ORDINANCE NO. 04-1531
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, REPEALING
ORDINANCE NO. 04-1522, IN ITS ENTIRETY, AND AMENDING THE
CODE OF ORDINANCES BY AMENDING CHAPTER 12, BY AMENDING
SECTION 6 TO PROVIDE FOR NEW WATER AND SEWER RATES AS
DEPICTED IN EXHIBIT "A", WHICH IS ATTACHED HERETO AND
INCORPORATED HEREIN BY REFERENCE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A PENALTY OF FINE NOT TO
EXCEED ONE THOUSAND DOLLARS ($1,000.00) FOR EACH OFFENSE
AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH
DAY DURING OR ON WHICH A VIOLATION OCCURS; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, on or about January 5, 2004 the City Council adopted Ordinance No. 04-1522,
which provided for an approximate three percent (3%) increase in water and sewer rates to be
effective April 1, 2004; and
WHEREAS, since the adoption &Ordinance No. 04-1522, it has been determined that the
rates which were attached and made a part of the ordinance were incorrect due to a typographical
error; and
WHEREAS, the City Council finds that it would be in the best interest of the City to repeal
Ordinance No. 04-1522 in its entirety and provide for the accurate water and sewer rates to be
effective April 1, 2004;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS:
SECTION 1.
INCORPORATION OF PREMISES
That the above and foregoing premises are tree and correct and are incorporated herein
and made a part hereof for all purposes.
SECTION 2.
REPEAL OF ORDINANCE NO. 04-1522
That Ordinance No. 04-1522, adopted by the City Council on or about January 5, 2004 be,
and the same is, hereby repealed in its entirety.
SECTION 3.
AMENDMENT
That The Colony Code of Ordinances, Chapter 12, Section 6 of the Code of Ordinances shall be
and is hereby amended as follows:
Sec. 12-106. Rates.
"(a) Any person receiving water from the City shall be charged and pay for such according to the
following schedule (See Attachment ",4 '9
(b) Any person receiving wastewater service from the city shall be charged and pay for such
service according to the following schedule (See Attachment "A '9"
SECTION 4.
EFFECTIVE DATE OF RATES
That rates established herein shall take effect on April 1, 2004 and after the date of its
publication as provided by law, and it is accordingly so ordained.
SECTION 5.
SEVERABILITY
If any section, article paragraph, sentence, clause, phrase or word in this ordinance, or
application thereto any persons or circumstances is held invalid or unconstitutional by a Court of
competent jurisdiction, such holding shall not affect the validity of the remaining portions of this
ordinance; and the City Council hereby declares it would have passed such remaining portions of
this Ordinance despite such invalidity, which remaining portions shall remain in full force and
effect.
SECTION 6.
REPEALER CLAUSE
That all provisions of the Ordinances of the City of The Colony, Texas, in conflict with the
provisions of this ordinance be, and the same are hereby amended, repealed, and all other provisions
of the Ordinances of the City not in conflict with the provisions of this ordinance shall remain in full
force and effect.
SECTION 7.
EFFECTIVE DATE
This ordinance shall become effective from and after its adoption and publication as
provided by law.
