AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT
WITH NATHAN D. MAIER CONSULTING ENGINEERS, INC. FOR THE
DESIGN OF MEMORIAL DR.; ATTACHING THE APPROVED FORM OF
CONTRACT AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1. That the City Manager of the City of The Colony, Texas is hereby authorized
to execute on behalf of the City a contract with Nathan D. Maier Consulting Engineers, Inc. for
the design of Memorial Dr. The approved form of contract is attached hereto as Exhibit "A", and
made a part hereof for such purposes.
SECTION 2. This Ordinance shall take effect immediately from and after its passage by the
City Council of the City of The Colony, Texas.

Blair Oaks Drive to Paige Road (3400' +/-)
Dear Mr. Saldana:
Nathan D. Maier Consulting Engineers, Inc. (NDMCE) is pleased to present this proposal for
engineering and surveying services for the Memorial Drive Improvements.
UNDERSTANDING OF THE PROJECT
Memorial Drive is proposed to be a six-lane divided urban arterial with curb and gutter, raised
median and an enclosed storm sewer system within a 100' right-of-way. The current project is
proposed to design and construct the outside four lanes of the ultimate six-lane street. We
anticipate that the roadway will be elevated 2-3 feet above natural ground to be above the 100-
year flood level of the adjacent creeks. This will require retaining walls along the park to retain
the trees along the north side of Memorial Drive near Blair Oaks Drive.
Blair Oaks Drive is currently a two-lane 37' (b-b) concrete street in a 60' right-of-way. Future
construction will include a 48' collector street with 80' right-of-way south of Memorial Drive
and a 44' collector street with 60' right-of-way north of Memorial Drive. The Memorial Drive
project will be designed to accommodate the future intersection, but will transition to the existing
Blair Oaks Drive in this project. A traffic signal, based on the future intersection layout at Blair
Oaks, is included in this project.
Paige Road is currently being designed under a separate contract which will include the
Memorial Drive intersection approach. The Memorial Drive project will include a connection to
the approach to the Paige Road intersection.
There is a separate project underway to construct a channel for Office Creek along the north side
of Memorial Drive from Paige Road to a point approximately 2300' to the west. Memorial Drive
will be parallel to and adjacent to the channel. There are two creek crossings included in the
Memorial Drive project. Each crossing is tentatively planned to consist of 2-9' x 5' box culverts.

The Memorial Drive project will include a 24" water line from the west side of Blair Oaks Drive
to Paige Road. This will include a bore under Blair Oaks Drive.
SCOPE OF WORK
1. Engineering Design
NDMCE will provide engineering design and prepare construction plans and contract
documents for Memorial Drive from Blair Oaks Drive to Paige Road. The project design
will include roadway paving, drainage, storm sewer, culvert crossings, retaining walls,
and water line. We will utilize the City of The Colony standard details to the greatest
extent feasible. The contract documents will utilize NCTCOG standard specifications or
other standards specified by the City. Progress review plans and opinions of probable
construction cost will be provided for City review at design milestone points.
2. Topographic and Design Survey
NDMCE will acquire topographic survey data necessary and sufficient for design of the
project and preparation of supporting documents. The design survey will utilize
horizontal control established by the existing Memorial Drive right-of-way. This project
does not anticipate preparing additional right-of-way or easement documents.
3. Hydraulic Studies
NDMCE will perform necessary hydraulic studies to establish the Memorial Drive
Roadway elevation and to size the culverts for the two creek crossings. We will prepare
CLOMR and LOMR applications for submittal to FEMA.
4. Traffic Signal
NDMCE will design the traffic signal at Blair Oaks Drive to accommodate the future
intersection design.
5. Construction Phase
NDMCE will assist the City in the bid process and evaluate the bids. We will provide
general administrative services during construction including periodic visits to the site (as
distinguished from the continuous services of a resident Project Representative) to
observe the progress and quality of the executed work to determine, in general, if the
work is proceeding in accordance with the Contract Documents. NDMCE will prepare
and issue routine change orders with City's approval. We will review samples, catalog
data, schedules, shop drawings, laboratory, shop and mill test of material, equipment and
other data which the contractor submits only as required by construction contract
documents. We will obtain and review monthly and final estimates for payments to
contractors and furnish to the City any recommended payments to contractors.

NDMCE will provide basic horizontal and vertical construction control staking.
Construction staking will be provided by the Contractor.
COMPENSATION
NDMCE proposes to accomplish Basic Services for a fixed fee. Special services will be
provided for a Not To Exceed Fee.

Reimbursable expenses, including reproduction, mileage and deliveries will be billed at the rate
of actual cost plus 15%. Any services requested but not defined in the scope of services above
will be performed on an hourly basis or an agreed lump sum fee. Hourly items will be billed in
accordance with our schedule of fees and charges in Attachment "A".
PAYMENT
Invoices for services outlined in this proposal will be submitted, with supporting information as
appropriate, on the first day of each month and are due within 30 days of receipt.
TERMINATION OF SERVICES
In connection with the services to be provided to you by NDMCE, we agree that you may cancel
or indefinitely suspend further work or terminate this agreement, or any portion of it, upon
written notice of thirty (30) days to NDMCE, with the understanding that immediately upon
receipt of such notice, all work being performed under this proposal or any portion of it shall

cease. Before the end of such thirty-day period, NDMCE shall provide an invoice for all work
completed and shall be compensated accordingly for all work accomplished by us prior to the
receipt of such notice.
