O~- /~L~ AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH FREESE-NICHOLS TO REPAIR THE CITY'S BACKWASH POND AT THE SEWER PLANT IN THE AMOUNT OF $24,732.00; ATTACHING THE APPROVED FORM OF CONTRACT AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the City Manager of the City of The Colony, Texas is hereby authorized to execute on behalf of the City a contract with Freese-Nichols to repair the city's backwash pond at the sewer plant for $24,732.00. The approved form of contract is attached hereto as Exhibit "A", and made a part hereof for such purposes. SECTION 2. This Ordinance shall take effect immediately from and after its passage by the City Council of the City of The Colony, Texas. Hicks, City Secretary APPROVED AS TO FORM: ~i~i-ke 1 ,-C i~A-t~omey SCOPE OF SERVICES TASK ORDER NO. 1 BASIC SERVICES: FNI shall render the following professional services in connection with the development of this Task Order: General The City of the Colony (hereinafter "City") has an existing holding pond at the wastewater treatment plant that is in need of repair. The 0.4 MG pond collects the backwash wastewater from the filters, the decant liquid from the sludge drying beds and excess sludge from the chemical clarifier via gravity piping systems. A 6" diameter discharge pipe is utilized to drain the pond and return the sludge and water to the headworks. Based on the drawings, the pond has bottom dimensions of 35' x 140' and is not lined. The pond's side slopes have sloughed and are covered with weeds and trees and sludge has accumulated at the discharge end and plugged the return line. The City would like to have the existing pond cleaned out, the trees and vegetation removed, the slopes and bottom of the pond reshaped and lined with concrete. This will allow the City to wash the pond and keep the sludge from accumulating in the bottom of the pond and plugging the return line. FNI will prepare Contract Documents for the improvements to the holding pond. Task 2.0 Project Administration FNI will perform general administrative duties associated with the Project including progress monitoring, scheduling, general correspondence, office administration, and invoicing. These duties include day-to-day contact and liaison with the CITY and project staff; ensuring the needs of the CITY are met in a timely manner; providing project communication; and monitoring work on the project. Two project status/coordination meetings will be scheduled and held at the CITY'S offices. Task 2.1 Preparation of Contract Documents 1. Provide field surveying and topographic map of the existing 0.4 MG holding pond area required for the preparation of drawings. 2. Prepare drawings, specifications, Construction Contract Documents, designs and layouts for the improvements to the existing 0.4 MG holding pond. 3. Meet twice with the CITY to discuss the drawings and specifications, once at 50% project completion and once at 90% project completion. Prepare bidder's proposal forms (project quantities) of the improvements to be constructed. 6. Furnish the CITY five sets of copies of drawings, specifications, and bid proposals marked "Draft" for approval by CITY. Upon final approval by CITY, FNI will provide CITY five sets of copies of"Final" drawings. Task 2.2 Bid Phase 1. Assist CITY in securing bids. Issue a Notice to Bidders to prospective contractors and to selected plan rooms. Provide a copy of the notice to bidders for CITY to use in notifying construction news publications and publishing appropriate legal notice. The cost for publications shall be paid by CITY. 2. Print Bid Documents and distribute to selected plan rooms, and to prospective bidders that respond to the Notice to Bidders. 3. Assist CITY by responding to questions and interpreting bid documents. Prepare and issue addenda to the bid documents to plan holders if necessary. 4. At CITY request, FNI will assist CITY in the opening, tabulating, and analyzing the bids received. Review the qualification information provided by the apparent low bidder. Recommend award of contracts or other actions as appropriate to be taken by CITY i. Assist the CITY in conducting a pre-bid conference for the construction projects and coordinate responses with CITY. ii. Assist CITY in the preparation of Construction Contract Documents for construction contracts. Provide ten (10) sets of Construction Contract Documents for execution by the CITY and construction contractor. Distribute five (5) copies of these documents to the contractor with a notice of award that includes directions for the execution of these documents by the construction contractor. Provide CITY with the remaining five (5) copies of these documents for use during construction. Additional sets of documents can be provided as an additional service. iii. Furnish contractor copies of the drawings and specifications for construction pursuant to the General Conditions of the Construction Contract. Assist CITY in conducting pre-construction conference(s) with the Contractor and review construction schedules prepared by the Contractor pursuant to the requirements of the construction contract. 2. Review contractor's submittals, including, requests for information, modification requests, shop drawings, schedules, and other submittals in accordance with the requirements of the construction contract documents for the projects. 3. Review Payment Requests and supporting documentation submitted by Contractor and recommend the amount to be paid on monthly and final estimates, pursuant to the General Conditions of the Construction Contract. 4. Make two visits to the site to observe the progress and the quality of work and to attempt to determine in general if the work is proceeding in accordance / with the Construction Contract Documents. Visits to the site in excess of the ,,,/ specified number are an additional service. / 5. Notify the contractor of non-conforming work observed on site visits. Review quality related documents provided by the contractor such as test reports or other documentation required by the Construction contract documents. 6. Coordinate the work of testing laboratories required for the testing or inspection of materials for quality control of the Project. The cost of such quality control shall be paid by CITY and is not included in the services to be performed by FNI. 7. Interpret the drawings and specifications for CITY and Contractor. Investigations, analyses, and studies requested by the Contractor and approved by CITY, for substitutions of materials or deviations from the drawings and specifications is an additional service. 8. Process contract modifications and negotiate with the contractor on behalf of the CITY to determine the cost and time impacts of these changes. Prepare change order documentation for approved changes for execution by the CITY. Documentation of field orders, where cost to CITY is not impacted, will also be prepared. 9. Conduct, in company with CITY'S representative, a fmal review of the Project for conformance with the design concept of the Project and general compliance with the Construction Contract Documents. Prepare a list of deficiencies to be corrected by the contractor before recommendation of final payment. Visiting the site to review completed work in excess of two trips are an additional service. Revise the construction drawings in accordance with the information furnished by construction Contractor reflecting changes in the Project made during construction. Two (2) sets of prints of "Record Drawings" shall be provided by FNI to CITY. Task 2.4 Schedule 1. Notice to Proceed December 23, 2002 2. Surveying - Field Work Week of January 6, 2003 3. Surveying - Office January 13-14 4. 50% Submittal to CITY February 14 5. CITY Review February 14-21 6. 90% Submittal to CITY March 5 7. CITY Review March 6- 11 8. 100% Submittal to CITY March 18 COMPENSATION: The total fee for this Task Order shall be computed on the basis of the original Schedule of Charges but shall not exceed $24,732. If FNI sees the Scope of Services changing so that Additional Services are needed, FNI will notify CITY for approval before proceeding. Additional services shall be computed based on the Schedule of Charges. Compensation for each phase shall be as indicated below: Construction Plans and Specifications Phase shall be the lump sum of $17,120. Bid and Construction Phase shall be the lump sum of $7,611.
