AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
AMENDING THE CODE OF ORDINANCES, CITY OF THE
COLONY, TEXAS BY AMENDING CHAPTER 12 BY AMENDING
SECTION 12-110 OTHER FEES AND CHARGES; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City Council of The Colony approved Ordinance No. 03-1435,
dated March 3, 2003; and
WHEREAS, the numbering system contained in that ordinance incorrectly
identified Section 12-110 - Other fees and charges as amending item (b); and
WHEREAS, the correct section for amendment was Section 12-110 - Other fees
and charges, item (c), and leaving item (b) unchanged;
WHEREAS, this amendment to the Code of Ordinance does not affect the
remaining items in Section 12-110, being items (a) and (d);
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS:
SECTION 1.
AMENDMENT
That Chapter 12, of the Code of Ordinances shall be and is hereby amended in the
following particulars:
Amend Section 12-110 (b) and (c)- Other fees and charges, as follows:
"(b) The city shall assess a fee of twenty dollars ($20.00) for reconnecting a
customer to the city water or wastewater system whose service has been disconnected
for non-payment.
(c) The city shall assess a fee of twenty-five dollars ($25.00) for turning on the
water at the request of the customer between the hours of 5:00 p.m. and 8:00 a.m.
weekdays, or at any time on Saturday, Sunday, or any legal holiday, or upon demand
of a customer for immediate service instead of making an appointment."
SECTION 2.
SAVINGS CLAUSE
That the Code of Ordinances of the City of The Colony, as amended shall remain
in full force and effect, save and except as amended by this ordinance.
SECTION 3.
SEVERABILITY CLAUSE
If any section, article paragraph, sentence, clause, phrase or word in this ordinance,
or application thereto any persons or circumstances is held invalid or unconstitutional by a
Court of competent jurisdiction, such holding shall not affect the validity of the remaining
portions of this ordinance; and the City Council hereby declares it would have passed such
remaining portions of this Ordinance despite such invalidity, which remaining portions shall
remain in full force and effect.
SECTION 4.
EFFECTIVE DATE
That this ordinance shall take effect immediately fi.om and after the date of its final
passage and publication as provided by law, and it is accordingly so ordained.
Passed and approved by the City Council of the City of The Colony, Texas this
