AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING ITS ORDINANCE NO. 97-1000, THE CITY OF THE COLONY'S 1997 THOROUGHFARE PLAN, ADOPTED AS PART OF THE CITY OF THE COLONY'S CAPITAL IMPROVEMENT PROJECTS, AMENDING THE MAP OF THE OFFICIAL THOROUGHFARE PLAN, AND PROVIDING FOR A PENALTY, SAVINGS, FILING, CUMMULATIVE, SEVERABILITY, PUBLICATION, AND ENGROSSMENT AND ENROLLMENT CLAUSES, AND AN EFFECTIVE DATE. WHEREAS, at its regular meeting held on the 9th day of April 2002, the Planning and Zoning Commission did consider and make recommendations on a certain request to amend the City of The Colony's 1997 Thoroughfare Plan; and WHEREAS, the City Council has determined that the following amendment to the 1997 Thoroughfare Plan would provide for and would be in the best interest of the health, safety, morals, and general welfare. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the City of The Colony's 1997 Thoroughfare Plan is hereby amended to show South Colony Boulevard west of Westport Drive to Lakeshore Boulevard as a collector street with a 60 feet Right-of-Way and designated 4U-B. The amendment is specifically shown on the amended Thoroughfare Plan attached hereto and incorporated herein as Exhibit "A". SECTION 2. PENALTY That any person, firm or corporation violating a provision of this Ordinance, upon conviction, is guilty of an offense punishable as provided in the City of The Colony's Code of Ordinances, as amended, by a fine not to exceed two thousand and no/100 dollars ($2,000.00); and each day or portion thereof during which the violation is committed, continued or permitted shall be a separate offense. SAVINGS All rights and remedies of the City of The Colony are expressly saved as to any and all violations of the provisions of any Ordinances affecting budgets and budget approval or adoption, which have accrued at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such Ordinances, same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. SECTION 4. FILING That a copy of this Ordinance shall be filed with the City Secretary of the City of The Colony, Texas. SECTION 5. CUMULATIVE This Ordinance shall be cumulative of all provisions of Ordinances of the City of The Colony, Texas, except where the provisions of this Ordinance are in direct conflict with the provisions of such Ordinances, in which event the conflicting provisions of such Ordinances are hereby repealed. SECTION 6. SEVERABILITY It is hereby declared to be the intention of the City Council of the City of The Colony that the phrases, clauses, sentences, paragraphs, and sections of this Ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this Ordinance should be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this Ordinance, since the same would have been enacted by the City Council without incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or sections of this Ordinance. SECTION 7. PUBLICATION The City Secretary of the City of The Colony is hereby directed to publish in the Official Newspaper of the City of The Colony the Caption and the Effective Date Clause of this Ordinance as required by Section 52.013 of the Local Government Code. ENGROSSMENT AND ENROLLMENT The City Secretary of the City of The Colony is hereby directed to engross and enroll this Ordinance by copying the exact Caption and Effective Date clause in the minutes of the City Council of the City of The Colony and by filing this Ordinance in the Ordinance records of the City. SECTION 9. EFFECTIVE DATE This Ordinance shall be in full force and effect and atter its date of passage, in accordance with law; AND IT IS SO ORDAINED.
