AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, CREATING THE DEPARTMENT OF COMMUNITY DEVELOPMENT/FIRE DEPARTMENT; PRO- VIDING FOR THE DUTIES OF THE DIRECTOR OF COMMUNITY DEVELOPMENT/ FIRE CHIEF; AMENDING THE PROVISIONS OF ORDINANCE NUMBER 48 TO MAKE THE DIRECTOR OF COMMUNITY DEVELOPMENT ADMINISTRATIVE AND OPERATIONAL HEAD OF THE FIRE DEPARTMENT; PROVIDING A SEVER- ABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. Pursuant to Section 3.07 of the Colony Home Rule Charter, there is hereby created an administrative department of the City to be known as the Department of Community Development/ Fire Department. The Department shall combine the duties of Building Official, Code Enforcement Official, Animal Control Official, Public Works, Construction superintendent, Volunteer Fire Department Chief and other such duties as may be assigned the Director and the Depart- ment by the City Manager, SECTION 2. The Department of Community Development shall have as its head a Director of Community Development/Fire Chief. The Director shall be appointed by the City Manager with the approval of the Council for an indefinite term and shall report directly to the City Manager as his duties may require. SECTION 3. The Director shall have the following responsibilities; (a) He shall be the Buidling Official for the. City and shall exercise the duties of such Department as may be prescribed by the code and ordinances of the City and by State law. (b) He shall be the chief Code Enforcement Official for the City with respect to any code affecting the construction of any structure within the City. (c) He shall be in charge of all animal control activi- ties for the City. (d) He shall be in charge of all public works of the City, including street maintenance, park maintenance, building and grounds maintenance. (e) He shall act as Superintendent of all building con- struction of any buildings, improvements, streets, alleys or other public improvements of the City. (f) He shall be the adminsitrative and operational head of The Colony Volunteer Fire Department, with responsi- bility for the training of the Volunteer Fire Department. (g) He shall be head of the Civil Defense activities of the City. (h) He shall perform such other duties as may be assigned to the Department of Community Development as its administrative and operational head, and shall supervise all employees within the Department of Community Development. SECTION 4. To the extent that the provisions of this ordinance conflict with the provisions of Ordinance Number 48 with reference to the appointement and duties of the Chief of the Colony Volunteer Fire Department, the provisions of Ordinance Number 48 are repealed. All other ordinances not specifically repealed hereby are continued in full force and effect. SECTION 5. If any section, part of an section, paragraph or clause of this ordinance is declared invalid or unconsti- tutional for any reason, such declaration shall not be held to invalidate or impair the validity, force or effect of any other sections, parts of sections, paragraphs or clauses of this ordinance. SECTION 6. That this ordinance shall take effect immediately from and after its passage and the publication of the caption as the law and charter in such cases provide.
