AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, ADOPTING A NEW REDISTRICTING PLAN THEREBY REVISING THE CITY COUNCIL FOUR SINGLE-MEMBER DISTRICT BOUNDARIES IN RESPONSE TO THE 2000 CENSUS, PROVIDING FOR THE FOLLOWING: FINDINGS OF FACT; PROPER NOTICE AND MEETING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the 2000 decennial census disclosed that existing council districts in the City of The Colony, Texas, are substantially unequal in population; and WHEREAS, the City of The Colony is experiencing rapid population growth in the areas described as the Legends Development and Austin Ranch located in the Southeast sector of the City; and WHEREAS, the City Council of the City of The Colony used its utility consumption records as of August 1, 2001, to calculate new housing units added since the 2000 census; and WHEREAS, the City Council for the City of The Colony used the August 1, 2001 population estimate for the Legends Development and the Austin Ranch areas in its redistricting of the four single-member district boundaries; and WHEREAS, the City Council of the City of The Colony has undertaken to redraw the four single-member council districts for the convenience of the people and to equalize population and assure compliance with the applicable requirements of state and federal law; and WHEREAS, the City Council for the City of The Colony considered Options A, B and C in its efforts to redraw the boundaries of the four single-member districts by using the 2000 census population figures and the City of The Colony's August 1, 2001 population estimate; and WHEREAS, through a series of public hearings and meetings, the City Council has received and considered oral testimony and written evidence regarding the need for new council districts and an appropriate configuration of these districts; and WHEREAS, the City Council finds that the attached maps and description of the new districts reflect the division of the City of The Colony into four single-member districts that satisfy all legal requirements, including the U.S. and Texas Constitution and Statutes and the Federal Voting Rights Act and the City Charter, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF THE COLONY HEREBY ORDAINS: SECTION 1. FINDINGS OF FACT. All of the above premises are hereby found to be true and correct legislative and factual findings of the City Council of the City of The Colony and are hereby approved and incorporated into the body of this ordinance as if copied in their entirety. SECTION 2. ADOPTION OF PLAN. The boundaries of the four single-member council districts are hereby modified, amended and redrawn for the purposes of apportioning the population of the City between the council districts and, as modified, amended and redrawn, the boundaries of the four single-member council member districts shall be in accordance with Option C, the maps of which are attached hereto as Exhibit "A" and the written descriptions which the Planning and Development Department is hereby directed to prepare and submit to the City Attorney for attachment hereto as Exhibit "B", which maps and written descriptions are incorporated by reference into and made a part of this ordinance. SECTION 3. GENERAL DESCRIPTION. The districts as delineated in Option C are as follows: PLACE 3: BEGINNING at the intersection of Nash Dr. and a TXU easement marked with the presence of large metal towers; THENCE southwesterly along said TXU easement to city limits line located south of S.H. 121; THENCE easterly along the city limits line parallel to S.H. 121; THENCE following said city limits line as it meanders around Austin Ranch; THENCE northerly along the east city limits line to a point of reference where the alleyway located south of Northpointe Dr. meets said city limits line; THENCE westerly along the centerline of said alleyway to drainage easement that is between south side of Baker Dr. and north of and parallel to Tucson Dr.; THENCE westerly along centerline of said drainage easement to its intersection with Momingstar Dr.; THENCE northerly along centerline of Momingstar Dr. to its intersection with Baker Dr.; THENCE westerly along centerline of Baker Dr. to its intersection with Slay Dr.; THENCE southerly along centerline of Slay Dr. to its intersection with Gates Dr.; THENCE westerly along centerline of Gates Dr. to its intersection with Paige Rd.; THENCE southerly along centerline of Paige Rd. to its intersection with Yager Rd.; THENCE westerly along centerline of Yager Rd. to its intersection with Miller Dr.; THENCE southerly along centerline of Miller Dr. to its intersection with Nash Dr.; 2 THENCE westerly along centerline of Nash Dr. to its intersection with a TXU easement marked by the presence of large metal towers, the point of beginning. PLACE 4: ALL of that area of The Colony located west of F.M. 423 and north of an unnamed tributary of Lewisville Lake extending between Stewart's Creek Park and East Hill Park to a point on F.M. 423 and the intersection of Nash Dr. PLACE 5: BEGINNING at the intersection of North Colony Blvd. and a TXU easement marked with the presence of large metal towers; THENCE westerly along centerline of North Colony Blvd. to its intersection with a drainage easement located west of and parallel to Ragan Dr.; THENCE northerly along said easement to city limits line; THENCE northerly and westerly along north city limits line to its intersection with F.M. 423; THENCE southerly along centerline of F.M. 423 to a point on F.M. 423 and the intersection of Nash Dr.; THENCE southwesterly along unnamed tributary of Lewisville Lake extending between Stewart's Creek Park and East Hill Park to city limits line; THENCE southerly along city limits line to southern city limits line located at intersection of S.H. 121 and Standridge Dr.; THENCE northeasterly along said city limits line to its intersection with a TXU easement marked with the presence of large metal towers; THENCE northeasterly along said TXU easement to its intersection with North Colony Blvd., the point of beginning. PLACE 6: BEGINNING at the northeastern most point of The Colony city limits; THENCE westerly along the north city limits line of The Colony to its intersection with a drainage easement located west of and parallel to Ragan Dr.; THENCE southerly along said drainage easement to its intersection with North Colony Blvd.; THENCE easterly along centerline of North Colony Blvd. to its intersection with a TXU easement marked with the presence of large metal towers; THENCE southwesterly along said easement to its intersection with Nash Dr.; THENCE easterly along centerline of Nash Dr. to its intersection with Miller Rd.; THENCE northerly along centerline of Miller Rd. to its intersection with Yager Dr.; THENCE easterly along centerline of Yager Dr. to its intersection with Paige Rd.; THENCE northerly along centerline of Paige Rd. to its intersection with Gates Dr.; THENCE easterly along centerline of Gates Dr. to its intersection with Slay Dr.; THENCE northerly along centerline of Slay Dr. to its intersection with Baker Dr.; THENCE easterly along centerline of Baker Dr. to its intersection with Momingstar Dr.; THENCE southerly along centerline of Momingstar Dr. to its intersection with a drainage easement which is between the south side of Baker Dr. and north of and parallel to Tucson Dr.; 3 THENCE easterly across said easement to alleyway located south of Northpointe Dr.; THENCE easterly along said alleyway to its intersection with The Colony city limits; THENCE northerly along east city limits line to the northeastern most point of The Colony, the point of beginning. SECTION 4. ELECTION PRECINCTS. The City Attorney is hereby instructed to send a copy of this ordinance and the new district maps and legal descriptions to the proper officials of Denton County so the County can make the necessary changes in the County's election precincts, as required by the Texas Election Code, and effective for the May 2002, City Council Election. SECTION 5. PROPER NOTICE AND MEETING. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required and that public notice of the time, place and purpose of this meeting was given as required by the Open Meetings Act, Chapter 551 of the Texas Government Code. SECTION 6. This ordinance shall become effective immediately upon its passage and approval. PASSED AND APPROVED this the 17th day of September, 2001.
