AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT
WITH FREESE-NICHOLS TO EVALUATE OUR WASTEWATER PLANT
IN THE AMOUNT OF $61,341.00; ATTACHING THE APPROVED FORM
OF CONTRACT AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1. That the City Manager of the City of The Colony, Texas is hereby authorized
to execute on behalf of the City a contract with Freese-Nichols for the evaluation of our
wastewater plant for $61,341.00. The approved form of contract is attached hereto as Exhibit "A"
and made a part hereof for such purposes. '
SECTION 2. This Ordinance shall take effect immediately from and after its passage by the
City Council of the City of The Colony, Texas.

SCOPE OF SERVICES
TASK ORDER NO. 2
BASIC SERVICES: FNI shall render the following professional services in connection
with the development of this Task Order:
Task Description
The City of The Colony (hereinafter "CITY") needs to perform an assessment of the City
of The Colony Wastewater Treatment Plant (WWTP) with respect to capacity, remaining
service life and recommended improvements or modifications to improve plant
performance, reliability and ease of operation. The assessment shall be performed in
three phases:
Phase 1 - Evaluation of wastewater treatment facilities with plant flows from the
existing service area.
· Phase 2 - Evaluation of wastewater treatment facilities with flows to include the
addition of Wynnwood Peninsula to the service area.
· Phase 3 - Evaluation of wastewater treatment facilities with flows to include the
addition of Wynnwood Peninsula and Austin Ranch to the service area.
Under each phase, FNI will prepare population and flow projections, identi~ required
improvements, prepare budget level opinions of probable construction cost, prepare a
schedule for implementation of the improvements, and prepare a detailed technical
memorandum outlining the proposed improvements. Evaluations will take into account
existing and potential future permit discharge requirements, project funding and sludge
management issues. FNI will identify recommended improvements and estimate timeline
for reaching 75% and 90% of treatment capacity based on these recommendations.
FNI will perform these services in accordance with the requirements of the original
Agreement for Professional Services dated November 6, 2001.
Task 1.1 Project Administration
FNI will perform general administrative duties associated with the Project including
progress monitoring, scheduling, general correspondence, office administration, and
invoicing. These duties include day-to-day contact and liaison with the CITY and project
staff; ensuring the needs of the CITY are met in a timely manner; providing project
communication; and monitoring work on the project.
Task 1.2 Project Meeting and Workshops
Three project status/coordination meetings will be scheduled and held in the City of The
Colony municipal offices. Project meetings will be held at the beginning of the project
(kickoff meeting) at the 50% progress level and at the 90% progress level. FNI will also
make up to two (2) presentations to the City Council upon request.
Task 1.3 Evaluation of Existing Facilities
Freese and Nichols will provide the following:
1. Consult with CITY to review the scope of services, verify requirements for the
Project, and to review available data.
2. Evaluate the existing treatment facilities relating to the current service area,
prepare population and flow projections, and evaluate alternatives for improving
plant performance and reliability. Evaluation shall include requirements of
existing and potential future permit discharge requirements.
3. Evaluation shall take into account design of improvements to the plants existing
holding pond, which are being conducted under Task Order No. 1. In addition to
other plant reliability and treatment issues, the Technical Memorandum shall
address current issues with the existing chlorine contact basin and ammonia
discharge permit limits.
4. Prepare a Technical Memorandmn reporting on alternative improvements and
recommendations, including preliminary layouts and drawings, opinions of
probable construction cost and implementation schedules.
Deliverable: Draft Technical Memorandum #1 (5 copies).
Final Technical Memorandum # 1 (5 copies).
Task 1.4 Evaluation of Wastewater Facilities including the addition of Wynnwood
Peninsula
Freese and Nichols will provide the following:
1. Consult with CITY to review the scope of services, verify requirements for the
Project, and to review available data.
2. Evaluate the existing treatment facilities relating to the current service area and
the potential addition of Wynnwood Peninsula, prepare population and flow
projections for the expanded service area, and evaluate alternatives for improving
plant performance and reliability. Evaluation shall include requirements of
existing and potential future permit discharge requirements.
3. Prepare a Technical Memorandum reporting on alternative improvements and
recommendations, including preliminary layouts and drawings, opinions of
probable construction cost and implementation schedules.
Deliverable: Draft Technical Memorandum #2 (5 copies).
Final Technical Memorandum #2 (5 copies).
Task 1.5 Evaluation of Wastewater Facilities including the addition of Wynnwood
Peninsula and Austin Ranch
Freese and Nichols will provide the following:
1. Consult with CITY to review the scope of services, verify requirements for the
Project, and to review available data.
2. Evaluate the existing treatmem facilities relating to the current service area and
the potential addition of Wynnwood Peninsula and Austin Ranch, prepare
population and flow projections for the expanded service area, and evaluate
alternatives for improving plant performance and reliability. Evaluation shall
include requiremems of existing and potential future permit discharge
requiremems.
3. Prepare a Technical Memorandum reporting on alternative improvements and
recommendations, including preliminary layouts and drawings, opinions of
probable construction cost and implememation schedules.
4. Flow projections for Austin Ranch shall be as prepared by the North Texas
Municipal Water District and provided by the City.
Deliverable: To be consolidated with Task 1.4 Deliverables (Technical
Memorandum #2).
Task 1.6 Final Report
Prepare a Report comaining schematic layouts, sketches and conceptual design criteria
/ with appropriate exhibits to indicate the considerations involved and some alternative
// solutions available to CITY and setting forth FNI's findings and recommendations with
/ opinions of probable construction costs for the Project, which includes estimates of
J/ comingencies and allowances for charges of professionals and consultants. Final Report
shall incorporate the findings of Technical Memorandums #1 and #2 into a single report.
Deliverable: Draft Final Report (5 copies).

COMPENSATION: The total fee for this Task Order shall be computed on the basis of
the original Schedule of Charges but shall not exceed $61,341. If FNI sees the Scope of
Services changing so that Additional Services are needed, FNI will notify CITY for
approval before proceeding. Additional services shall be computed based on the
Schedule of Charges.
Compensation for each phase shall be as indicated below:
Phase 1 - Evaluation of wastewater treatment facilities with plant flows from the
existing service area, compensation shall be the lump sum of $34,983.
Phase 2 - Evaluation of wastewater treatment facilities with flows to include the
addition of Wynnwood Peninsula to the service area, compensation shall be the
lump sum of $13,179.
Phase 3 - Evaluation of wastewater treatment facilities with flows to include the
addition of Wynnwood Peninsula and Austin Ranch to the service area,
compensation shall be the lump sum of $13,179.
