AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING ORDINANCE NO. 99-1162, THE ANNEXATION PLAN FOR THE CITY OF THE COLONY, TEXAS; PROVIDING A REPEALER CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the 76th Texas Legislature, 1999, adopted S.B. 89 extensively amending the Texas Annexation Act, Chapter 43, Local Government Code; and WHEREAS, Section 17(b) of S.B. 89, 76th Texas Legislature, 1999, requires that each city adopt an annexation plan on or before December 31, 1999, that includes territory the City plans to annex three years from the date the territory is placed in the plan in accordance with Section 43.052, Local Govemment Code; and WHEREAS, there are a number of exceptions that authorize annexation of territory without having been placed in an annexation plan and for the foreseeable future annexations of territory contemplated by the City fit into one of these exceptions; and WHEREAS, it is the City=s interest to remove territory that was included in the initial annexation plan. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: Section 1. Annexation Plan. The City Council has reviewed the future expansion needs of the City and the prospects for development within the City'. s extraterritorial jurisdiction. After studying the effects of amendments to Chapter 43 of the Texas Local Government, the City Council has determined that, at this time, the City does not intend to annex any territory that is required to be in an annexation plan in order to be annexed. The City reserves the right to amend this annexation plan in the future to add territory for annexation. Section 2. ~ The City Council amends Ordinance No. 99-1162 by removing the area identified on Exhibit "A" from the annexation plan. Section 3. Repealer. All previously adopted ordinances or resolutions or parts of ordinances or resolutions of the City of The Colony, Texas, including, but not limited to Ordinance No. 99-1162, pertaining to annexations which are not consistent with or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. Severability, If any section, article, paragraph, sentence, clause, phrase or CITY OF THE COLONY, TEXAS - ORDINANCE - Page 1 P:\DOCX~AMEND ANNEX PLAN ORD.DOC word in this Ordinance, or application thereof to any persons or circumstances is held invalid or unconstitutional by a Court of competent.jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance and the City Council hereby declares it would have passed such remaining portions of the Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 5. Engrossment and Enrollment. The City Secretary of the City of The Colony is hereby directed to engross and enroll this Ordinance by copying the Caption Clause and Effective Date Clause in the minutes of the City Council and by filing this Ordinance in the ordinance records of the City.
