ORDINANCE NO. ~ I-~ '~}
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
AMENDING ITS ORDINANCE NO. 97-1000, THE CITY OF THE
COLONY'S 1997 THOROUGHFARE PLAN, ADOPTED AS PART
OF THE CITY OF THE COLONY'S CAPITAL IMPROVEMENT
PROJECTS, AMENDING THE MAP OF THE OFFICIAL
THOROUGHFARE PLAN, AND PROVIDING FOR A PENALTY,
SAVINGS, FILING, CUMMULATIVE, SEVERABILITY,
PUBLICATION, AND ENGROSSMENT AND ENROLLMENT
CLAUSES, AND AN EFFECTIVE DATE.
WHEREAS, at its regular meeting held on the 28t~ day of August 2001, the
Planning and Zoning Commission did consider and make recommendations on a certain
request to amend the City of The Colony's 1997 Thoroughfare Plan; and
WHEREAS, the City Council, after determining all legal requirements of notice
and hearing have been met, has further determined that the following amendment to the
1997 Thoroughfare Plan would provide for and would be in the best interest of the health,
safety, morals, and general welfare.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF THE COLONY, TEXAS:
SECTION 1.
That the City of Thc Colony's 1997 Thoroughfare Plan is hereby amended as
follows:
('l) Extend Windhaven Parkway from Piano Parkway to Josey Lane.
(2) Re-align Headquarter's Drive to connect to the extended Windhaven Parkway about
1000 feet west of Piano Parkway. This arterial is shown as 6D-A and may be
reduced to 4U-A pending a formal traffic study.
(3) Delete Overlake Drive.
(4) Delete Marsh Lane extension through Austin Ranch North of Parker road.
The amendments are specifically shown on the amended Thoroughfare Plan
attached hereto and incorporated herein as Exhibit "A".
SECTION 2.
PENALTY
That any person, firm or corporation violating a provision of this Ordinance, upon
conviction, is guilty of an offense punishable as provided in the City of The Colony's

Code of Ordinances, as amended, by a fine not to exceed two thousand and no/100
dollars ($2,000.00); and each day or portion thereof during which the violation is
committed, continued or permitted shall be a separate offense.
SECTION 3.
SAVINGS
All rights and remedies of the City of The Colony are expressly saved as to any
and all violations of the provisions of any Ordinances affecting budgets and budget
approval or adoption, which have accrued at the time of the effective date of this
Ordinance; and, as to such accrued violations and all pending litigation, both civil and
criminal, whether pending in court or not, under such Ordinances, same shall not be
affected by this Ordinance but may be prosecuted until final disposition by the courts.
SECTION 4.
FILING
That a copy of this Ordinance shall be filed with the City Secretary of the City of
The Colony, Texas.
SECTION 5.
CUMULATIVE
This Ordinance shall be cumulative of all provisions of Ordinances of the City of
The Colony, Texas, except where the provisions of this Ordinance are in direct conflict
with the provisions of such Ordinances, in which event the conflicting provisions of such
Ordinances are hereby repealed.
SECTION 6.
SEVERABILITY
It is hereby declared to be the intention of the City Council of the City of The
Colony that the phrases, clauses, sentences, paragraphs, and sections of this Ordinance
are severable, and if any phrase, clause, sentence, paragraph, or section of this Ordinance
should be declared unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs, or sections of this Ordinance, since the same
would have been enacted by the City Council without incorporation in this Ordinance of
any such unconstitutional phrase, clause, sentence, paragraph, or sections of this
Ordinance.
SECTION 7.
PUBLICATION

The City Secretary of the City of The Colony is hereby directed to publish in the
Official Newspaper of the City of The Colony the Caption and the Effective Date Clause
of this Ordinance as required by Section 52.013 of the Local Government Code.
SECTION 8.
ENRGOSSMENT AND ENROLLMENT
The City Secretary of the City of The Colony is hereby directed to engross and
enroll this Ordinance by copying the exact Caption and Effective Date clause in the
minutes of the City Council of the City of The Colony and by filing this Ordinance in the
Ordinance records of the City.
SECTION 9.
EFFECTIVE DATE
This Ordinance shall be in full force and effect and after its date of passage, in
accordance with law;
AND IT IS SO ORDAINED.
