AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS
AMENDING CHAPTER 14, SECTION 14-6 BY AMENDING
NUMBERS 3 AND 19, AND BY ADDING ADDITIONAL
UNLAWFUL ACTS WITHIN THE LIMITS OF ANY CITY PARK
IN THE CITY OF THE COLONY; PROVIDING A SAVING
CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING
A PENALTY UPON CONVICTION IN AN AMOUNT NOT TO
EXCEED FIVE HUNDRED DOLLARS ($500.00) AND A
SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH
DAY DURING OR ON WHICH A VIOLATION OCCURS OR
CONTINUES; PROVIDING A PUBLICATION CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 14-6 of the Code of Ordinances provides a listing of
unlawful acts within the limits of any city park in the City; and
WHEREAS, it has been determined that other common issues and/or concerns
should be included and addressed; and
WHEREAS, after due deliberations and consideration, the City Council of the
City of The Colony finds that it is in the public interest to amend Section 14-6 by
amending some of the current prohibited acts and adding other prohibited acts within the
city parks;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF THE COLONY, TEXAS:
SECTION 1.
INCORPORATION OF PREMISES
That the above and foregoing premises are true and correct and are incorporated
herein and made a part hereof for all purposes.
SECTION 2.
AMENDMENT
That The Colony Code of Ordinances be, and the same is, hereby amended by
amending Chapter 14, Section 14-6 by amending numbers 3 and 19, and by adding
additional unlawful acts within the limits of any city park in the City of The Colony,
which shall read as follows:
"Sec. 14-6. Unlawful acts.

Within the limits of any city park, it shall be unlawful for any person to do any of
the acts hereinafter specified, except as may be otherwise provided:
(3) To carry or discharge any firearms, firecrackers, rockets, torpedoes or any other
fireworks, airguns, BB guns, bow and arrows, and/or slingshots.
(19) For any person to possess or consume any alcoholic beverage in any athletic
complex in the city.
(23) To smoke or use tobacco products in athletic complexes except in designated
areas.
(24) To use any designated athletic field without first obtaining a reservation through
the Parks & Recreation Department.
(25) To play golf or hit golf balls on designated athletic fields.
(26) To ride bicycles, skateboards, skates or scooters (motorized and non-motorized) at
athletic facilities, except on areas designated as part of the City's trail system or
other designated areas.
(27) To allow dogs or other pets onto designated athletic fields.
(28) To fail to properly clean up pet waste and dispose of waste in receptacles."
SECTION 3.
PENALTY
It is unlawful for any person to violate any provision of this ordinance, and any
person violating or failing to comply with any provision hereof shall be fined, upon
conviction, in an amount not more than five hundred dollars ($500.00), and a separate
offense shall be deemed committed each day during or on which a violation occurs or
continues.
SECTION 4.
SAVING
Chapter 13 of the Code of Ordinances of the City of The Colony, as amended,
shall remain in full force and effect, save and except as amended by this ordinance.

SECTION 5.
SEVERABILITY
The sections, paragraphs, sentences, phrases, clauses and words of this ordinance
are severable, and if any section, paragraph, sentence, phrase, clause or word in this
ordinance or application thereof to any person or circumstance is held invalid or
unconstitutional by a Court of competent jurisdiction, such holding shall not affect the
validity of the remaining portions of this ordinance, and the City Council hereby declares
that it would have passed such remaining portions of this ordinance despite such
invalidity, which remaining portions shall remain in full force and effect·
SECTION 6.
EFFECTIVE DATE
This ordinance shall become effective from and after its adoption and publication
as provided by law.
