ORDINANCE NO.
AN ORDINANTCE OF THE CITY OF THE COLONY, TEXAS, AUTHORIZING
THE CITY MANAGER TO EXECUTE A LEASE PURCHASE AGREEMENT BETWEEN
THE CITY AND LONE STAR DODGE FOR THE LEASE OF POLICE PATROL CARS
AND AUTHORIZING THE CITY MANAGER. TO EXPEND FROM THE GENERAL FUNDS
OF THE CITY SUCH AMOUNTS AS ARE NECESSARY TO PAY THE LEASE RENTAL
WHICH WILL COME DUE DURING THE CURRENT FISCAL YEAR: PROVIDING A
SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, IN COMPLIANCE WITH THE BIDDING REQUIREMENTS IMPOSED
BY LAW THE CITY RECEIVED A BID FROM LONE STAR DODGE, 12000 EAST
NORTHWEST HIGHWAY AT GARLAND ROAD, DALLAS, TEXAS, FOR CERTAIN
POLICE PATROL CARS, WHICH SAID BID WAS ACCEPTED, AND
WHEREAS, IT IS THE DESIRE OF THE CITY OF THE COLONY, TEXAS, AND
LONE STAR DODGE TO ENTER INTO A LEASE PURCHASE AGREEMENT FOR SAID
VEHICLES, THE ULTIMATE PURCHASE PRICE TO BE GOVERNED BY SUCH BID
PROPOSAL IN THE EVENT THE OPTION TO PURCHASE IS EXERCISED, NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COL(YtlY,
TEXAS:
SECTION 1. The City Manager of the City of The Colony, Texas, is hereby
authorized to execute that certain "lease purchase agreement" between Lone Star
Dodge and The Colony, Texas, a copy of which is attached hereto as Exhibit No. 1
and made a part hereof for all purposes. That said City Manager is further authorized
to execute the "certificate of acceptance," a copy of which is attached hereto as
Exhibit No. 2 upon receipt of the police patrol cars and related eauipment which are
the subject of said lease purchase agreement. Said City Manager is further authorized
to expend from current reveneus such funds as are necessary to make such lease rental
payments during the current fiscal year.
SECTION 7.. Whereas the option to purchase set forth in the lease purchase
agreement attached hereto as Exhibit No. 1 is based upon the bid proposal of Lone
Star Dodge dated August 17, 1979, the City's prior acceptance of said bid is hereby
ratified for all purposes.
SECTION 3. SEVERABILITY CLAUSE. If any section, part of anv section,
paragraph or clause of this ordinance is declared invalid or unconstitutional for anv
reason, such declaration shall not be held to invalidate or impair the validity, force
or effect of any other sections, part of sections, paragraphs or clauses of this ordinance.
SECTION 4. EFFECTIVE DATE. This ordinance shall become effective from
and after its passage as the law in such cases provides.
