AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, PROVIDING DEFINITIONS; REGULATING THE OPERATION OF BICYCLES IN BUSINESS DISTRICTS OF THE CITY; PROVIDING FOR RESPONSIBILITY OF PARENTS OR GUARDIANS OF MINORS; PROVIDING A SEVERABILITY CLAUSE; PRO- VIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. For purposes of this ordinance the following words shall have the meaning ascribed to them: Bicycle. The word "bicycle" shall mean any light vehicle having two wheels, one behind the other, a steering handle or handlebars, a saddle, seat or seats, and pedals by which it is propelled. iness Districts. The term "business districts" shall mean those areas within the city limits which are zoned and are used for Mercantile activities or transactions having for their purpose the supplying of comodities or services, and specifically including shopping centers and shopping center parking lots and the appurtenances thereto. SECTION 2. No persons shall ride a bicycle on a sidewalk in a business district, and all persons riding on a sidewalk in other districts shall yield the right-of-way to all pedestrians. No person riding a bicycle in any district shall carry any packages, bundles or articles of any kind which prevent the rider from having at least one hand upon the handlebars. The operator of any bicycle in the City shall not carry any other person upon the handlebars or. frame upon such bicycle, nor shall any other person so ride upon any such bicycle. The operator of any bicycle shall not ride other than astride a permanent and regular seat and no bicycle shall be used to carry more persons at one time than the number for which it was designed and equipped. Persons riding bicycles upon the streets of the City shall not ride more than two abreast and shall ride in single columns only when riding such bicycles in motor vehicle traffic. A bicycle being ridden in the street shall proceed only in the same direction as the vehicular traffic flow, and shall be subject to all of the traffic regulations. Every bicycle operated after sunset and before sunrise shall be equipped with a lamp on the front which shall emit a white light visible from a distance of at least 500 feet to the front and a red light visible to the rear, except that a red reflector having a minimum diameter of 2 inches may be used in lieu of a rear light. No rider of any bicycle shall remove both hands from the handlebars or feet from the pedals, or practice any acrobatics or stunts riding upon any street, nor shall any person operating a bicycle upon a street, alley or highway of the City participate in any race or speed contest. No person shall park a bicycle other than against the curb or on the sidewalk in a rack or against a building in such a manner as to afford the least obstruction to pedestrian or other traffic. SECTION 3. The parent of any child and the guardian of any ward shall not authorize or knowingly permit any such child or ward who would not be subject to prosecution in the Municipal Court to violate any of the provisions of this ordinance. SECTION 4. The provisions of this ordinance are severable, and should any section, paragraph, sentence, clause or phrase hereof be declared unconstitutional or void, such declaration shall not effect any of the remaining portions hereof. SECTION 5. Any person violating any'of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction in the Municipal Court of the City of The Colony, Texas, shall be fined in an amount not to exceed the sum of Two Hundred Dollars ($200.00) for each offense. SECTION 6. This ordinance shall take effect immediately from and after its passage and the publication of the caption as the law and charter in such cases provide.
