AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AUTHORIZING ThE
MAYOR TO EXECUTE AN AGREEMENT FOR SERVICES BY AND BETWEEN THE CITY
AND THE COLONY MUNICIPAL UTILITY DISTRICT NUMBER 1; ATTACHING ThE
APPROVED FORM OF THE CONTRACT AS EXHIBIT "A"; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS:
SECTION 1. That the Mayor of the City of The Colony, Texas, be,
and he is hereby, authorized to execute, on behalf of the City of
The Colony, an agreement for services by and between the City and
the Colony Municipal Utility District Number 1 of Denton County,
Texas. The approved form of such contract is attached hereto as
Exhibit "A" and made a part hereof for all purposes.
SECTION 2. This ordinance shall take effect immediately from and
after its passage and the publication of the caption, as the law and
charter in such cases provide.

AGREEMENT FOR SERVICES
This Agreement is made as of the _ day of
1979, by and between The Colony Municipal Utility District No. 1
of Denton County, Texas ("MUD") and the City of The Colony, Texas
("City") after approval of resolution or ordinance of their re-
spective governing bodies authorizing the execution hereof and ac-
cordingly the parties agree as follows:
1. Pursuant to Article 1066b, Texas Revised Civil Statutes,
MUD hereby agrees, under the terms hereof, to provide for City the
services of MUD's Tax Assessor, Board of Equalization and Tax Col-
lector. In the performance of such duties, MUD agrees that its
Tax Assessor and Collector shall
(a) appraise all new properties and improvements to exist-
ing properties;
(b) reappraise properties and improvements thereon where
current assessments have been questioned (but not including
reappraisals pursuant to a general equalization or revaluation)-
(c) prepare the tax rolls for presentation to the Board of
Equalization;
(d) prepare and mail tax statements and rendition forms;
(e) be available for consultation and explanation of the tax
rolls to the Board of Equalization;
(f) pay postage for mailing and statements, renditions and
notices to taxpayers;
(g) maintain current tax rolls, cards and property cards on
each taxable parcel or other taxable property;
(h) taxes collected for City pursuant to this agreement shall
be paid over to City as soon as possible after their collection
in twice monthly payments, on the 1st and 15th of each succeed-
ing month during the term of the agreement.
2. MUD Board of Directors shall timely appoint and pay a Board
of Equalization which shall be the Board of Equalization for both the
MUD and City.
3. MUD agrees to prepare and mail for City one delinquent tax
notice to a City Taxpayer. After such notification the MUD shall
deliver to City a current list of delinquent taxpayers. City shall
thereafter be solely responsible for tax collection of such delin-
quent sums.
4. In consideration of the foregoing services, the City agrees
to provide all reasonable and necessary grounds maintenance for all
MUD facilities. The City agrees to provide the necessary and
appropriate equipment and personnel to perform such maintenance
functions. In this connection, City estimates that it will fur-
nish personnel equivalent to a total of one man day per week for
the entire one (1) year term of this agreement. Such man days
may be grouped together in any manner convenient to MUD to perform
such maintenance functions. It is anticipated and agreed that the
exchange of these services for the tax services to be performed by
MUD will be substantially equivalent to the actual cost of MUD
providing such tax services to the City.
5. MUD agrees that if reasonably necessary or required by law,
City may perform at its expense an independent audit of MUD's tax
records with regard to the performance of the tax services enumer-
ated above. For purposes of such audit City may have access to
MUD's tax records during reasonable business hours. In lieu of
the same, MUD may furnish the City with a certified audit of such
tax records. MUD agrees to cooperate with the City in collection of
delinquent taxes by furnishing necessary delinquent tax statements
unpaid after the notification provided in paragraph 3. above.
6. If upon termination of this agreement the City desires a
duplicate set of MUD's tax records applicable to the City, MUD shall
so deliver the copy of the records to the City upon payment to MUD
of the costs of duplicating such records.
7. This agreement shall terminate on December 31, 1980. This
agreement is intended to cover tax service and grounds maintenance
service for the fiscal year ending September 30, 1980.
