AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT
WITH NATHAN D. MAIER CONSULTING ENGINEERS~ INC. FOR
DESIGN PROPOSALS FOR THE SUTI~)N DRAINANGE CHANNEL PHASE
I AND/OR PHASE II; ATTACHING THE APPROVED FORM OF
CONTRACT AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1. That the City Manager of the City of The Colony, Texas is hereby authorized
to execute on behalf of the City a contract with Nathan D. Maier Consulting Engineers, Inc.. for
Sutton Drainage Channel Design Proposals, Ph. 1 and/or Ph. 2. The approved form of contract is
attached hereto as Exhibit "A", and made a part hereof for such purposes.
SECTION 2. This Ordinance shall take effect immediately from and after its passage by the
City Council of the City of The Colony, Texas.

RE: Engineering Proposal #90-0402 for Phase 1 Sutton Drainage Channel
Improvements, East of FM 423, north of Colon), Blvd.
Dear Mr. Saldana:
Nathan D. Maier Consulting Engineers, Inc. (NDMCE) is pleased to present this
proposal for engineering services for the Phase 1 reach of Sutton Channel that extends
approximately 500-feet east (upstream) of FM 423.
UNDERSTANDING THE PROJECT SCOPE
At FM 423 (Main Street), north of Colony Blvd., the drainage from a 285-acre watershed
concentrates in an earthen drainage ditch that has been named Sutton Drainage
Channel. In the past a gabion channel bank protection has been constructed along the
soL[them limits of lots 60 through 64 of The Colony No. 48 subdivision within the platted
25-foot drainage easement. Recently the City has obtained an additional 40-foot
drainage easement from the Arthur Gibson 4.33-acre tract to the south. A total drainage
easement of 65-feet is available for Sutton Drainage Channel conveyance of
floodwaters.
Currently, about 80-feet upstream of the 4-60" culverts under FM 423, the channel has a
concrete drop structure. Upstream of this structure the stream has a small earthen pilot
channel with wide earthen overb;mks. The channel and overbanks are maintained as a
natural creek allowing for channel erosion patterns and growth of native vegetation. It is
desirable to reduce the erosion pattern that is occurring, to limit the spread of storm
waters to be within the 65-foot drainage easement, and to grade the channel to increase
the channel cross section area which will reduce the average velocities and lower the
elevation of the 100-year design flood profile.
This objective will need structural bank protection along the limits of the southern
easements, either a gabion or concrete bag wall, to protect the bank from erosion. The
grade of the channel between the north and south gabion structures will need to be
flattened to spread the water. Currently the flow is concentrated along the lower
elevation against the northem gabion mat.

SCOPE OF WORK
1. Engineering Design
NDMCE will provide engineenng design, prepare the construction plans and contract
documents (Quantity Bid Schedule and any Supplemental Conditions) for the channel
improvement. We will utilize the City of The Colony standard details to the greatest
extent feasible. The contract documents will utilize NCTCOG standard specifications or
other standards specified by the City. Progress review plans and opinions of probable
construction cost will be provided for City review.
2. Topographic and Design Survey
NDMCE will provide the necessary survey data for design of the project and preparation
of supporting documents. Field survey of the 500-feet upstream of FM 423 will be
needed for design and plan preparation.
3. Drainage Analysis/Project Design/Plan Preparation
NDMCE will perform necessary drainage analysis to size the required channel cross
section and slope. The design discharge will be calculated and a HEC-RAS modeling of
the project will be utilized to insure that the channel is design properly.
Using the field survey topographic mapping as the base map, NDMCE will prepare plans
/ profiles for the construction of the channel and the southern slope protection.
4. Section 404 Permit processing
NDMCE will design the project based on acceptable cdteria that is generally preferred
by the Corps of Engineers. This will include maintaining a meandering Iow flow channel
and providing plantings that wilt restore the biological value of the stream. A Nationwide
Section 404 permit will be obtained for the project.
5. Construction Phase
NDMCE will assist the City in the bid process and evaluate the bids. We will provide
general administrative services during construction including periodic visits to the site to
observe the progress and quality of the executed work to determine, in general, if the
w~3rk is proceeding in accordance with the Contract Documents. NDMCE will provide
basic horizontal and vertical construction control. Construction staking is to be provided
by the Contractor.
SCHEDULE
NDMCE proposes to begin services immediately upon receipt of authorization to
proceed. The site survey, engineering design, and consb'uction plans will be completed
within six (6) weeks.

COMPENSATION
Via an Indefinite Delivery Contract (IDC for Hydrology/Hydraulic Studies) approved by
the City Council on December 18, 2000, NDMCE proposes to accomplish Basic
Services for a fixed fee based on percent complete, and Special Services will be
provided for a Not To Exceed Fee on a "as needed" basis.
Basic Services

404 Permit (not to exceed amount) $ 8,000.00

Additional Special Services
Reimbursable Allowance $ 200.00
TOTAL PROJECT COST $ 29,200.00
Reimbursable expenses that include reproductions, mileage, and deliveries will be billed
as direct reimbursable expenses. Any services requested but not defined in the scope of
services above will be performed on an hourly basis or an agreed lump sum fee.
All services performed will be billed monthly as the project progresses. All invoices will
be dUe within 30 days of invoice date.
TERMINATION OF SERVICES
In connection with the services to be provided to you by NDMCE we agree that you may
cancel or indefinitely suspend further work or terminate this agreement, or any portion of
it, upon wdtten notice to NDMCE, with the understanding that immediately upon receipt
of such notice all work being performed under this proposal, or any portion of it, shall
cease. NDMCE shall provide an invoice for all work completed and shall be
compensated in accordance with the terms of this proposal for all work accomplished by
us prior to the receipt of such notice.

RE: Engineering Proposal #91-0402 for Phase 2 Sutton Drainage Channel
Improvements, North of South Colony Blvd.
Dear Mr. Saldana:
Nathan D. Maier Consulting Engineers, lnc. (NDMCE) is pleased to present this
proposal for engineering services for the Phase 2 reach of Sutton Channel that is north
of South Colony Blvd. and extends approximately 100-feet southwest (downstream)
adjacent to the Good Shepherd Lutheran Church property.
UNDERSTANDING THE PROJECT SCOPE
North of South Colony Blvd., east of FM 423 (Main Street), the drainage from a 260-
acre watershed converges in an earthen ditch from the surrounding drainage systems.
This is the upper end of Sutton Drainage Channel. At the point of convergence from
storm sewer systems and an earthen drainage channel a severe bank and channel
erosion area has developed. This bank erosion is encroaching onto the Good Shepherd
Lutheran Church property and local residential properties. It is desirable to stop the
erosion pattem that is occurring to protect the surrounding properties.
To obtain this objective structural bank protection, either a gabion or concrete bag wall,
will be needed to protect the bank from erosion. The eroded areas will need to be re-
graded to reduce the steep bank slopes.
SCOPE OF WORK
1. Engineering Design
NDMCE will provide engineering design, prepare the construction plans and contract
documents (Quantity Bid Schedule and any Supplemental Conditions) for the channel
improvement. We will utilize the City of The Colony standard details to the greatest
extent feasible. The contract documents will utilize NCTCOG standard specifications or
other standards specified by the City. Progress review plans and opinions of probable
construction cost will be provided for City review.
