. This Ordinance shall take effect immediately from and after its passage by the City Council of the City of The Colony, Texas. Hicks, TRMC, City Secretary APPROVED AS TO FORM: City Atto/~e~ CITY OF THE COLONY, TEXAS AMENDMENT TO AGREEMENT This agreement is entered into by the City of The Colony, Texas, hereinafter referred to as the "City", and Tm-Green Land Care: hereinafter referred to as the "Contractor". A. In addition to terms of original agreement, contractor hereby agrees to provide materials and perform the labor necessary for the completion of: 1. Weed eat ditch line south of Baker Drive, starting at Morning Star Drive and pick up all trash and directed by The Colony Parks and Recreation Department: B. Contractor shall provide proof of insurance in accordance with V.A.C.S. requirements. C. Contractor agrees to defend, indemnify and hold harmless the city from all damages, costs, expenses, and attorney fees for all claims and suits including claims and suits for death, personal injury, and property damage, arising out of, or connected with, the work performed under this contract whether or not caused in whole or in part by the negligence of the city, its agents, or employees. D. All material is guaranteed to be as specified, and the above work is to be performed in accordance with the specifications submitted for above work and completed in a substantial workmanlike manner for the sum of: Four Thousand dollars ($4000.00) for five (5) visits a year Invoices are to be presented to the City of The Colony by the first (lst) of each month, and shall be paid in accordance with the financial procedures for the City of The Colony. I. In the event contractor defaults on this contract, the City of The Colony may procure the services from other sources and hold this contractor responsible for any excess cost occasioned thereby.
