ORDINANCE NO. O ~- I ~ ~,~-
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING
THE CODE OF ORDINANCES, CITY OF THE COLONY, TEXAS BY
AMENDING CHAPTER 12, BY AMENDING SECTION 6 RELATING TO
RATES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY
OF FINE NOT TO EXCEED ONE THOUSAND DOLLARS ($1,000.00) FOR
EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED
COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION
OCCURS; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
1. Chapter 12, Section 6 of the Code of Ordinances shall be and is hereby amended in
the following particulars:
Sec. 12-106. Rates.
"(a) Any person receiving water from the City shall be charged and pay for such according to the
following schedule (See Attachment "A '9
(b) Any person receiving wastewater service from the city shall be charged and pay for such
service according to the following schedule (See Attachment "A")
The sewer charge to residential customers will be based on a three (3) month winter
average water use. These three (3) months will reflect the lowest months of usage, with a
minimum charge for 2,000gallons.
(1) Commercial usage will be based on water meter reading according to schedule.
Delete the second paragraph of this section entirely.
(d) A charge set by council resolution shall be added to the utility bill of each customer
receiving wastewater service from the City of The Colony Such charge shall be for the repayment
of the state revolving fund loan acquired for sewer improvements in the City of The Colony".
3. If any section, article paragraph, sentence, clause, phrase or word in this ordinance,
or application thereto any persons or circumstances is held invalid or unconstitutional by a Court of
competent jurisdiction, such holding shall not affect the validity of the remaining portions of this
ordinance; and the City Council hereby declares it would have passed such remaining portions of
this Ordinance despite such invalidity, which remaining portions shall remain in full force and
effect.
4. That this ordinance shall take effect immediately from and after the date of its final
passage and publication as provided by law, and it is accordingly so ordained.
