MAIER CONSULTING FOR THE OFFICE CREEK PHASE liB IMPROVEMENTS AND AUTHORIZING A PROFESSIONAL SERVICES CONTRACT; ATTACHING THE APPROVED FORM OF CONTRACT AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE BE 1T ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the City Manager of the City of The Colony, Texas is hereby authorized to execute on behalf of the City a contract with NATHAN D. MAIER CONSULTING ENGINEERS, INC. for the Office Creek Phase IIB Improvements and authorizing a professional services contract. The approved form of contract is attached hereto as Exhibit "A", and made a part hereof for such purposes. SECTION 2. This Ordinance shall take effect immediately from and after its passage by the City Council of the City of The Colony, Texas. City Engineer City of The Colony 6800 Main Street The Colony, Texas 75056 RE: Phase lib Office Creek Improvements East of Blair Oaks Drive through 80-Acre Park Property Dear Mr. Saldana: Nathan D. Maier Consulting Engineers, Inc. (NDMCE) is pleased to present this proposal for engineering services for Office Creek Phase II improvements east of Blair Oaks Drive. UNDERSTANDING THE PROJECT SCOPE Office Creek is the primary conveyor of storm water for the southern sector of the City of The Colony. Office Creek drains in a westerly direction and is located north of SH121. Phase I channel improvements extended from approximately 1100-feet east of Blair Oaks, east through Paige Road, and terminated at an existing culvert under SH121. The section of creek from Blair Oaks upstream 1100-feet to the end of Phase I construction remains as a natural creek section with a mature growth of bottomland hardwood trees. It is desirable to retain this section of creek in its natural condition. This canopy of trees extends north from the creek a varying depth from 70' to 180'. To maintain the conveyance capacity of the 100-year discharge (about 4000 cfs), provide for Office Creek Drainage Master Plan detention, and to reduce the floodplain on properties south of Memorial Drive a split flow condition is needed for this remaining 1100-feet of channel improvements. The Master Plan recommended 4-10'x9' multiple box culvert structure to supplement the existing 2-84" diameter CMP structure at Blair Oaks. A planned split flow channel will run north of the tree line and extend 1100-feet from termination of the Phase I improvements to the proposed multiple box culvert structure at Blair Oaks. The construction plans for Blair Oaks drainage structure and the downstream channel improvements (Phase 2A) are to be provided by others. The design and engineering for the split flow channel east of Blair Oaks and north of the tree line including the grading of the storm water detention facility in the 80-acre park property is to be completed separately as part of this project (Phase 2B). Engineering Design NDMCE will provide engineering design and prepare the Phase 2B construction plans and contract documents for the 1100-foot split flow channel and the detention grading on the 80-acre City park property. We will coordinate this design effort with the downstream design (Phase 2A), Phase 1 construction, and with the park master plan. We will utilize the City of The Colony standard details to the greatest extent feasible. The contract documents will utilize NCTCOG standard specifications or other standards specified by the City. Progress review plans and opinions of probable construction cost will be provided for City review at design milestone points. 2. Topographic and Design Survey NDMCE, under separate contract, has provided the necessary survey data for design of the project and preparation of supporting documents. Additional field survey, to supplement the existing topographic mapping, will be needed to cross section the existing natural creek. Approximately twenty-five sections of the stream will be needed to define the creek for hydraulic design and for submittal to FEMA for a CLOMR. This survey will need to be coordinated with the downstream Phase 2A plans and the upstream Phase I improvements. 3. Hydraulic Studies NDMCE will perform necessary hydraulic studies to size the split flow channel and detention facility. We will prepare Conditional Letter of Map Revision (CLOMR) and Letter of Map Revision (LOMR) applications for submittal to FEMA. For the hydraulics modeling, the current effective FEMA models (floodway and multiple profile) will be duplicated. A second corrected effective model will be generated that uses the field surveyed cross sections for data input. This model will be used as the baseline conditions model for comparisons against a proposed channel improvement model. This proposed CLOMR model will include the downstream Phase 2A channel improvements and the proposed culverts at Blair Oaks Drive, the proposed Phase 2B split flow channel, the proposed Memorial Drive improvements, and the Phase 1 channel improvements and culvert at Paige Road. The current 100-year floodplain will be determined with the baseline model and the proposed channel improvement will be modeled to demonstrate compliance with local and FEMA regulations. Once the construction has been completed for Phases 2A, 2B, and Phase 1, we will proceed with a FEMA LOMR that reflects all the completed channel and culvert work from downstream of Blair Oaks Ddve to upstream of Paige Road for an intedm map correction. Page 3 December lO, 2001 Phase lib Office Creek Improvements Proposal The Memodal Road LOMR will need to be processed at a later date after the road construction has been completed. For the CL©MR application, three sets of computer models will be included. The initial set will be a duplication of the FEMA current effective multiple profile and floodway runs. A second set of models will add any new field surveyed cross sections for a pre-project revised existing conditions model, and a third set of computer models will present the proposed project analysis that will show the recommended channel and culvert improvements. 4. Construction Phase NDMCE will assist the City in the bid process and evaluate the bids. We will provide general administrative services during construction including periodic visits to the site to observe the progress and quality of the executed work to determine, in general, if the work is proceeding in accordance with the Contract Documents. NDMCE will prepare and issue routine change orders with City's approval. We will obtain and review monthly and final estimates for payments to contractors and furnish to the City any recommended payment to contractors. NDMCE will provide basic horizontal and vertical construction control. Construction staking is to be provided by the Contractor. COMPENSATION NDMCE proposes to accomplish Basic Services for a fixed fee. Special services will be provided for a Not To Exceed Fee. Basic Services Engineering Design $15,600.00 Special Services Field Survey of Creek and Coordination $12,000.00 Of Phase 2A and Phase 1 Hydraulic Analysis $ 3,600.00 Construction Phase $ 4,500.00 TOTAL BASIC AND SPECIAL SERVICES $35,700.00 Additional Special Services CLOMPJLOMR Application $16,300.00 Reimbursable Allowance $11,500.00 TOTAL ADDITIONAL SPECIAL SERVICES $27,800.00 TOTAL PROJECT COST $63,500.00 Reimbursable expenses that include reproductions, mileage, and deliveries will be billed at the rate of actual cost plus 15%. FEMA application fees are currently $3,100 for the FEMA CLOMR. These will be billed as direct reimbursable expenses. Any services requested but not defined in the scope of services above will be performed on an hourly basis or an agreed lump sum fee. All services performed will be billed monthly as the project progresses. All invoices will be due within 30 days of invoice date. TERMINATION OF SERVICES In connection with the services to be provided to you by NDMCE we agree that you may cancel or indefinitely suspend further work or terminate this agreement, or any portion of it, upon written notice to NDMCE, with the understanding that immediately upon receipt of such notice all work being performed under this proposal, or any portion of it, shall cease. NDMCE shall provide an invoice for all work completed and shall be compensated in accordance with the terms of this proposal for all work accomplished by us prior to the receipt of such notice.
