AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING
THE CODE OF ORDINANCES, CITY OF THE COLONY, TEXAS BY
AMENDING CHAPTER 12, BY AMENDING SECTION 6 RELATING TO
RATES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY
OF FINE NOT TO EXCEED ONE THOUSAND DOLLARS ($1,000.00) FOR
EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED
COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION
OCCURS; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
1. Chapter 12, Section 6 of the Code of Ordinances shall be and is hereby amended in
the following particulars:
Sec. 12-106. Rates.
"(a) Any person receiving water from the City shall be charged and pay for such according to the
following schedule (See Attachment '91'9
(b) Any person receiving wastewater service from the city shall be charged and pay for such
service according to the following schedule (See Attachment '91'9"
2. That rates established herein shall take effect on April 1, 2004 and after the date of
its publication as provided by law, and it is accordingly so ordained.
3. If any section, article paragraph, sentence, clause, phrase or word in this ordinance,
or application thereto any persons or cimumstances is held invalid or unconstitutional by a Court of
competent jurisdiction, such holding shall not affect the validity of the remaining portions of this
ordinance; and the City Council hereby declares it would have passed such remaining portions of
this Ordinance despite such invalidity, which remaining portions shall remain in full force and
effect.
4. That all provisions of the Ordinances of the City of The Colony, Texas, in conflict
with the provisions of this ordinance be, and the same are hereby amended, repealed, and all other
provisions of the Ordinances of the City not in conflict with the provisions of this ordinance shall
remain in full force and effect.
5. This ordinance shall become effective from and after its adoption and publication
as provided by law.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS THIS 5th day of January 2004.
