HomeMy WebLinkAboutOrdinance No. 01-1299 ORIGINAL CITY OF THE COLONY, TEXAS ORDINANCE NO. 0 1 ' t ~ q q AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH JIM WEATHERS CONSULTING FOR ELECTRICAL DESIGN SERVICES AT KID'S COLONY PARK; ATTACHING THE APPROVED FORM OF CONTRACT AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the City Manager of the City of The Colony, Texas is hereby authorized to execute on behalf of the City a contract with Jim Weathers Consulting for electrical design services at Kid's Colony and Bill Allen Memorial Park. The approved form of contract is attached hereto as Exhibit "A", and made a part hereof for such purposes. SECTION 2. This Ordinance shall take effect immediately from and after its passage bythe City Council of the City of The Colony, Texas. Russell, Deputy City Secretary APPROVED AS TO FORM: n-Hik~l~ Cjt4~ Attorney April 23, 2001 City of The Colony Parks and Recreation Department 5151 North Colony Blvd. The Colony, Texas 75056 Attention: Ms. Pam Nelson, Director Re: Kid's Colony Lighting Proposal # 109 This Proposal/Contract will constitute the agreement between City of The Colony (Client) and Jim Weathers Consulting (JWC) for electrical design services for the above referenced projects. SCOPE OF WORK Scope of work shall be defined as follows: BASIC SER VICES Preliminary consultation to establish project requirements including Client expectations. The electrical design shall conform to all City, State and National Code requirements. Contract Documents shall consist of Drawings and Specifications and include the following: · Site Plans showing Lighting Standards, and equipment for lighting the Playground Area. · Lighting and power design for two light poles, each with (2) 400 watt HPS floodlights. The two existing lighting standards can possibly be reused however, a structural engineer will need to be retained to inspect and report on the integrity of the poles along with design of the foundations. · Lighting levels shall be designed for low level "security" lighting only. · Lighting controls shall be via timeclock. · Site investigation to develop the background to scale will be necessary and to identify existing conditions. 2300 Highland Village Rd., Suite 535 · Highland Village, TX 75067 · Office (972) 317-9655 Fax (972) 317-1379 Ms. Pam Nelson City of The Colony April 23, 2001 Proposal # 109 Page 2 · Electrical power and control equipment will come from the existing panel in the Recreation Center. CONSTRUCTION BID DOCUMENTS Construction Bid Documents shall be developed as follows: The JWC will field verify existing conditions with background information on electronic media in AutoCad R14 (.dwg format). JWC will provide Client with reproducible vellum at the various submittal levels. The Client will be responsible for reproduction of submittals. CONSTRUCTION PHASE SER VICES Construction Phase Services included as part of Basic Services, shall include the following: Review of equipment submittals and shop drawings. One (1) construction site visit observations and engineering field reports will be provided as part of the Basic Services. SPECIFICATIONS · JWC will provide Division 16 sections of specifications.. HOURLY RATES For the purpose of the Agreement, our standard hourly rates, as indicated on the attached fee schedule, are hereby made part of the Agreement. The rates are periodically updated and are subject to change upon advance written notice, but shall remain in effect for 12 months from notice to proceed. REIMB URSAB L E EXPENSES Ms. Pam Nelson City of The Colony April 23, 2001 Proposal # 109 Page 3 Reimbursables are billable at cost, in addition to the fees for Basic Services as indicated on the attached fee schedule. TERMS AND CONDITIONS JWC's scope of services is limited to electrical services only. In the event the project is abandoned or not carried to completion, our services for that portion of the work which as been completed will be paid for based on the percentage of completion. The Contract Drawings and Specifications or reproduction of them in whole or in part shall not be used on any other project without the written approval of JWC. JWC agrees not to use these documents in whole or in part on any other project without written approval from the City of The Colony. Client agrees to furnish JWC with plans and other necessary information required for the production of the Contract Documents. This proposal will be honored thirty (30) days after date of issue and will be subject to renegotiation after that date. IF THE SERVICES covered by this Agreement have not been completed within twelve (12) months of the date hereof, through no fault of JWC, the amounts of compensation rates and multiples set forth herein shall be equitably adjusted. FEES Engineer will provide the above Basic Services for the following lump sum fee amounts: Kid's Colony Construction Documents $2,400.00 Construction Administration $ 560.00 Total Fees $2,960.00 Ms. Pam Nelson City of The Colony April 23, 2001 Proposal # 109 Page 4 PA YMENT Invoices shall be submitted monthly based on estimated percentage of completion according to · the above breakdown of fees. Client agrees to make payment of invoice amount to JWC within thirty (30) calendar days from date of invoice ADDITIONAL SER VICES Additional services include but are not limited to the following: 1. Revision of previously approved drawings. 2. Reports/Studies of energy and utility costs. 3. Detailed construction costs other than listed above. 4. Additional documents and revisions to documents after the completion date of documents. 5. Project observations, site visits and other construction services during construction not listed above. 6. On-site project supervision. 7. Conferences and project visits for coordination of construction among subcontractors. Additional Services are billable at the hourly rates specified in addition to the fees for Basic Services. We shall consider the return of a copy of this Agreement with your signature as acknowledging your acceptance of this Agreement, as a firm contract between us, and as our authorization to proceed with the work of this project.
