AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, ANNEXING THE
HEREINAFTER DESCRIBED TERRITORY TO THE CITY OF THE COLONY, DENTON
COUNTY, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO
AS TO INCLUDE SAID PROPERTY WITHIN SAID CITY LIMITS AND GRANTING
ALL PRIVILEGES OF OTHER CITIZENS AND BINDING ALL INHABITANTS BY
ALL THE ACTS, ORDINANCES AND REGULATIONS OF SAID CITY; PROVIDING
FOR THE EXTENSION OF THE EXTRATERRITORIAL JURISDICTION OF THE CITY;
PROVIDING SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE OF
SAID ORDINANCE.
WHEREAS, the City of The Colony Staff has heretofore proposed
the annexation of all the property hereinafter described, request-
ing the City Council to annex said territories and extend the
corporate limits of said City; and,
WHEREAS, after holding public hearing under the provisions of
Article 970a of the Revised Civil Statutes of Texas; and,
WHEREAS, the following described land is adjoining the present
City Limits of the City of The Colony, and the members of the City
Council of the City of The Colony have concluded that said area
should be annexed and made a part of the City of The Colony, Texas:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS:
SECTION 1. That the following described territory be, and
the same is hereby annexed to the City of The Colony, Denton County,
Texas, and the boundary limits of the City of The Colony be, and
the same are hereby extended to include the following described
territory within the City Limits of the City of The Colony, and
the same hereafter shall be included within the territorial limits
of said City, and the inhabitants thereof hereafter shall be en-
titled to all rights and privileges of other citizens of the City
of The Colony; and shall be bound by the acts, ordinances, reso-
lutions and regulations of said City. That the territory to be so
annexed is more particularly described as follows, to -wit:
(1) FIRST TRACT: All that certain tract or parcel of
land situated the B.B.B. and C.R.R. Survey, Abstract
173, Denton County, Texas, being a part of a certain
tract conveyed by Nelson Griffin, et ux, to Dick Chaplin,
et ux, lying between the west line of said survey and
the west right-of-way of F.M. Road 423, designated for
convenience as Tract No. 1-A in a subdivision for said
Chaplin, and being more particularly described as follows:
BEGINNING at a steel pin in a fence on the West line of
said tract and said survey at a point North 0 degrees
23' East 476.1 feet from the West Southwest corner of
said survey;
THENCE North 0 degrees 23' East with said fence on said
line 236.4 feet to a steel pin;
THENCE South 88 degrees 59' East 277.0 feet to a corner;
THENCE South 0 degrees 41' West 235.4 feet to a corner;
THENCE North 88 degrees 59' West 275.75 feet to the place
of beginning.
SECOND TRACT: All that certain tract or parcel of
land situated in the B.B.B. and C.R.R. Survey, Abstract
173, Denton County, Texas, being a part of a certain
tract conveyed by Nelson Griffin, et ux, to Dick Chaplin,
et ux, lying between the West line of said survey and
the West right-of-way of F.M. Road 423, designated for
convenience as Tract No. 1-B in a subdivision for said
Chaplin and being more particularly described as follows:
BEGINNING at a steel pin on the West right-of-way of
F.M. Road 423 at a point N. 0 degrees 23' East 476.1 feet
and South 88 degrees 59' East 551.5 feet from the West
Southwest corner of said survey;
THENCE North 0 degrees 59' East with said right-of-way
221.4 feet to a corner;
THENCE North 88 degrees 59' West with the South line of
said road 277.0 feet to a corner;
THENCE South 0 degrees 41' West 221.4 feet to a steel pin;
THENCE South 88 degrees 59' East 275.75 feet to the place
of beginning.
(2) All that certain parcel or tract of land situated in
the B.B.B. & C.R.R. Co. Survey, Abstract 173, Denton
County, Texas, being out of the Southwest corner of a cer-
tain (called) 205.0 acre tract described as the FIRST TRACT
and deeded from Stephen H. Griffen, et ux, to Nelson H.
Griffen on December 10, 1952, recorded in Volume 383, Page
132, Deed Records of said county, this tract being more
particularly described as follows;
BEGINNING at a steel fence at the Southwest corner of said
205.0 acre tract, same being the West Southwest corner of
said B.B.B. & C.R.R. Co. Survey, Abstract 173, and the
Southeast corner of the B.B.B. & C.R.R. Co. Survey, Abstract
181;
THENCE N. 0 degrees 23' E. with the fence on the West line
of said tract and said survey 476.1 feet to a steel stake
in said fence;
THENCE S. 88 degrees 59' E. 551.5 feet to a steel stake for
corner in the West right-of-way of F.M. Road 423;
THENCE S. 0 degrees 59' W. with said right-of-way 476.1 feet
to a steel stake for corner in the South line of said 205.0
acre tract and said survey near a fence corner;
THENCE N. 88 degrees 59' W. with a fence on said line 546.5
feet to the place of beginning, containing in all 6.000
acres of land.

SECTION 2. That it is not the intention of the City of The
Colony to annex any territory not legally subject to being annexed
by said City, and should any portion of the above described terri-
tory not be subject to legal annexation by the City of The Colony,
such fact will not prevent the City from annexing such territory
which is above described and is subject to legal annexation by
the City, and it is the intention of the City of The Colony to
annex only such territory as may be legally annexed by it within
the limits of the above described area.
SECTION 3. That this ordinance shall take effect immediately
from and after its passage and the publication of the caption as
the law and charter in such cases provide.
