MAIER CONSULTING ENGINEERS~ INC. FOR SURVEY/ENGINEERING DESIGN; ATTACHING THE APPROVED FORM OF CONTRACT AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. That the City Manager of the City of The Colony, Texas is hereby authorized to execute on behalf of the City a contract with Nathan D. Maier Consulting Engineers, Inc.. for survey/engineering design. The approved form of contract is attached hereto as Exhibit "A", and made a part hereof for such purposes. SECTION 2. This Ordinance shall take effect immediately from and after its passage by the City Council of the City of The Colony, Texas. City Engineer City of The Colony 6800 Main Street The Colony, Texas 75056 RE: Engineering Proposal for 35-Acre Park Site Drainage Channel Improvements East of Paige Road, north of Office Creek to Worley Drive Dear Mr. Saldana: Nathan D. Maier Consulting Engineers, Inc. (NDMCE) is pleased to present this proposal for engineering services for 35-Acre Park Site Drainage Channel 'Improvements east of Paige Road, north of Office Creek to Worley Drive. UNDERSTANDING THE PROJECT SCOPE The storm sewer system that drains the 45-acre watershed from the upper limits at Paige Road and South Colony Blvd. outfalls into an earthen ditch at Wodey Ddve. An additional 15-acres in the undeveloped 35-Acre Park Site drains westerly toward this ditch that parallels Paige Road. This earthen ditch was constructed pdor to the lowering of the TXU gas line and the construction of Office Creek Phase 1 channel improvements. The excavation of this earthen ditch was stopped about 200-feet short of a positive outfall. Currently the storm runoff collects in the excavated portion and overflows into Paige Road thereby causing a flooding condition at the old Office Creek sag point where a 3-60" diameter RCP culvert drains the Home Depot property. To correct this flooding problem a temporary fix is needed until the improvements in the 35-Acre Park Site are constructed (projected to be about five years). The existing excavated drainage channel provides some flood storage volume that can be used as a detention basin. A discharge pipe needs to be sized that will release a design storm discharge that has been routed through the detention reach of the earthen ditch. The pipe will be constructed to discharge into Office Creek upstream of the new Paige Road multiple box culvert. The objective is to maintain a dry channel which will detain storm water, size a discharge pipe large enough to prevent the annual (or possible greater storm event) flooding of Paige Road, and control the erosion at the discharge point in Office Creek. With the future construction of the 35-Acre Park Site detention facilities this outlet pipe may require some modifications at that time. Engineering Design NDMCE will provide engineering design, prepare the construction plans and contract documents (Quantity Bid Schedule and any Supplemental Conditions) for the pipe outfall and any silt removal for the existing earthen channel. We will utilize the City of The Colony standard details to the greatest extent feasible. The contract documents will utilize NCTCOG standard specifications or other standards specified by the City. Progress review plans and opinions of probable construction cost will be provided for City review. 2. Topographic and Design Survey NDMCE will provide the necessary survey data for design of the project and preparation of supporting documents. Field survey of the recently constructed Office Creek channel, the 'existing topography between the channel and the termination of the earthen channel, and some sections of the existing ditch (to determine silt loading) will be needed for design and plan preparation. 3. Drainage Analysis/Project Design/Plan Preparation NDMCE will perform necessary drainage analysis to size the required outlet pipe. The design discharge will be calculated, the available storage volume of the excavated channel will be determined, and an outfall pipe will be designed to control the release into Office Creek. Using the field survey topographic mapping as the base map, NDMCE will prepare plans / profiles for the construction of the outlet pipe and possible sedimentation removal of the existing excavated channel. 4. Construction Phase NDMCE will assist the City in the bid process and evaluate the bids. We will provide general administrative services during construction including periodic visits to the site to observe the progress and quality of the executed work to determine, in general, if the work is proceeding in accordance with the Contract Documents. NDMCE will provide basic'horizontal and vertical construction control. Construction staking is to be provided by the Contractor. SCHEDULE NDMCE proposes to begin services immediately upon receipt of authorization to proceed. The site survey, engineering design, and construction plans will be completed within six (6) weeks. COMPENSATION Via an Indefinite Delivery Contract (IDC for Hydrology/ Hydraulic Studies) approved by the City Council on December 18, 2000, NDMCE proposes to accomplish Basic Services for a fixed fee based on percent complete, and Special Services will be provided for a Not To Exceed Fee on a "as needed" basis. Page 3 February 13, 2002 35-Acre Park Site Drainage Improvements Engineering Proposal Basic Services Engineering Design/Plan Preparation $ 3,600.00 Special Services Field Survey $ 3,000.00 Construction Phase $ 500.00 TOTAL BASIC AND SPECIAL SERVICES $ 7,100.00 Additional Special Services Reimbursable Allowance $ 200.00 TOTAL PROJECT COST $ 7,300.00 Reimbursable expenses that include reproductions, mileage, and deliveries will be billed as direct reimbursable expenses. Any services requested but not defined in the scope of services above will be performed on an hourly basis or an agreed lump sum fee. All services performed will be billed monthly as the project progresses. All invoices will be due within 30 days of invoice date. TERMINATION OF SERVICES In connection with the services to be provided to you by NDMCE we agree that you may cancel or indefinitely suspend further work or terminate this agreement, or any portion of it, upon written notice to NDMCE, with the understanding that immediately upon receipt of such notice all work being performed under this proposal, or any portion of it, shall cease. NDMCE shall provide an invoice for all work completed and shall be compensated in accordance with the terms of this proposal for all work accomplished by us prior to the receipt of such notice.
